TITLE: Sponsorship Request from Balboa Theater Foundation
ABSTRACT:
On October 25, 2011 the City Council approved the concept of a Balboa Beach Music
Festival and asked staff to work with the Balboa Performing Arts Theater Foundation
( "Foundation ") to plan it. In August, we received a letter from the Foundation's director
requesting sponsorship of the Festival (Attachment A).
RECOMMENDATION:
Authorize the Mayor to execute a sponsorship agreement with the Foundation for
$20,000 as a "Producing Sponsor."
FUNDING REQUIREMENTS:
The current adopted budget includes sufficient funding for this purchase. It will be
expensed to the City Council's 8080 account.
DISCUSSION:
The City of Newport Beach owns the land and building housing the now - closed Balboa
Theater. A grass -roots non - profit group — the Balboa Performing Arts Theater
Foundation — is tasked with raising funds to pay for the Theater's renovation and later
management and operation.
As part of the Foundation's fundraising effort, the Foundation has planned a "Balboa
Beach Music Festival" for Saturday, October 13, 2012 at Peninsula Park located

adjacent to the Balboa Pier. Staff has been working closely with the Foundation and
The Producing Group (the contractor organizing the event on behalf of the Theater)
over the past year to discuss and refine the Festival. As noted, it will take place on
Peninsula Park and the A and B Street parking lots. The park and parking lots are
planned to be fenced and contain an entertainment stage and areas for food, vendors,
VIP and portable restrooms as illustrated in Attachment B. Entrance fees ranging from
$45 to $200 will be charged for the event scheduled from 1 pm -10pm. Approximately 10
bands are scheduled throughout the day — the goal is to attract up to 5,000 participants
and target demographic ages of 35 and up with genres such as 80s pop, Surf Pop, Indie
Rock, and Classic Adult Contemporary.
Additionally, staff has continued to work with the Producing Group to address and
mitigate challenges through the planning process which include offsite parking options,
noise generated from amplified sound, traffic control and the selling of alcohol. Noise
impacts to the nearby residents would be unavoidable due to their close proximity to the
park. However, the event organizer plans to work closely with residents to notify them
well in advance and direct the sound system out towards the ocean to minimize
impacts as best possible. The event organizer also understands that they would be
responsible for all related permit, lot closure revenue loss, and City staffing costs
estimated to be approximately $20,000.

This sponsorship request did not go through the FY 2012 -13 Special Event Advisory
Committee (SEAC) process, but that same process is likely to be revised soon.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.

As you know the Balboa Theater is planning a Beach Music Festival to be held on
the beach near the Balboa Pier on Saturday, October 13, 2012, from 1:00 P.M. to 10:00 P.M.
The beach festival program will include four major headline artist performing groups taking
part in a beach front concert, along with 5 or 6 emerging artists. Targeted attendance is 4,000
general admission and 500 VIPs who would receive special treatment in a tent set up for that
purpose. The Balboa Village Business Improvement District is a sponsor and special
programs are planned for all local businesses, including opportunities for vendor booths at the

venue and a walking map of Balboa Village and other incentives to encourage attendees to
patronize local businesses.

The Festival site, adjacent to the sand in Peninsula Park, will provide the City of Newport Beach with an
excellent opportunity to inform the community about recreation and senior programs as well as new
(Oasis Center) and planned (Marina Park, City Hall) facilities.

in all Festival schedules and on a large tent dedicated to
promote City programs. Specific City programs, such as
the Recreation and Senior Services Department offerings,
the Oasis Senior Center, the new City Hall, and special
programs such as the Fire Department's CERT program,
or important messages about the City, can be displayed.
-The Producing Group will work with the City to design
promotional materials that highlight the City's name and
logo and specified departments. Recognition will be given
in digital and print communications, including flyers,
brochures and on the Festival's web site.
-There are significant opportunities for custom skims,
banners, booths and displays prominently placed within
the Festival grounds to introduce City services.
