The attached resolution would implement a City Council approved line of succession for such appointments. RECOMMENDATION: Adopt Resolution No. 2012- 75 relating to the designation of persons to serve as "managers pro tempore" in the City Manager's temporary absence or disability. FUNDING REQUIREMENTS: The adoption of a "manager pro tempore' line of succession is not anticipated to have any fiscal impact. DISCUSSION: Charter Section 507 requires the City Manager to appoint, subject to the approval of the City Council, one of the other City officers or department heads to serve as "manager pro tempore" during temporary absence or disability. My typical practice if I am going to be away from the City for any length of time (generally a full workday or series of days) is to appoint a department director to assume management of the City in my absence, and then notify the City Council, management group, and Police Watch Commander of Designation of Manager pro Tempore August 14, 2012 Page 2 my appointment. The director chosen is typically someone who will be nearby during that period with no out of town commitments. Recently, I received comments from some members of the public there should be a more formal process under Charter Section 507 (i.e., creation of a chart depicting the order of "manager pro tempore" appointment that is approved in advance by City Council resolution). I agree. As such, attached to this staff report is a "manager pro tempore" line of succession plan that may be reviewed and approved by the City Council. If approved, I will use this line of succession to make "manager pro tempore" appointments pursuant to the order provided (i.e., start with the first position and work my way down the list in order until an appointment is made). I will also work closely with the City's Public Information Manager to ensure notice is provided to the public of my appointment (e.g., posting on the web site, etc.). ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). Submitted by: Dave Kiff, City Manager Attachment: Resolution Designation of Manager pro Tempore August 14, 2012 Page 3 RESOLUTION NO. 2012- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH RELATING TO CHARTER SECTION 507 AND THE DESIGNATION OF MANAGER(S) PRO TEMPORE WHEREAS, the City of Newport Beach is a Charter City with the Council - Manager form of government; and WHEREAS, the City Charter's section 507 directs that the City Manager designate, and the Council approve, a Manager Pro Tempore to serve as City Manager during the temporary absence or disability of the City Manager; and WHEREAS, the City Manager has suggested that the City Council consider approving a line of succession for Managers pro Tempore to comply with the Charter and in the event that the City Manager is absent or disabled; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that the City Council hereby approves the City Manager's recommendation of the following line of succession to serve in the manager's stead during any time of temporary absence or disability: 1. Assistant City Manager 2. Public Works Director or Municipal Operations Director 3. Police Chief or Fire Chief 4. Finance Director 5. Community Development Director, Human Resources Director, Library Director. or Recreation and Senior Services Director BE IT FURTHER RESOLVED by the City Council of the City of Newport Beach that the adoption of this resolution expresses the City Manager's and the City Council's compliance with City Charter Section 507 relating to the designation of a Manager pro Tempore.
