TITLE: Multiple Buildings Painting Project — Notice of Completion and
Acceptance of Contract No. 6013
ABSTRACT:
On April 14, 2015, City Council awarded the Multiple Buildings Painting Project to Tony
Painting, Inc. of Garden Grove, California for the $191,500.00 base contract and a
$19,000.00 contingency amount. The required work is now complete and staff requests
City Council acceptance and close out of the contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of
Completion for the project;
b) Authorize the City Clerk to release the Labor and Materials Bond sixty-five (65)
days after the Notice of Completion has been recorded in accordance with
applicable portions of the Civil Code; and
C) Release the Faithful Performance Bond one (1) year after acceptance by the City
Council.
FUNDING REQUIREMENTS:
The current adopted FY 2015-2016 Capital Improvement Budget includes sufficient
funding for this expenditure. Project costs were expensed to the Facilities Maintenance
Master Plan account in the Public Works Department, 571 01-980000-1 5F02.

This project was developed from the findings produced by the City's Facilities
Maintenance Master Plan (FMMP) where eighty-eight (88) City buildings' major
components (Mechanical, Electrical, Flooring, Interior Finishes, Plumbing, Structural,
Fire Protection, Stairs, Site Improvements, Exterior Finishes, Roofing, and Exterior
Enclosures) were inspected and prioritized. As recommended by the FMMP, this project
painted the following twenty-one (21) city buildings:
1. 15th Street Restrooms (15th Street at Ocean Front)
2. 58th Street Restrooms (58th Street at Seashore Drive)
3. Arroyo Park Restrooms (Residencia)
4. Bob Henry Park Restrooms (Dover Drive at Castaways Lane)
5. Buck Gully Restrooms (Little Corona Beach below Ocean Blvd / Poppy Avenue)
6. Channel Place Park Restrooms (Channel Place at River Avenue)
7. Corona del Mar State Beach Restrooms (Corona del Mar State Beach)
8. Eastbluff Park Restrooms (Vista Del Oro at Hacienda)
9. Fire Station No. 3 (868 Santa Barbara Drive)
10. Fire Station No. 8 (6502 Ridge Park Road)
11. Grant Howald Park Restrooms (5th Avenue at Goldenrod Avenue)

A total of two (2) contract change orders (CCO) were issued for this Project. The first
CCO was a negotiated cost -neutral agreement directing Tony Painting to paint the
exterior screen walls, awnings, and parking lot light poles of the Newport Coast
Community Center, and the 15th Street restrooms in lieu of the $15,250.00 credit due to
the City from the substitute anti -graffiti coating material. The second CCO in the amount
of $17,700.00 was issued to perform additional exterior painting and anti -graffiti coating
of the restrooms at Bob Henry Park, Mariners Park and 15th Street. These locations
were deemed to be cost effective additions to the original project scope and supported
by the operational departments managing these facilities.
The contract was completed to the satisfaction of the Public Works Department. A

Staff recommends the City Council find this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301 (minor alteration of
existing public facilities with negligible expansion) of the CEQA Guidelines, California
Code of Regulations, Title 14, Chapter 3, because it has no potential to have a
significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
