ITEM NO. 2 BALBOA VILLAGE HERITAGE SIGNS (PA2015-195)
Site Location: 601 Balboa Blvd and 706 E. Bay Avenue
Summary:
Designation of the roof top signs at 601 Balboa Boulevard and 706 E. Bay Avenue as Heritage Signs, as
defined by the Newport Beach Municipal Code. As Heritage Signs, these signs will no longer be
considered nonconforming and shall be maintained in good repair and retain the character defining
features of a designed heritage sign. A heritage sign may be removed if desired.
CEQA Compliance:
The project is categorically exempt under Section 15301, of the State CEQA (California
Environmental Quality Act) Guidelines — Existing Facilities, as the signs are existing and will be
modified for maintenance purposes only.
Recommended Action:
1. Conduct a public hearing; and
2. Adopt Resolution No. _ designating three roof top signs in Balboa Village as Heritage
Signs

ITEM NO. 3 WASA SUSHI RESTAURANT EXPANSION AND BLUFF'S SHOPPING CENTER PARKING
WAIVER (PA2015-140)
Site Location: 1346 Bison Avenue/The Bluffs Shopping Center
Summary:
The proposed project consists of two conditional use permit requests. First, the applicant proposes a
conditional use permit to approve an off-street parking modification for the Bluffs Shopping Center to
reduce the required number of parking spaces by 1 (one) space resulting in a 477 space parking
requirement where the zoning regulations require 478 spaces.
The second request is a conditional use permit to amend Use Permit No. UP2003-018 to expand an
existing 1,566 square foot eating and drinking establishment into an adjacent 2,024 square foot tenant
space for a combined floor area of 3,590 square feet. The expansion includes an upgrade from a Type
41 ABC License (On -Sale Beer and Wine) to a Type 47 ABC License (On -Sale General). The request
also includes approval of a conditional use permit to approve an off-street parking modification to reduce
the required number of parking spaces by 24 spaces and approve a parking management plan. If
approved, UP2015-034 would supersede UP2003-018.
CEQA Compliance:
The project is categorically exempt under Section 15301, of the State CEQA (California
Environmental Quality Act) Guidelines - Class 1 (Existing Facilities).
Recommended Action:
1. Conduct a public hearing; and
2. Adopt Resolution No. _ approving Conditional Use Permit No. UP2015-034 (Bluffs
Parking Waiver) subject to the conditions of approval provided in the draft resolution; and
3. Adopt Resolution No. _ approving Conditional Use Permit No. UP2015-035 (Wasa Sushi
Expansion) subject to the conditions of approval provided in the draft resolution.
ITEM NO. 4 THE VILLAGE INN OUTDOOR DINING AND LAND USE AMENDMENTS (PA2015-016)
Site Location: 123 and 127 Marine Avenue
Summary:
A General Plan, Coastal Land Use Plan, and Zoning Code amendment application to change the
land use designation from residential to mixed-use for 123 Marine Avenue, which is a residential lot
abutting the existing Village Inn restaurant. The land use amendments would allow for both
properties to be used for the restaurant use or for other uses allowed in the mixed use district. The
application also includes an amendment to a Conditional Use Permit to allow a 240 -square -foot
outdoor dining area in front of the restaurant at 127 Marine Avenue, within the public right-of-way.
The proposed amendments and outdoor dining area requires review and approval by the City
Council.
CEQA Compliance:
The project is categorically exempt under Section 15302, of the State CEQA (California
Environmental Quality Act) Guidelines — Class 2 (Replacement or Reconstruction) on the basis that
the land use amendment would not result in new development or change the current use of the
property located at 123 Marine Avenue. The project is also categorically exempt under Section
15303, of the State CEQA (California Environmental Quality Act) Guidelines — Construction or
Conversion of Small Structures in that the improvements associated with the outdoor dining area are
considered accessory to the main structure.

Recommended Action:
1. Conduct a public hearing;
2. Adopt Resolution No. _ recommending City Council approve Conditional Use Permit No.
UP2015-006 to establish an outdoor dining area associated with the Village Inn restaurant at
127 Marine Avenue; and
3. Adopt Resolution No. _ recommending City Council approve General Plan No. GP2015-
002, Coastal Land Use Plan No. LC2015-001 and Zoning Code No. CA2015-010
amendments for the property located at 123 Marine Avenue.

Deputy Director Brenda Wisneski gave a presentation summarizing the request
and stated that the signs at 601 Balboa Boulevard have been removed from
consideration at the request of the property owner.
The Planning Commission voted to approve the resolution designating the signs
at 601 Balboa Boulevard and 706 East Bay Avenue as Heritage Signs.

PARKING WAIVER (PA2015-140)
Site Location: 1346 Bison Avenue/The Bluffs Shopping Center
SUMMARY: The proposed project consists of two conditional use permit requests. First, the

request.
The Planning Commission approved the project with conditions.
