The applicant desires to use a higher average grade than the grade elevations determined by the Community Development Director. CEQA COMPLIANCE: Pursuant to Section 15270 of the California Environmental Quality Act (CEQA) Guidelines, projects which a public agency rejects or disapproves are not subject to CEQA review. If the applicant's request is approved, the project is categorically exempt under Section 15303, of the State CEQA (California Environmental Quality Act) Guidelines - Class 3 (New Construction or Conversion of Small Structures). Associate Planner Makana Nova gave a presentation summarizing the applicants' request. The Planning Commission voted to uphold the Director determination and deny the appeal. Planning Commission Action Report Page 2 AYES: Brown, Koetting, Kramer, and Weigand NOES: None ABSENT: Lawler, Hillgren and Zak ABSTAIN: None ITEM NO. 3 TROESH RESIDENCE(PA2015-122) Site Location: 336 Catalina Drive and 333 La Jolla Drive SUMMARY: In conjunction with the addition of a 4,451-square-foot detached dwelling, the applicant requests the following: Modification Permit - to allow a property that is nonconforming to add more than 10 percent of the existing floor area developed on site. A separate detached dwelling unit exists on the northerly half of the property and is considered nonconforming due to the size of the parking spaces. Variance - to allow a retaining wall and guardrail to exceed 42 inches in height within the 5-foot front setback adjacent to La Jolla Drive due to the topography of the property. CEQA COMPLIANCE: The project is categorically exempt under Section 15303, of the State CEQA (California Environmental Quality Act) Guidelines - Class 3. Assistant Planner Jason Van Patten gave a presentation summarizing the applicants' request. The Planning Commission voted to continue the item to the meeting of November 5, 2015. AYES: Brown, Koetting, Kramer and Weigand NOES: None ABSENT: Lawler, Hillgren and Zak ABSTAIN: None ITEM NO. 4 VERIZON MONOEUCALYPTUS TREE (PA2015-128) Site Location: 23 Corporate Plaza SUMMARY: A conditional use permit for Verizon Wireless to install 12 panel antennas and two ray caps on a new 32-foot high telecommunications monopole designed to resemble a eucalyptus tree. The associated equipment is proposed to be located within an existing 20-foot 8-inch by 16-foot trash area, which will be fully screened with a 5-foot 10-inch block wall with 2-foot 6-inch mesh steel panels above. CEQA COMPLIANCE: The project is categorically exempt under Section 15303, of the State CEQA (California Environmental Quality Act) Guidelines - Class 3 (New Construction or Conversion of Small Structures). AYES: Brown, Koetting, Kramer and Weigand NOES: None Planning Commission Action Report Page 3 ABSENT: Lawler, Hillgren and Zak ABSTAIN: None ITEM NO. 5 LOCAL COASTAL PROGRAM IMPLEMENTATION PLAN (PA2013-001) Site Location: Coastal Zone SUMMARY: The Planning Commission will consider recommending to the City Council of the City of Newport Beach the adoption of the Local Coastal Program (LCP) Implementation Plan. The LCP Implementation Plan consists of the zoning regulations, maps, and other legal instruments needed to implement the California Coastal Act and the City's certified Coastal Land Use Plan. CEQA COMPLIANCE: Notice is hereby further given that pursuant to the authority and criteria contained in the California Environmental Quality Act (CEQA), the proposal is statutorily exempt from CEQA pursuant to Section 15265(a) (1) of the California Code of Regulations, Title 14, and Chapter 3 of the Coastal Act. Planning Program Manager Patrick Alford introduced the item and offered to respond to questions. The Planning Commission voted to recommend to the City Council approval of the Local Coastal Implementation Plan. AYES: Brown, Koetting, Kramer, Weigand, and Zak NOES: None ABSENT: Lawler and Hillgren ABSTAIN: None NEW BUSINESS: ITEM NO. 6 NEWPORT CENTER VILLAS STUDY SESSION (PA2014-213) Site Location: 150 Newport Center Drive SUMMARY: A study session to allow staff and the applicant, Newport Anacapa Associates, LLC, to present information regarding the proposed Newport Center Villas residential development project. Newport Center Villas is an approximate 1.3 acre site in Newport Center bounded to the north by Newport Center Drive and to the east by Anacapa Drive. The proposed project consists of the demolition of an existing 2,085-square-foot car-wash and gas station to accommodate the development of 49 condominium dwelling units. The project requires the following discretionary approvals to be reviewed by the Planning Commission: a General Plan Amendment, Zoning Code Amendment, Planned Community Development Plan, Site Development Review, Tentative Tract Map, and certification of a Mitigated Negative Declaration. CEQA COMPLIANCE: A Mitigated Negative Declaration (MND) has been prepared for the project in accordance with the California Environmental Quality Act (CEQA). The document was released for a 20-day public comment period from September 11, 2015, through October, 1, 2015. As a courtesy to the public,the public review period was extended to October 7, 2015. Associate Planner Makana Nova introduced the project and reviewed the requested entitlement permits. The applicant provided details of the project. Public comments were received and the Planning Commission identified topics they would like addressed prior to the public hearing.
