TITLE: Confirm Nominations to Fill the Unscheduled Vacancy on the City
Arts Commission
ABSTRACT:
Due to the resignation of Charles Ware from the City Arts Commission, the City Council
has the opportunity to fill the vacant position pursuant to City Council Policy A-2 (Board,
Commission and Committee Appointments), City Charter Sections 702 and 705, and
the Maddy Act.
RECOMMENDATION:
Confirm the nominations of Michael Kerr and Jennifer Van Bergh to fill the unexpired
balance of Charles Ware's term on the City Arts Commission.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
On September 14, 2015, Commissioner Charles Ware resigned from his seat on the
City Arts Commission. His term is scheduled to expire on June 30, 2017.
Pursuant to City Charter Sections 702 and 705, and City Council Policy A-2, the City
Council's appointee to the City Arts Commission will serve the balance of Mr. Ware's
unexpired term.

Pursuant to the Maddy Act and City Council Policy A-2, the City Clerk prepared and
posted a Special Notice of Unscheduled Vacancy on Wednesday, September 16, 2015,
in the City Clerk's Office, at the Central Library, on the bulletin board in the City Council
Chambers, and on the City's webpage, and published Special Notice in the Daily Pilot
on Saturday, September 19, 2015. As provided in the Special Notice, applications were
accepted by the City Clerk's Office until 12 p.m. on Thursday, October 1, 2015.
Pursuant to City Council Policy A-2, the Ad -Hoc Appointments Committee, consisting of
Mayor Ed Selich, Mayor Pro Tem Diane Dixon, and Council Member Tony Petros,
reviewed the 13 applications received. As a result of their review, the Ad -Hoc
Appointments Committee conducted interviews on October 22, 2015 and recommends
nominating Michael Kerr and Jennifer Van Bergh to fill the unscheduled vacancy on the
City Arts Commission. Copies of the applications are attached hereto as Attachment A.
Appointment to the City Arts Commission is scheduled to take place at the Tuesday,
October 27, 2015 City Council meeting.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
