ABSTRACT:
As part of the current Orange County Transportation Authority’s (OCTA) update of the
Federal Transportation Improvement Program (FTIP), the City is required to adopt a
Resolution affirming its intention to allocate necessary funds and implement the
MacArthur Boulevard Pavement Rehabilitation Project and the Park Avenue Bridge
Replacement Project reflecting the federal transportation grant funds that the City was
awarded for these two projects.
RECOMMENDATION:
Adopt Resolution No. 2016-34, A Resolution of the City Council of the City of Newport
Beach, California, Certifying that the City has the Resources to Fund the Projects
Submitted for Inclusion in the 2017 Federal Transportation Improvement Program within
Federal Fiscal Years 2016/17 – 2021/22 and Affirms its Commitment to Implement all
Projects in the Program, affirming the City’s intent to fund and allocate resources to
implement the MacArthur Boulevard Pavement Rehabilitation Project and the Park
Avenue Bridge Replacement Project as part of the 2017 FTIP.
FUNDING REQUIREMENTS:
There is no fiscal impact related to the adoption of this Resolution. The required funding
for these two projects is included in the current FY 2015/16 Capital Improvement
Program budget.
DISCUSSION:
The FTIP is a listing of all capital transportation projects proposed over a 6-year period.

vehicle lanes, signal synchronization, intersection improvements, freeway ramps, bike
facilities, etc. The OCTA FTIP database includes all projects that are deemed regionally
significant, regardless of the funding source and allow local agencies access to view
and amend their projects.
As part of the 2017 FTIP update, OCTA requires local jurisdictions to adopt a
Resolution affirming the City’s intent to allocate resources to fund and implement
federally funded projects.
Currently, the City has two upcoming improvement projects that are listed in the FTIP.
The MacArthur Boulevard Pavement Rehabilitation project will be partially funded by
federal funds through the Arterial Pavement Management program. The Park Avenue
Replacement Bridge project was awarded through a grant from the Federal Highway
Administration Highway Bridge Program. The two projects are detailed below:
1.MacArthur Boulevard Pavement Rehabilitation Project – This project
involves grinding and overlaying MacArthur Boulevard from East Coast
Highway to Bonita Canyon Drive with rubberized asphalt concrete.
Deteriorated concrete improvements will also be reconstructed. Construction
will be partially funded with federal funds as part of the Arterial Pavement
Management program.
2.Park Avenue Bridge Over Grand Canal Replacement Project – This
project provides for the replacement of the Little Balboa Island Bridge. The
City is currently requesting additional Federal funding based on actual bid
results and it is expected to be fully funded with federal funds as part of the
Federal Highway Administration Highway Bridge Program.

Final design for the MacArthur Blvd. Project has been completed and has been
submitted to Caltrans for formal approval as required by the federal funding process.
Upon Caltrans approval, MacArthur Blvd. will go through the public bid process and be
brought to Council for award of the construction contract. Construction bids for the Park

Avenue Bridge Replacement Project have been received. Staff will be requesting City
Council approval to award that project under a separate staff report. Funding for the
Park Avenue Bridge Replacement may change depending on results of the current
discussions with Caltrans and Federal Highway Administration.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

OF NEWPORT BEACH, CALIFORNIA CERTIFYING THAT
THE CITY HAS THE RESOURCES TO FUND THE
PROJECTS SUBMITTED FOR INCLUSION IN THE 2017
FEDERAL TRANSPORTATION IMPROVEMENT
PROGRAM WITHIN FEDERAL FISCAL YEARS 2016/17 –
2021/22 AND AFFIRMS ITS COMMITMENT TO
IMPLEMENT ALL PROJECTS IN THE PROGRAM
WHEREAS, the City of Newport Beach (“City”) desires to include the MacArthur
Boulevard Pavement Rehabilitation Project and the Park Avenue Bridge Project in the
Orange County Transportation Authority’s (OCTA) 2017 Federal Transportation
Improvement Program (FTIP); and
WHEREAS, the City is able to commit funding for the City’s share as required
and accepts responsibility to fully implement submitted projects; and
WHEREAS, the City is the lead agency for projects and will comply with
applicable local, state, and federal provisions including the Federal Transportation
Improvement Program, California Environmental Quality Act, National Environmental
Policy Act, Americans with Disabilities Act, and Buy America; and
WHEREAS, the City agrees to the MacArthur Boulevard Pavement Rehabilitation
Project and the Park Avenue Bridge Project as shown in the 2017 FTIP; and
WHEREAS, the City desires to finance and construct the projects as noted in
the FTIP in a timely manner.
NOW THEREFORE, the City Council of the City of Newport Beach hereby
resolves as follows:
Section 1: The recitals provided above are true and correct and are
incorporated into the operative part of this resolution.
Section 2: The City Council does hereby affirm the City’s commitment to the
projects submitted in the 2017 Federal Transportation Improvement Program.
Section 3: If any section, subsection, sentence, clause or phrase of this
resolution is, for any reason, held to be invalid or unconstitutional, such decision shall
not affect the validity or constitutionality of the remaining portions of this resolution. The

City Council hereby declares that it would have passed this resolution, and each
section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any
one or more sections, subsections, sentences, clauses or phrases be declared invalid
or unconstitutional.
Section 4: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act (“CEQA”) pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in
the environment) and 15060(c)(3) (the activity is not a project as defined in Section
15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3,
because it has no potential for resulting in physical change to the environment, directly
or indirectly.
Section 5: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting the resolution.
