TITLE: Marina Park Coastal Land Use Plan Amendment (PA2012 -079)
1600 West Balboa Boulevard
ABSTRACT:
Amendment of Coastal Land Use Plan (CLUP) Policy No. 4.4.2 -1 to allow a tower
feature within the City's previously approved Marina Park project to exceed the 35 -foot
shoreline height limitation zone. The Marina Park project was approved by the City
Council in May of 2010, and it included a 71 -foot tall landmark tower feature depicting a
lighthouse. No changes to the approved plans are proposed.
RECOMMENDATION:
1) Conduct a public hearing.
2) Adopt the attached draft Resolution (Attachment CC -1) that:
a. Finds the California Environmental Quality Act ( "CEQA ") to be satisfied by the
May 11, 2010, City Council certification of the Marina Park Project Environmental
Impact Report (EIR) (SCH # 2008051096) in compliance with the California
Environmental Quality Act (CEQA), the State CEQA Guidelines, and City Council
Policy K -3, and
b. Approves Coastal Land Use Plan Amendment No. LC2012 -002.
FUNDING REQUIREMENTS:
There is no direct fiscal impact related to this item.

DISCUSSION:
The project site is approximately 10 acres and is developed with 57 mobile homes, the
Girl Scout house, park and recreation facilities (community center, tot lot, basketball
courts, public tennis courts, public access) and a surface parking lot. The site is
bordered to the east by a Parking lot, the American Legion Post 291, residential and
commercial uses, and 15" Street; to the south by West Balboa Boulevard, and
residential uses; and to the west by 18th Street, a hotel, and residential uses. The
General Plan Land Use Element designates the site as Park and Recreation and the
site is zoned Planned Community.

Background
The City Council approved the concept plan for the Marina Park project in May of 2010,
following years of planning, public input, and certification of the Marina Park
Environmental Impact Report (EIR). The EIR evaluated the visual impact of a 73 -foot
tall tower and it concluded that there was no significant impact to public views. The

architectural tower was ultimately approved at 71 feet as an iconic landmark to promote
aid in project identification and wayfinding. It was approved on the basis that the Zoning
Code allows for base height limits to be exceeded. After modest refinement by the
Marina Park Committee, the project was submitted to the California Coastal
Commission.
The Coastal Commission approved the project in June 2012, but limited the tower
feature to 35 feet on the basis that it did not comply with Coastal Land Use Plan Policy
4.4.2 -1. Commissioner comments revealed concerns that, if approved without an
amendment to the policy, the additional height could create precedent for future
increases in height. This concern was echoed by Coastal Commission staff, therefore,
the proposed amendment has been drafted to only apply to the Marina Park project.
The genesis of Policy 4.4.2 -1 was the Shoreline Height Limitation Zone that was
adopted by the City in the early 1970's to regulate and control development pressures
within the harbor area and to reduce impacts to public views. Non - residential structures
are limited to 35 feet in height and it includes West Newport, areas surrounding the
harbor, and it extends inland to the Back Bay.
Proposed Amendment
Although the approved plan includes a 71 -foot high tower resembling a lighthouse, the
request is to amend Coastal Land Use Plan Policy No. 4.4.2 -1 to allow a 73 -foot high
architectural tower. The proposed amendment is underlined below:
Coastal Land Use Policy 4.4.2 -1
Maintain the 35 -foot height limitation in the Shoreline Height Limitation Zone, as
graphically depicted on Map 4 -3, except for the following site.
Marina Park located at 1600 West Balboa Boulevard: A single, up to 73 -foot tall
architectural tower that does not include floor area but could house screened
communications or emergency equipment. The additional height would create an
iconic landmark for the public to identify the site from land and water and a visual
focal point to enhance public views from surrounding vantages.
Analysis
The tower is considered a critical element of the project by facilitating navigation of
watercraft for new visitors, as well as to draw the beach going public into the park. In
addition to this functional role, the tower is anticipated to become an iconic feature for
the facility which reflects the City's history and culture.

The City in approving the Marina Park project evaluated potential view impacts that may
be created by the tower feature and concluded, that while visible from designated
viewing areas where public views are protected, it is not bulky, obtrusive, or otherwise
objectionable in nature. Some suggest that the tower feature enhances the view by
providing an architecturally coordinated and pleasing focal point within the view.
In approving the Marina Park project in 2010, the City Council made the requisite
findings and took the necessary discretionary actions to permit the tower feature to
exceed the "base" height of the zoning district.
Given the specific nature of the amendment, it could not be used as a precedent for
other future projects. Future projects would be subject to a site specific analysis to
demonstrate a less than significant visual impact prior to receiving any similar
consideration. It seems clear that a future amendment of this policy will be necessary to
provide a policy basis within the Local Coastal Program Implementation Plan to
consider future minor architectural variations or Variances similar to how the Zoning
Code provides. Future projects that propose significant deviation from 35 -foot limit or
future Implementation Plan regulations would require a site specific amendment to this
policy.
PlanningCommission Recommendation Recommendation
On July 5, 2012, the Planning Commission considered the proposed amendment at a
noticed public hearing (Attachment CC -2). At the conclusion of the meeting,
Commission adopted Planning Commission Resolution No. 1889 recommending

adoption of the proposed amendment (Attachment CC -3). The Commission modified
the proposed policy to reflect a 73 -foot high tower as that was the height evaluated in
the EIR. This change would permit a modest amount of flexibility to change the design
that currently has the tower at 71 feet.
Alternatives
1. The City Council could decline to approve the proposed amendment. This option
would result in the construction of the Marina Park project with the architectural
tower being limited to 35 feet.
2. The City Council may modify the proposed amendment to a specified height that is
less than 73 feet.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find the requirement for environmental review
pursuant to CEQA satisfied by the Marina Park Project Environmental Impact Report
(EIR) (SCH # 2008051096) that was certified by the City Council in compliance with the
California Environmental Quality Act (CEQA), the State CEQA Guidelines, and City
Council Policy K -3 on May 11, 2010. The architectural tower at 73 feet high was
evaluated in the EIR, therefore no further environmental analysis is required. Copies of
the Marina Park Project Environmental Impact Report are available for public review
and inspection at the Planning Division or at the City of Newport Beach website at
www.newportbeachca.gov.
NOTICING:
Notice of this hearing was published in the Daily Pilot and on the City's website, mailed
to property owners within 300 feet of the project site and posted at the site, a minimum
of 10 days in advance of this hearing consistent with the Municipal Code. Additionally,
the item appeared upon the agenda for this meeting, which was posted at City Hall and
on the City website.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING COASTAL LAND USE PLAN
AMENDMENT NO. LC2012 -002, MODIFYING POLICY 4.4.2 -1 TO
ALLOW AN ARCHITECTURAL TOWER AT 1600 WEST
BALBOA BOULEVARD (PA2012 -079)
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH HEREBY FINDS AS FOLLOWS:
SECTION 1. STATEMENT OF FACTS.
Between 2007 and 2009, working with residents, the citizen group Protect our Parks,
the Harbor Commission and the 9- member Council /Citizens Advisory Committee, the
City developed the plan to replace the current mobile home park between 18th Street
and 15th Street along West Balboa Boulevard with a visitor - serving use.
2. The Marina Park Committee was formed to oversee the design of the project and
advise the Council regarding the community and stakeholder interests. The Marina
Park Committee conducted fourteen public meetings between 2009 and 2011.
3. In March 2009, the City Council approved the concept plan for a visitor - serving marina,
a community building, a sailing center building that included a 71 -foot high
architectural tower, a new Girl Scout meeting house, parking, a tot play area,
restrooms, and lots of open grassy space for picnicking.
4. The Marina Park Project Environmental Impact Report (EIR) (SCH # 2008051096)
was certified to the City Council in compliance with the California Environmental
Quality Act (CEQA), the State CEQA Guidelines, and City Council Policy K -3 on May
11, 2010.
5. The project was submitted for approval and permitting by the California Coastal
Commission and was conditionally approved on June 13, 2012. Approval was
conditioned to reduce the height of the architectural tower to 35 feet.
6. In accordance with California Code of Regulations, Section 13515[c], notice of
availability of the proposed amendment to the Coastal Land Use Plan was mailed to:
1) members of the public requesting such notices; 2) contiguous and affected local
governments; 3) various regional, state, and federal agencies, and 4) local libraries
and media.
7. The Planning Commission conducted a public hearing on July 5, 2012, in the City Hall
Council Chambers, 3300 Newport Boulevard, Newport Beach, California. A notice of
time, place and purpose of the meeting was given in accordance with the Newport
Beach Municipal Code. Evidence, both written and oral, was presented to, and
considered by, the Planning Commission at this meeting. At the conclusion of the
hearing, the Planning Commission adopted Planning Commission Resolution No.

1889 recommending adoption of Coastal Land Use Plan Amendment No. LC2012-
002.
8. A public hearing was held on July 24, 2012, in the City Hall Council Chambers, 3300
Newport Boulevard, Newport Beach, California. A notice of time, place and purpose of
the meeting was given in accordance with the Newport Beach Municipal Code.
Evidence, both written and oral, was presented to, and considered by, the City Council
at this meeting.
SECTION 2. CALIFORNIA ENVIRONMENTAL QUALITY ACT DETERMINATION.
1. The Marina Park Project Environmental Impact Report (EIR) (SCH # 2008051096)
was certified to the City Council in compliance with the California Environmental
Quality Act (CEQA), the State CEQA Guidelines, and City Council Policy K -3 on May
11, 2010.
2. The 73 -foot high tower element was included in the project description analyzed in the
EIR which concluded that the potential impact of the project on public views and
access would be less than significant. Therefore, the EIR concluded that the project,
including the tower element, was consistent with the goals and policies of the Coastal
Land Use Plan and the California Coastal Act.
SECTION 3. FINDINGS.
1. Amendments to the Coastal Land Use Plan are a legislative act. Neither the City nor
State Planning Law set forth any required findings for either approval or denial of such
amendments.
2. The amendment of the Coastal Land Use Plan will allow for a tower feature to be
incorporated into the previously approved Marina Park Project. The tower, which will
depict a lighthouse, is considered a critical feature of the project in that it provides an
iconic element of a public facility and will assist in wayfinding for the public from land
and water.
3. The analysis of the proposed project and architectural tower element demonstrate no
impacts to designated public view sheds or public access. The project analysis
demonstrated the project, including the 73 -foot tower element, would be in compliance
with the California Coastal Act. In that the subject amendment would only allow a
tower element on the subject site, the amendment is also consistent with the Coastal
Act.

SECTION 4. DECISION.
NOW, THEREFORE, BE IT RESOLVED:
1. The City Council of the City of Newport Beach hereby approves of Coastal Land Use Plan
Amendment No. LC2012 -002, modifying Policy No. 4.4.2 -1 to read as follows (changes
are underlined):
4.4.2 -1. Maintain the 35 -foot height limitation in the Shoreline Height Limitation Zone, as
graphically depicted on Map 4 -3, except for the following site.
Marina Park located at 1600 West Balboa Boulevard: A single, up to 73 -foot tall
architectural tower that does not include floor area but could house screened
communications or emergency equipment. The additional height would create an
iconic landmark for the public to identify the site from land and water and a visual
focal point to enhance public views from surrounding vantages.
2. The Community Development Director is authorized to submit the Coastal Land Use Plan
Amendment No. LC2012 -002 to the California Coastal Commission for review.
3. Coastal Land Use Plan Amendment No. LC2012 -002 shall become effective upon
approval from the California Coastal Commission unless modifications to the amendment
are required as a result the Coastal Commission's approval. If the California Coastal
Commission approves and does not modify the amendment, no further action will be
required by the City Council. If the California Coastal Commission approves a modified
amendment, the amendment shall require a separate action by the City Council following
Coastal Commission approval.
Passed and adopted by the City Council of Newport Beach at a regular meeting held on July 24,
2012, by the following vote to wit:

ITEM NO.4 MARINA PARK PROJECT (PA2012 -079)
Site Location: 1600 W. Balboa Boulevard
Principal Planner Jim Campbell presented details and provided a PowerPoint presentation of the report
addressing the previous approval of the project by the City Council, the location, and a description of the
project. He noted that the architectural tower of the building modified by the Coastal Commission. He
referenced preparation of a certified EIR and the conclusion that there were less than significant impacts to
public views. He presented the site plan, the tower /lighthouse feature and modification by the Coastal
Commission of the height. He noted that the Coastal Commission was concerned about setting precedence
for future projects and he presented details of the proposed amendment. Mr. Campbell noted a change in the
proposed amendment from the draft presented in the staff report creating specific language to support the
proposed 71 -foot high tower and including a purpose statement. Mr. Campbell indicated staffs
recommendation for approval.
In response to an inquiry from Chair Toerge, Mr. Campbell reported that the proposed building is 35 feet.
In response to Commissioner Tucker's request, Mr. Campbell indicated that the design process was extensive
and it was publically vetted.
Responding to Vice Chair Hillgren's inquiry regarding the tower height, Mr. Campbell noted that the EIR
evaluated a 73 -foot high tower but that the current city- approved design calls for 71 feet.
Commissioner Amen inquired regarding whether the item must return to the Coastal Commission if the
Planning Commission approves the height of the tower at 71 feet.
Mr. Campbell reported that the amendment requires review by the Coastal Commission and if approved by the
City. If the Coastal Commission approves the amendment, the project itself will require a subsequent review.
He added that staff will try its best to expedite the process.
Assistant City Attorney Mulvihill reported that she was at the Coastal Commission hearing where they
considered the matter and approved the project with the exception of the large architectural element. She
added that they had a problem relative to the height limit in the City's Zoning Code and stated approval of the
amendment should not impede approval of the project. She added that part of the process is to have the
Planning Commission review it.
Interested parties were invited to address the Commission on this item.
Jim Mosher felt the building would look as good with the tower as without it and he commented about a
statement made by the City's consultant to the Coastal Commission indicating that an existing tsunami warning
hom would be removed from its current location and placed on the proposed tower. He questioned how that
would work.
Dan Purcell commented on the tower as being a faux lighthouse and expressed the opinion that this project will
be used to justify other projects. He also expressed concerns with maintenance.
Catherine Callahan stated her agreement with the previous speakers and she felt that public opinions were
overlooked and that the tower is overkill and would be an eyesore.
Elliott Vaughn agreed with previous speakers and addressed placement of the tsunami warning horns noting
the City's consultant mentioned that it would be placed above the tower. He requested that language be added
to reflect that nothing over 71 feet should be built or added.
Mr. Campbell reported that the project does not include a specific design to incorporate the tsunami warning
system or any other communications equipment. The policy sets for the ability to potentially use the tower for
the tsunami or communications equipment in the future.

Commissioner Ameri stated agreement with specifying that nothing should be built or installed above 71 feet.
There being no others wishing to address the Commission, Chair Toerge closed public comments for this item.
Commissioner Brown indicated he will support the project, primarily because of the iconic value.
Motion was made by Commissioner Kramer and seconded by Commissioner Brown, and carried (7 — 0), to
adopt a resolution recommending the City Council approve the amendment to the Coastal Land Use Plan
No. LC2012 -002. 1.1
Mr. Campbell requested clarification regarding the motion such that the amendment would include the revised
language presented by the separate memorandum and not the language within the staff report or draft
resolution. Commissioner Kramer and Brown indicated that understanding.
Discussion followed regarding the possibility of considering increasing the height "up to 73 feet."
Commissioner Kramer and Commissioner Brown amended the motion to include language in the resolution
placing a height limit to not over 73 feet.
Commissioner Ameri suggested adding language indicating "a minimum of 71 feet and up to a maximum of 73
feet ".
Substitute motion by Commissioner Ameri to add language indicating "a minimum of 71 feet and up to a
maximum of 73 feet ". The substitute motion failed for lack of a second.
Commission Vote on the motion.

Community Development Director Brandt introduced the item noting it has been continued several times
and addressed direction by the Planning Commission. She reported that staff incorporated the comments
provided by the Planning Commission and presented a draft copy of the By Laws with the changes. She
asked for additional feedback so that staff can return to the Planning Commission with a final copy of the
By Laws at its next meeting for formal adoption.
She affirmed that typically, the election of officers is scheduled for the first meeting in July, but that it will
be set for the Planning Commission's next meeting.
Vice Chair Hillgren inquired regarding the length of time recordings of meetings are required to be kept.
Assistant City Attorney Mulvihill reported that there is a requirement under State law, but that the City has
expanded that requirement in its records retention policy. She stated that is City policy and not required in
the By Laws.

Thank you for the opportunity to comment on the proposed draft amendment. Our comments are
found below:
The proposed amendment language states that the tower "...does not include floor area but could
house screened communications or emergency equipment'. This language is too vague. The
specific uses that will be housed in this tower must be specifically identified if the inclusion of such
device(s) is necessary to justify a specific increase in height. The policy language must also
specifically state that this tower "shall" include these uses.
The 2nd sentence of the proposed amendment language states: "The additional height would create
an iconic landmark for the public to identify the site from land and water and a visual point to enhance
public views from surrounding vantages." Commission staff recommends you strike out"... water and
." From our discussions, you have
focused on the idea that the tower would serve as an iconic public landmark that can be seen from
land and water. Inclusion of the additional language does not enhance the idea you are attempting to
convey. Even more so, if you are trying to justify the excessive height ( +71') of this structure by
attempting to convey that this tower would enhance public views, we disagree since we feel it would
significantly adversely impact public views. Justification for the excessive height of this structure
must be clear and enhancing public views is not one of those reasons. If it is necessary for
something such as public safety for the inclusion of a tsunami warning device or for navigation
purposes, etc., then state that specifically and make that argument. Thus, please remove and alter
your language appropriately.
As discussed during our previous phone call discussion, please remember that the submitted Land
Use Plan Amendment must include graphics and a thorough discussion of how you justify the
excessive height ( +71') of the tower at this specific location and how it is visually compatible with the
character of the surrounding area.

Hello everyone. Thank you for considering my thoughts when you vote on several 7 /24/2012 agenda items.
Item 3 — Removal of parking restrictions on Balboa Blvd. The signs should have been removed several decades ago.
They serve no purpose. They restrict parking before 6:OOPM, yet allow parking during the summer weekend mass
exodus from the peninsula -- generally sometime between 6:30PM and 8:OOPM (depending on weather and sunset
time).
Item 16 — Marina Park Coastal Land Use Plan Amendment. It would be a missed opportunity to not to include an
iconic design element in the Marina Park project. I've attended nearly every Marina Park related meeting in the past
many years and I can't recall a better "iconic" idea than the lighthouse. A 35ft lighthouse is a ridiculous notion. It simply
doesn't fit the scale of the buildings. So, I'm either for a properly scaled lighthouse (71' sounds good to me), or no
lighthouse.
Item 13 — Phase 11 Lower Bay Dredging. All I can say is DREDGE, DREDGE, DREDGE —if the funds are available. I was
out in the main channel the other day and watched some kids "turtle" a Lido 14. The funny thing was that the head of
the sails were scooping mud long before the boat was upside down. It's not that deep out there —as you all well know!
As for Banning Ranch, I still haven't a clue. But, I'll let you know after wading through the staff report this weekend.
Oh, and I really liked the policy of not supporting private political fundraisers with public funds. As much as we would all
like any presidential candidate to come visit us, if it's private then the folks giving the party should pay for city services.

Maintain the 35 -foot height limitation in the
Shoreline Height Limitation Zone, as graphically
depicted on Map 4 -3, except for the following site.
Marina Park located at 1600 W. Balboa Boulevard: A
single, up to z�-foot tall architectural tower that does
not include floor area but could house screened
communications or emergency equipment. The
additional height would create an iconic landmark for
