ABSTRACT:
On April 28, 2015, the City Council awarded Contract No. 5583 to All American Asphalt in
the amount of $3,293,293.00 for Dover Drive and Westcliff Drive Street Rehabilitation
Project. A 10 percent construction contingency was authorized to cover the cost of
unforeseen work. The project is nearing completion. Increased costs due to change
orders and quantity adjustments are estimated to approximate up to $566,525, or 17
percent of construction, including supplemental pavement work on 15th Street, intersection
improvements at Westcliff Drive and Buckingham Lane and grade adjustments. Staff
recommends increasing the contingency authority for this project up to 17 percent and
approving a Budget Amendment to increase General Fund appropriation by a net $23,035.
RECOMMENDATIONS:
a) Establish an amount up to $566,525 (17%) to cover the cost of unforeseen work not
included in the original contract;
b) Approve Budget Amendment No. 16BA-030, unappropriating $58,000 back to the
Contributions Fund balance from Account 13501-980000-15R15 (Dover Drive and
Westcliff Drive Street Rehabilitation Project Contributions Fund) and appropriating
$81,035 from the General Fund balance to Account No. 01001927-980000-15R15
(Dover Drive and Westcliff Drive Street Rehabilitation Project General Fund) for a
General Fund net increase of $23,035 to this project; and
c) Revenue receipted in 13501-431075 from the Orange County Sanitation District in
the amount of $58,000 will be transferred to 01080801-521380 (City Staff Service
Fee General Fund).

FUNDING REQUIREMENTS:
The Budget Amendment records and appropriates $81,035 in increased expenditure
appropriations from General Fund unappropriated fund balance. At the time of the
contract award, $583,000 from Orange County Sanitation District (OCSD) was recognized
as revenue and appropriated through the Contribution Fund to cover the cost to repair
pavement and medians damaged during recent sewer work within Dover Drive. Of this
amount, $58,000 represents reimbursement to the City for administrative costs for this
work and should be transferred to the General Fund.
The Budget Amendment now transfers $58,000 from the project’s Contributions Fund to
the General Fund City Staff Service Fee (Account 01080801-521380) and then
appropriates this $58,000 from the General Fund to restore the original contingency for
this project. The Budget Amendment also appropriates an additional $23,035 from the
General Fund to cover quantity adjustments for materials needed to complete the project.
Costs for 15
th Street alley, intersection improvements at Buckingham and Westcliff, and
adjustments to sewer manhole covers and water valves will be covered by funds available
in the Capital Improvements Program (CIP) budget.
Upon approval of the proposed Budget Amendment and increase in contingency authority,
there will be sufficient funding for the following proposed uses:

DISCUSSION:
The Dover Drive and Westcliff Drive Street Rehabilitation Project is nearly completed
through a contract awarded to All American Asphalt. This project called for pavement
grinding and pavement rehabilitation of Dover Drive from East Coast Highway to Irvine
Boulevard and Westcliff Drive from Irvine Avenue to Dover Drive. Additionally, Dover
Drive medians from East Coast Highway to Westcliff Drive were rebuilt and landscaped
with colorful native and drought tolerant plants, four older traffic signals were upgraded
and a deteriorated storm drain line was relined. A new smart-irrigation system was
installed to provide irrigation to plants that uses substantially less water than the system it
replaced. No landscape and irrigation work was performed for Westcliff Drive medians as
they were rehabilitated several years ago.
During the construction of the Dover/Westcliff project, it was determined the alley near
15th Street to be the secondary access to Marina Park and it needed to be
reconstructed before Marina Park opened in December 2015. While the current CIP
includes funding for the 15th Street and Balboa Boulevard Revitalization Project with
Dover Drive and Westcliff Drive Street Rehabilitation Increased Contingency

improvements to the 15th Street corridor and West Balboa Boulevard, work on the
project just started. Given All American Asphalt’s favorable unit pricing for Contract
5583, staff approached All American Asphalt to provide a cost estimate to reconstruct
the 15th Street alley through a change order.
Also, the City asked All American to install flashing crosswalk beacons across Westcliff
Drive at Buckingham Lane and Rutland Road. Adjustments to sewer manhole covers
and water valves will be expensed to project accounts in the current CIP for this
purpose. Costs to complete the 15
th Street alley work, install lighted crosswalks on
Westcliff Drive, and adjust sewer manhole covers and water valves to grade
approximates $214,500 and can be expensed to existing project budgets. Due to the
addition of these change orders, along with the quantity adjustments to Contract 5583,
the overall contract value will exceed the originally approved 10 percent contingency.
Staff requests the contingency to be increased from 10 percent to 17 percent to account
for the aforementioned work.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this project exempt from the California
Environmental Quality Act (“CEQA”) pursuant to Section 15301 Class 1(c) (existing
facilities) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3,
because it has no potential to have a significant effect on the environment.

The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
