TITLE: October 2 Memorial Bike Ride, Waiver of Fees, Bike Safety
Improvement Fund (BSIF)
ABSTRACT:
Following two recent accidents involving bicyclists in Newport Beach last month,
community members and cycling advocates have initiated various fundraising efforts
including a memorial bike ride on October 28, 2012. The proceeds of the fundraising
efforts are intended to augment the City's ongoing bicycle safety improvement projects.
Council is being asked to consider matching the fund raising efforts at a 3:1 ratio,
approve a fee waiver for the event, and direct staff to prepare a resource plan for the
implementation of bike safety improvement projects.
RECOMMENDATION:
1. Authorize a match of City resources at a proposed 3:1 ratio for all funds raised from
community fundraising efforts for bicycle safety that occur prior to December 31,
2012. The 3:1 match means that for every dollar raised by the community, the City
will match three additional dollars in bike safety project expenditures and fee
waivers, with a cap of $450,000 for the City's contribution. The City's match may
include competitive grant awards from sources such as Measure M.
2. Authorize the City to act as a sponsor of the event, approve a fee waiver, and a City
commitment to cover the cost of the special event insurance for the memorial bike
ride fundraiser on October 28, 2012, with a not -to- exceed amount of $10,000
included within the City's matching contribution.
3. Direct Public Works staff to develop a Resource Plan for the implementation of
bicycle safety improvement fund projects that will be funded by community funding
efforts and any City matching expenditure that is approved.
FUNDING REQUIREMENTS:
The City's matching contribution of up to $450,000 (a cap that envisions another
$150,000 raised by the community) may be provided from any eligible resource to which

it may have access, including but not limited to the general fund, gas tax funds,
Measure M funds, circulation and transportation funding, and grant sources. Further,
the fundraising contributions, together with City resources, may be leveraged to secure
additional funding grant sources. The precise appropriation by fund will not be known
until the fundraising efforts are complete and the projects have been prioritized and
approved by Council. We will report the total amount of funds raised through December
31, 2012, and request a budget amendment at a future Council meeting date when total
fundraising and project prioritization are better known.
DISCUSSION:
Bicycle Safety Progress Update - The City Council has been committed to improving
bicycle safety in Newport Beach through the formation of the Citizen's Task Force on
Bicycle Safety, which completed its duties in May 2010, and then through the Citizen's
Bicycle Safety Committee which was established in August 2010. The Citizen's Bicycle
Safety Committee has conducted public outreach efforts and safe cycling education,
along with making recommended improvements to bicycle facilities throughout the City.
Their efforts are important and will continue to help promote bicycle safety, education,
and awareness. Some of the projects that have been completed as a result of the
committee's work include the following:

!Memorial Ride and Community Fundraising Efforts - Following the recent accidents
involving bicyclists in Newport Beach last month, community members and cycling
advocates are in the process of organizing a memorial bike ride on Sunday, October 28,
2012. In addition to ride donations, commemorative T -shirts and wrist bands will be sold
at the event and an opportunity drawing will be held. The net proceeds of the
fundraising efforts will be directed toward bicycle safety improvement projects within
Newport Beach. The Recreation and Senior Services Department is processing the
special event permit. Ride details are still being finalized. Further information
concerning the community fundraising efforts can be found at

The actual amount of the requested fee waiver is dependent upon event details and
staffing requirements that are not yet fully known. However, the potential City staffing
costs and insurance premiums are not likely to exceed $10,000. The insurance costs
and waiver of permit fees will be considered part of the City's matching contribution to
the Bike Safety Improvement Fund fundraising efforts.
City Council is being asked to match fundraising efforts at a 3:1 ratio up to $450,000.

will provide three additional dollars worth of bike safety improvement projects. The net

fundraising proceeds will be segregated and used only to fund bicycle safety
improvements throughout the City. The projects will consist of Caltrans and City
Council- approved projects on state routes and City Council- approved projects on local
streets. These improvements will be consistent with adopted traffic engineering
standards and manuals. A tentative list of potential bicycle safety improvement projects
is attached.
Lastly, Mayor Gardner, City Manager Dave Kiff, and Public Works staff have met and
recognize the need to identify the staff resources needed to implement additional bike
safety improvements. Therefore, at a future Council meeting, staff will present a
Resource Plan to Council in order to prioritize projects that will be funded through the
community fundraising efforts and any matching resources approved.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
