HomeMy WebLinkAbout2016-31 - Limiting the Parking of Vehicles on Margaret DriveRESOLUTION NO. 2016-31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, LIMITING THE PARKING OF VEHICLES ON MARGARET DRIVE WHEREAS, the City of Newport Beach ("City") Municipal Code Section 12.44.010(A) provides that when authorized signs are in place giving notice thereof, no person shall stop, stand, or park any vehicle between the hours of 8:00 a.m. and 6:00 p.m. of any day for a period of time longer than one (1) hour upon such streets or portions thereof as the City Council shall designate by resolution; and WHEREAS, Newport Beach Municipal Code Section 12.44.010(E) authorizes the City Council to vary the hours or days of parking restrictions when special parking or traffic conditions exist; and WHEREAS, parking impacts exist on Margaret Drive related to students attending Newport Harbor High School during the weekday, or visitors attending special events during the evenings and/or weekends such as sport tournaments, football games, etc.; and WHEREAS, the City Council desires to address the parking conditions on Margaret Drive by limiting the parking of vehicles as hereinafter provided. NOW THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: Section 1: The recitals provided above are true and correct and are incorporated into the operative part of this resolution. 1. The parking of vehicles between the hours of 8:00 a.m. and 6:00 p.m. every day, except holidays, shall be limited to one (1) hour duration on Margaret Drive from Irvine Avenue to and including 2322 on the north side and 2323 on the south side. 2. The City Traffic Engineer is authorized and directed to cause signs to be erected at the above locations giving notice of such parking restrictions. Section 2: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each Resolution No. 2016-31 Page 2 of 2 section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 3: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 4: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
