TITLE: Confirmation of Appointments to the Newport Beach Restaurant
Association Business Improvement District Advisory Board of
Directors
ABSTRACT:
California Streets and Highways Code Sections 36500 et seq., grants the City Council
the authority to appoint an advisory board for Business Improvement Districts formed
under the Parking and Business Improvement Area Law of 1989 (1989 Law).
Due to the resignations of Cindy O'Shea, representing Whole Foods, and Alexandra
Robinson, representing Park Avenue Cafe, the City Council has the opportunity to fill
the vacated positions on the Newport Beach Restaurant Association Business
Improvement District Advisory Board of Directors (NBRA BID).
RECOMMENDATION:
Appoint Alexandra Robinson representing Back Bay Bistro, and Christopher Roman,
representing Cucina Enoteca, to fill the unexpired balance of Cindy O'Shea and
Alexandra Robinson's terms on the Newport Beach Restaurant Association Business
Improvement District Advisory Board of Directors which expires on June 30, 2016.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
The NBRA BID was formed pursuant to the 1989 Law, codified in Streets and Highways
Code Sections 36500 et seq., for the purpose of financing activities and programs to
benefit businesses located and operating within the business improvement district
(BID).

The City Council has the authority to appoint an Advisory Board to the NBRA BID and
limit membership on the Advisory Board to persons subject to the BID assessment. The
Advisory Board that serves on the NBRA BID is not appointed in the same manner as
other City Boards, Commissions, and Committees. The City relies on the Streets and
Highways Code for Business Improvement District advisory board appointments rather
than City Council Policy A-2, Board, Commission and Committee Appointments.
At the May 26, 2015, City Council meeting, the City Council appointed 11 individuals to
the NBRA BID Advisory Board of Directors for FY 2015-2016.
On October 14, 2015, the City Clerk was informed that Cindy O'Shea resigned from her
seat on the Advisory Board and, on October 28, 2015, the City Clerk was informed that
Alexandra Robinson resigned from his seat on the Advisory Board.
In compliance with the Maddy Act and the 1989 Law, the City Clerk prepared and
posted a Special Notice of Unscheduled Vacancy on November 4, 2015, in the City
Clerk's Office, at the Central Library, on the City's webpage, and on the bulletin board
located in the City Council Chambers; and published the Notice of Vacancy in the Daily
Pilot on November 7, 2015.
It is the NBRA BID Advisory Board of Directors' desire to fill the unscheduled vacancies
for the remaining FY 2015-2016 terms, ending June 30, 2016. At its November 18,
2015 meeting, the NBRA BID Advisory Board of Directors reviewed the applications on
file and recommends that the City Council appoint Alexandra Robinson representing
Back Bay Bistro, and Christopher Roman, representing Cucina Enoteca, to the Advisory
Board of Directors for FY 2015-2016.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

I have never lived anywhere besides Newport Beach, and the restaurant industry is something I've always been exposed to,
since my family has worked in it for longer than I've been alive. With my background in marketing and passion for food, I
strongly believe that my input to the NBRA is a valuable addition. I want to support local corporate and small businesses by
volunteering time and working to figure out ways to keep the residents and visitors spending their money within Newport Beach.
