ROLL CALL-5:47 p.m. Present: Council Member Peotter, Council Member Petros, Council Member Curry, Council Member Duffield, Council Member Muldoon, Mayor Pro Tem Dixon, Mayor Selich II. PUBLIC COMMENTS Jim Mosher referenced Closed Session Item IIIA and stated that this item has preceded every regular Council meeting since late 2011. He believed that it is impossible for Council Members to consider the various groups within the time allotted before the regular meeting. He referenced previous agreements reached with five of the organizations in which no additional negotiations were needed until 2017 and 2018. He requested that future agendas more clearly indicate which of the ten groups will be discussed in Closed Session. City Attorney Harp announced that the City Council will adjourn to Closed Session to discuss the items as listed in the Closed Session agenda and read the titles. III. CLOSED SESSION-5:48 p.m. A. NOTICE TO THE PUBLIC XI. CITY COUNCIL ANNOUNCEMENTS (NON-DISCUSSION ITEMS) Mayor Pro Tem Dixon announced that the Newport Beach Public Library was recognized as a Star Library in a national ranking compiled by the Library Journal Index of Public Library Service. She reported that there are over 7,600 public libraries and that the Newport Beach Library was the only library in Orange County to be designated as a Star Library. She commended Library Services Director Hetherton, who credited the award to community support and quality programs and services. Additionally, she reported that she and Council Member Muldoon officiated on a panel for Youth in Government at Newport Harbor High School and commented positively on the event. Mayor Selich reported on the Corona del Mar Pocket Park dedication on December 1, 2015, attending the preopening of the Lighthouse Cafe on December 4, 2015, the grand opening of Marina Park and attending the Balboa Village Christmas tree lighting on December 5, 2015, and attending the Corona del Mar Christmas Walk and the Balboa Christmas Tree Lighting on December 6, 2015. Additionally, he reported that the City Clerk's Office is still accepting new and unwrapped toys for the children of troops through Operation Christmas. He commented on the 25th anniversary of the Firefighters' Spark of Love campaign where all Fire Stations are accepting donations of toys and money. Mayor Selich invited Amy Senk, Publisher and Lead Writer of Corona del Mar Today, to the podium, noting that the newspaper will cease publication on December 31, 2015. On behalf of the City Council, Mayor Selich presented her with a Certificate of Recognition in appreciation of her contributions to the residents of Corona del Mar. XII. MATTERS WHICH COUNCIL MEMBERS HAVE ASKED TO BE PLACED ON A FUTURE AGENDA-None XIII. PUBLIC COMMENTS ON CONSENT CALENDAR Regarding Item No. 4 (15th Street/Balboa Boulevard Revitalization), Council Member Petros noted receiving correspondence from residents of the Peninsula and asked whether there was still opportunity to coordinate with residents regarding the landscape palette as the matter moves forward. Public Works Director Webb addressed the numerous community outreach meetings, acknowledged receipt of the correspondence, and stated that staff can work with residents on specific issues as the project moves forward. Mayor Pro Tem Dixon referenced Item No. 8 (Community Programs Grants for Fiscal Year 2015- 2016), and asked if, going forward, it would be possible to consolidate this item with other charitable/discretionary gift programs (special events). City Manager Kiff reported that staff will do so, going forward. City Manager Kiff referenced Item No. 9 (Purchase of New Load-Bearing Vests; Budget Amendment) and recommended that the budget amendment not be part of the motion since it is no longer needed. XIV. CONSENT CALENDAR READING OF MINUTES AND ORDINANCES 1. Minutes for the November 24, 2015 Regular Meeting[100-2015] Waive reading of subject minutes, approve as amended, and order filed. Reading of Ordinances Waive reading in full of all ordinances under consideration, and direct the City Clerk to read by title only. ORDINANCE FOR ADOPTION 3. Second Reading of Ordinance No. 2015-35 for Zoning Code Amendment No. CA2012-003 for the Former City Hall Complex located at 3300 Newport Boulevard and 475 32nd Street (PA2012-031)[100-20151 a) Conduct second reading of an ordinance; and b) Adopt Ordinance No. 2015-35, An Ordinance of the City Council of the City of Newport Beach, California, Approving Zoning Code Amendment No. CA2012-003 for the Former City Hall Complex Located at 3300 Newport Boulevard and 475 32nd Street (PA2012-031). CONTRACTS AND AGREEMENTS 4. 15th Street/Balboa Boulevard Revitalization - Award of Contract No. 6341 (Project No. 15R11)[381100-20151 a) Approve the project drawings and specifications; b) Award Contract No. 6341 to GMC Engineering for the total bid price of $2,746,402.00, and authorize the Mayor and the City Clerk to execute the contract; and c) Establish an amount of $412,000.00 (15 percent) to cover the cost of unforeseen work not included in the original contract. 5. Zone III Pump Station Variable Frequency Drive (VFD) Replacement - Award of Contract No. 6278 (Project No. 16W16) [381100-20151 a) Approve the project plans and specifications; b) Approve Budget Amendment No. 16BA-019 appropriating $143,500.00 from the unappropriated Water Enterprise fund to Account No. 70101-980000-16W16; c) Award Contract No. 6278 to Industrial Power and Automation, Inc. for the Total Bid Price of $129,500.00, and authorize the Mayor and City Clerk to execute the contract; and d) Establish a contingency of $1.3,000.00 (approximately 10% of Total Bid) to cover the cost of unforeseen work not included in the original contract. 6. Tentative Agreements with the City Employees Association (C-2059) and the Professional and Technical Employees Association (C-2051), and Draft Revisions to the Key and Management Compensation Plan[381100-20151 Receive and consider the Tentative Agreement between the City of Newport Beach and the Newport Beach City Employees Association and the Newport Beach Professional and Technical Employees Association and receive and consider the draft revisions to the Key and Management Compensation Plan. MISCELLANEOUS 7. Planning Commission Agenda for the December 3, 2015 Meeting[100-20151 Receive and file. 8. Community Programs Grants for Fiscal Year 2015-2016 1100-2015] Pursuant to City Council Policy A-12, find that the organizations listed below provide services or programs that serve residents and are beneficial to resident's quality of life and authorize the allocation of$40,000 in Community Programs Grants in the following manner: Volume 62 - Page 522 City of Newport Beach Regular Meeting December 8,2015 Orange County Council on Aging $10,000 Central Orange Coast YMCA 7,500 Boys & Girls Club of the Harbor Area 7,500 Serving People in Need, Inc. Purchase of New Load-Bearing Vests; Budget Amendment[100-20151 Authorize the purchase of new ballistic vests for the Newport Beach Police Department. Motion by Mayor Pro Tem Dixon, seconded by Council Member Petros, to approve the Consent Calendar, with Item No. 9 being amended pursuant to the City Manager's recommendation. ITEMS REMOVED FROM THE CONSENT CALENDAR-None XVI. PUBLIC COMMENTS ON NON-AGENDA ITEMS Jim Mosher took issue with the City conducting only one meeting in December and provided a brief history of the matter. Council Member Petros read from voter-approved City Charter Section 407 which indicates that the City Council shall hold two meetings per month except in the months of August and December when there will be at least one regular meeting in each of those months. He emphasized that, as it reads today, the Council is following the City Charter. XVII. ORAL REPORTS FROM CITY COUNCIL ON COMMITTEE ACTIVITIES Council Member Curry reported that the Finance Committee will meet on December 10, 2015, at 4:00 p.m. Mayor Selich recessed the meeting at 6.35 p.m, and reconvened the meeting at 7.•00 p.m. with all members of the City Council in attendance. XVIII. REORGANIZATION A. ELECTION OF MAYOR The City Clerk, in presiding, placed all members of the Council on an equal basis to nominate and elect, and declared nominations for Mayor open. Council Member Muldoon nominated Council Member Dixon for Mayor. Motion by Council Member Peotter, seconded by Council Member Curry, to close nominations for Mayor. Volume 62 - Page 523 City of Newport Beach Regular Meeting December 8, 2015 The motion carried by the following roll call vote: Ayes: Council Member Peotter, Council Member Petros, Council Member Curry, Council Member Duffield, Council Member Muldoon, Council Member Dixon, Council Member Selich Jim Mosher noted that for a majority of the City's history, Mayors served a two-year term and referenced the original City Charter. He believed that it is a good idea to change the Mayor frequently, but stated it has a strange history. He wished the new Mayor well. Utilizing the voting system, City Clerk Brown announced the election of Council Member Dixon as the Mayor of Newport Beach for 2015-2016 by unanimous vote. Mayor Dixon took her place on the dais. B. ELECTION OF MAYOR PRO TEM. Mayor Dixon, in presiding, placed all members of the City Council on an equal basis to nominate and elect, and declared nominations for Mayor Pro Tem open. Council Member Duffield nominated Council Member Muldoon for the position of Mayor Pro Tem. Motion by Council Member Peotter. seconded by Council Member Duffield, to close nominations for Mayor Pro Tem. The motion carried by the following roll call vote: Ayes: Council Member Peotter, Council Member Petros, Council Member Curry, Council Member Duffield, Council Member Muldoon, Council Member Selich, Mayor Dixon Jim Mosher stated that the Mayor Pro Tem usually moves to the position of Mayor the following year and questioned how the Mayor Pro Tem is selected. He referenced an article in the Daily Pilot regarding last year's selection of the Mayor and this year's selection of the Mayor Pro Tem in connection with Team Newport. He expressed concern that Team Newport consists of four Council Members (a majority) and cannot legally discuss City business amongst themselves pursuant to the Brown Act. Utilizing the voting system, City Clerk Brown announced the election of Council Member Muldoon as the Mayor Pro Tem of Newport Beach for 2015-2016 by unanimous vote. Mayor Pro Tem Muldoon took his place on the dais. C. SEATING ARRANGEMENTS FOR CITY COUNCIL The Council Members decided on the seating arrangement of the Council dais with the senior Council Members having first preference. The following seating order was determined (left to right): Peotter—Duffield—Muldoon—Dixon—Selich—Curry- Petros D. REMARKS Presentation of Gavel Plaque to Outgoing Mayor Selich Volume 62-Page 524 City of Newport Beach Regular Meeting December 8, 2015 On behalf of the City Council, Mayor Dixon presented a gavel plaque to outgoing Mayor Selich and thanked him for his leadership and service to the City. Outgoing Mayor Selich's Remarks Council Member Selich distributed "Thank You" cards and expressed his appreciation to fellow Council Members, the City Manager, City Attorney, City Clerk, and staff, as well as his wife, Lynn, for their support. Mayor Dixon Remarks Mayor Dixon thanked fellow Council Members, the people of Newport Beach and her husband, Pat, daughter and husband, her grandsons and her sister, as well as City staff. She addressed Council's accomplishments during the last year and listed her goals for the upcoming year, as follows: 1. Maintain fiscal responsibility. 2. Revitalize and renew the City. 3. Protect our water. 4. Protect our City. 5. Create public/private partnerships. Mayor Dixon reported that she will continue holding monthly Town Hall meetings and wished everyone a Merry Christmas and Happy New Year. XX. MOTION FOR RECONSIDERATION-None XXI.
