ABSTRACT:
A Residential Parking Permit program, incorporating certain streets in Newport Heights
and Cliff Haven, was originally established by the City Council in 1996. Preferential
Parking Zone “2” was approved, which lists those streets where parking is limited to two
(2) hour durations on school days between the hours of 8 p.m. to 6 p.m. except by
permit. The residents of Margaret Drive, adjacent to Newport Harbor High School, have
requested that the permit parking hours on Margaret Drive be revised to limit parking to
one (1) hour (rather than the current (2) hour) between 8 a.m. and 6 p.m. every day,
except holidays. There are fifteen (15) homes on Margaret Drive that will be affected by
the change. As outlined in Chapter 12.68 of the Municipal Code, all of these residents
can purchase permits which will allow them to be exempt from the parking time hour
restrictions.
RECOMMENDATION:
a) Adopt Resolution No. 2016-30, A Resolution of the City Council of the City of
Newport Beach, California, Limiting the Parking of Vehicles on Certain Streets and
Rescinding Resolution No. 2009-62;
b) Adopt Resolution No. 2016-31, A Resolution of the City Council of the City of
Newport Beach, California, Limiting the Parking of Vehicles on Margaret Drive,
between the hours of 8:00 a.m. and 6:00 p.m. every day, except holidays, to one (1)
hour on Margaret Drive from Irvine Avenue, to and including 2322 on the north side,
and 2323 on the south side of Margaret Drive; and

c) Introduce Ordinance No. 2016 3, An Ordinance of the City Council of the City of
Newport Beach, California, Amending Subsection 12.68.060(B) of the Newport
Beach Municipal Code Regarding the Residential Parking Permit Program for the
Newport Heights and Cliff Haven, approving revisions to the Preferential Parking
Zone “2”, and pass to second reading on February 23, 2016.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
Staff received a request from the residents on Margaret Drive to change the current
permit parking hours on their street to address the regular overflow of school parking
and the related trash impacts on their street. Residents are specifically requesting that
the existing two (2) hour parking limit during school days be changed to a one (1) hour
limit every day, except holidays. Based on their experience, the existing two (2) hour
parking restriction is not sufficient to address their concerns with excessive parking.
The primary entrance to Newport Harbor High School from Irvine Avenue is at the
Margaret Drive intersection. Because of the immediate proximity to the school entrance
location, Margaret Drive experiences more school parking issues than other residential
streets in the surrounding neighborhood. Many students access the school at this
location during regular school hours. In addition, this location is busy during weekday
after-school athletic events and extracurricular activities. The high school is also used
extensively during weekends and weekday evenings for sports tournaments, football
games, etc. Those attending the on-campus events often choose to park on Margaret
Drive because it is the closest street to their destination.
A meeting was held with representatives of the Margaret Drive residents, the Newport
Harbor High School Principal, and staff on November 16, 2015. At this meeting,
residents indicated they would provide a signed petition, which is included herein as
Attachment D.
Municipal Code Sections 12.44.010 (B) and (E) establish two (2) hour parking
restrictions upon such streets as the City Council shall designate, and authorizes the
City Council to vary the hours or days of parking restrictions when special parking or
traffic conditions exist. The first proposed Resolution would rescind Resolution No.
2009-62 to remove Margaret Drive from the existing two (2) hour parking restriction.
Municipal Code Sections 12.44.010 (A) and (E) establish one (1) hour parking
restrictions upon such streets as the City Council shall designate, and authorizes the
City Council to vary the hours or days of parking restrictions when special parking or

traffic conditions exist. The second proposed Resolution would limit the parking of
vehicles between the hours of 8 a.m. and 6 p.m. every day, except holidays, to one
(1) hour on Margaret Drive from Irvine Avenue to and including 2322 on the north side,
and 2323 on the south side of Margaret Drive.
As part of the parking revisions, staff is also recommending the City Council adopt an
Ordinance amending the parking regulations provided in Municipal Code Section
12.68.060 (B) to read:
“B. Zone “2” – Newport Heights and Cliff Haven. Parking on the following streets shall
be limited to two (2) hours duration on school days between the hours of 8 a.m. and 6
p.m., except by permit, unless otherwise indicated below.
(B)(7). Margaret Drive – From Irvine Avenue to and including 2322 on the north side
and 2323 on the south side of Margaret Drive. One (1) Hour limit 8 a.m. to 6 p.m. every
day, except holidays.”
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

On January 24th, 2016 a petition was delivered to NB city hall on behalf of the residents on Margaret Drive who
reside in the Zone 2 parking restriction area. Please review the reasons for this petition to change the current
Zone 2 for Margaret Drive only.
The majority of residents that live in this area have been on Margaret Drive for over 20 years. Sixty percent have
children that graduated from NHHS in the last 10-15 years so we are very supportive of the school and have
worked with them and the city on this issue for 15 plus years. Our conclusion is there needs to be a change to the
current parking restrictions (length/days) that will improve our neighborhood and not impact the school since
there is ample parking on campus for the majority of their students, events and those that do exceed school
capacity are welcome to use our street.
Margaret Drive is the closest residential street to Newport Harbor High’s gyms, tennis courts and athletic f ields,
closer than the parking lots on campus except for the 16th street lot to Davidson Field.
Margaret Drive has a direct link via its location and the cross walk to the center of the west side of the campus and
its gyms.
Every activity* held at the gym(s) use Margaret Drive as the primary parking location vs on campus lots, which
includes the participants, their friends, relatives and general public attending.
NHHS is now an event center that is active 12 months a year in which Margaret is impacted by these events about
300 plus days a year.
Approximately 13 different NHHS athletic programs use the west side facilities on campus throughout the year for
games, tournaments and or practices. Each program has at least Varsity, JV and the majority have F/S.
The school has about 10 or more major non athletic functions on the west side of its campus that attracts 50 plus
to hundreds visiting the campus, again using Margaret Drive as a primary parking location.
The School District (NMUSD) leases out these same facilities to outside groups that add more participants and
visitors to the campus. This is active all year round with club sports in the gyms.
The residents of Margaret Drive are not looking to ban parking on our street 100% of the time for those going to
the school but we are in need of reducing the overall impact our section of the street endures due to lack of use of
on campus parking. We would like to be able park on our own street when we have friends and guests and not
wake up to car alarms, slamming doors and driveway turnarounds at 7:00 am on a weekend mornings. We used to
have summers off of parked cars and trash but not anymore due to the districts increased lease activities on
campus when school is out.
*approximately 150 and counting of games, meetings, events a year. Does not include team practices, club sports
programs, district lease programs and overall student parking on school days.
