TITLE: Taste of Newport Banners — Approval of Encroachment Permit
N2012 -0203
ABSTRACT:
The Newport Beach Chamber of Commerce is requesting approval to install 100
banners on City and Caltrans owned streetlights along various roadways within the City
and Caltrans rights -of -way for the 24th annual "Taste of Newport".
RECOMMENDATION:
Conditionally approve the request of the Newport Beach Chamber of Commerce for
installation of 100 banners, from August 15, 2012, to September 17, 2012, for the
annual "Taste of Newport". Installation will be along Westcliff Drive, Jamboree Road,
MacArthur Boulevard, Newport Boulevard, and East Coast Highway.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
The Newport Beach Chamber of Commerce (NBCC) has requested that 100 private
banners be installed from August 15 through September 17, 2012, along the City's
major thoroughfares, for the 24th annual "Taste of Newport". The banners will be
mounted on streetlight poles in the public right -of -way along Westcliff Drive (6 banners),
Jamboree Road (18 banners), MacArthur Boulevard (22 banners), Newport Boulevard
(16 banners), and East Coast Highway (38 banners). See attached Location Map. The
banners on portions of Newport Boulevard and East Coast Highway are within Caltrans
right -of -way and will require a Caltrans Standard Encroachment Permit. The proposed

banner locations will not conflict with the Susan G. Komen "Race for the Cure" banner
locations.
On the weekend of September 14 through 16, 2012, NBCC will host the 24th annual
"Taste of Newport" — a dining and entertainment celebration highlighting the many
restaurants in Newport Beach. The NBCC reports that over 60,000 people attend the
Taste of Newport events. Attendees pay an admission charge to enter the event and, if
interested, purchase scrip to receive food and drink from participating restaurants and
caterers. The City's Special Events Advisory Committee has provided the applicant
$5,000 in funding.
The event is not co- sponsored by the City of Newport Beach and is not free to the
public. Council Policy L -16 prohibits the use of a commercial sponsor's name on
banners. However, the event will be community -wide, open to the public, and may
generate additional revenue to the City through restaurants, businesses, and hotel
reservations.
In the past, similar requests for this event have been approved by City Council and
there have been no reported public complaints.
Should the City Council elect to approve the installation of 100 private banners in the
City for 30 days, staff recommends the following conditions of approval:
1. No banners shall be installed on traffic signal poles or metal streetlight poles.
2. The applicant must provide on -going maintenance of the banners and brackets.
3. The applicant must sign a "Hold Harmless Statement" requiring maintenance of the
banners/brackets and indemnification and hold harmless for any liability associated
with the banners /brackets.
4. The applicant must maintain a minimum of $1,000,000 in liability insurance from a
company with a Best's Key Rating Guide parameter of "A" or better, and a financial
size category of "VIII" or higher.
5. The applicant will obtain an Encroachment Permit (N2012 -0203) from the Public
Works Department.
6. The banners shall conform to City Council Policy L -16 with the exception of open to
the public free of charge and co- sponsor by the City.
7. All banners and brackets shall be removed by the end of the approved time unless
otherwise approved by the conditions stated in the Encroachment Permit.
8. All banners and brackets shall comply with the Encroachment Permit conditions.

9. If needed, the City may require removal of some of the banners to allow other
organizations to install banners at the same location and during the same time
period.
10. A minimum of two 5 -inch wide half - circle wind slits per banner are required to
minimize the wind load.
11. A Caltrans Standard Encroachment Permit shall be obtained for banners within
Caltrans right -of -way.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
