Komen - Race for the Cure" Banners — Approval of Encroachment Permit N2012 -0227 ABSTRACT: "Susan G. Komen - Race for the Cure" is requesting approval to install 40 banners on City owned streetlights along various roadways within the City rights -of -way for the 21st annual Race for the Cure event. RECOMMENDATION: Conditionally approve the request of "Susan G. Komen — Race for the Cure" for installation of 40 banners, from August 23, 2012, to September 24, 2012, for the annual Race for the Cure. Installation will be along Westcliff Drive, Jamboree Road, and MacArthur Boulevard. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: The Orange County Affiliate of "Susan G. Komen - Race for the Cure" has requested that 40 private banners be installed from August 23 through September 24, 2012, along the City's major thoroughfares, for the 21st annual Race for the Cure. The banners will be mounted on streetlight poles in the public right -of -way along Westcliff Drive (4 banners), Jamboree Road (21 banners), and MacArthur Boulevard (15 banners). See attached Location Map. The proposed banner locations will not conflict with the Taste of Newport banner locations. "Susan G. Komen - Race for the Cure" Banners — Approval of Encroachment Permit N2012 -0227 August 14, 2012 Page 2 On September 23, 2012, the Orange County Affiliate of "Susan G. Komen - Race for the Cure' will host the 21st annual Race for the Cure, a 5k Run/Walk and 1 -Mile Fun Walk fundraiser supporting breast cancer research and education. In 2011, the applicant reports there was over 30,000 participants and volunteers and raised $3 million for the Newport Beach (Orange County) Race for the Cure. The run /walk route is around the Fashion Island area. The expo area is within the Pacific Life Insurance Company parking lot. The Newport Beach Marriott Resort and Spa is the official host hotel and reports hotel rooms sell out on the event weekend. Participants pay a nominal registration fee ranging from $25 to $40. The City's Special Events Advisory Committee has provided the applicant $10,000 in funding. The event is not co- sponsored by the City of Newport Beach and is not free to the public. "Susan G. Komen — Race for the Cure" is a Texas, charitable organization (non- profit) IRS 501© (3) corporation. Council Policy L -16 prohibits the use of a commercial sponsor's name on banners. However, the event will be community -wide, open to the public, and may generate additional revenue to the City through restaurants, businesses, and hotel reservations. This is the first time "Susan G. Komen — Race for the Cure" has requested street light banners for the event. In the past, requests for similar events (Taste of Newport, BCS Championship, and Barrett - Jackson Car Auction Company) have been approved by City Council and there have been no reported public complaints. Should the City Council elect to approve the installation of 40 private banners in the City for 30 days, staff recommends the following conditions of approval: 1. No banners shall be installed on traffic signal poles or metal streetlight poles. 2. The applicant must provide on -going maintenance of the banners and brackets. 3. The applicant must sign a "Hold Harmless Statement" requiring maintenance of the banners /brackets and indemnification and hold harmless for any liability associated with the banners /brackets. 4. The applicant must maintain a minimum of $1,000,000 in liability insurance from a company with a Best's Key Rating Guide parameter of "A" or better, and a financial size category of "VIII" or higher. 5. The applicant will obtain an Encroachment Permit (N2012 -0227) from the Public Works Department. 2 "Susan G. The banners shall conform to City Council Policy L -16 with the exception of open to the public free of charge and co- sponsor by the City. 7. All banners and brackets shall be removed by the end of the approved time unless otherwise approved by the conditions stated in the Encroachment Permit. 8. All banners and brackets shall comply with the Encroachment Permit conditions. 9. If needed, the City may require removal of some of the banners to allow other organizations to install banners at the same location and during the same time period. 10. A minimum of two 5 -inch wide half - circle wind slits per banner are required to minimize the wind load. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQK) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
