HomeMy WebLinkAbout15 - Appointment of a New BVAC Member to Represent ExplorOcean15-1 NEWPORT BEACH City Council Staff Report COUNCIL STAFF REPORT CITY OF January 26, 2016 Agenda Item No. 15 ABSTRACT: Due to a recent resignation on the Balboa Village Advisory Committee (BVAC), the City Council may appoint a new member pursuant to City Council Policy A-2 (Board, Commission and Committee Appointments) and the Maddy Act. RECOMMENDATION: Appoint ExplorOcean’s CEO Linda Mayer to BVAC to fill the unexpired balance of Tom Pollack’s term, which expires on December 31, 2016. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: Resolution No. 2012-85 provides ExplorOcean with a representative on BVAC. Tom Pollack resigned from his seat on BVAC as the representative of ExplorOcean via email on January 6, 2016. His unfilled term is scheduled to expire on December 31, 2016. Pursuant to the Maddy Act and City Council Policy A-2, the City Clerk prepared and posted a Notice of Unscheduled Vacancy on Thursday, January 7, 2016, in the City Clerk’s Office, at the Central Library, and on the bulletin board in the City Council Chambers. The Notice was also placed on the City’s webpage on Thursday, January 7, 2016, and was published in the Daily Pilot on Saturday, January 9, 2016. As per the Notice of Unscheduled Vacancy, applications were accepted by the City Clerk’s Office until noon on Friday, January 15, 2016. Consistent with the Maddy Act and City Council Policy A-2, final appointment to fill Mr. Pollack’s unexpired term will not be made for at least ten working days after the posting of Notice of Unscheduled Vacancy. Ms. Mayer currently serves as the CEO of ExplorOcean and a copy of her application is attached hereto as Attachment A. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
