ABSTRACT:
Consideration and approval of a Professional Services Agreement with Kimley-Horn
and Associates, Inc. for environmental consulting services for the preparation of
necessary environmental studies including a traffic study for a proposed mixed-use
development.
RECOMMENDATION:
Approve the Professional Services Agreement, and authorize the Mayor and City Clerk
to execute the agreement.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item. The consulting service cost of $193,884
will be reimbursed to the City by the applicant (Shopoff Land Fund II, LP).
DISCUSSION:
In 2006, the comprehensive update of the General Plan provides for new residential and
mixed-use development in the Airport Area generally north of State Route 73 and
between Campus Drive and Jamboree Road.
On September 28, 2010, the Newport Beach City Council approved the Integrated
Conceptual Development Plan (Plan) to guide the redevelopment of the 25-acre Uptown
Newport site and the inclusion of a mixed-use development within Koll Center Newport.

The Uptown Newport site has been entitled by the Shopoff Group and is presently
under construction.
On February 10, 2015, the Shopoff Land Fund II, LP submitted an entitlement
application to allow project development on a 12.70-acre portion of the Koll Center
Newport office park between Birch Street and Von Karman Avenue. The project
includes 260 residential units, 3,019 square feet of retail space, and a 1-acre
neighborhood park. The new development is proposed on the parking lots for the
existing office uses; therefore, replacement parking will be provided.
After many months of planning, the project is now ready to proceed and requires the
preparation of an Environmental Impact Report (EIR) and a traffic study pursuant to the
Traffic Phasing Ordinance. Consistent with Council Policy F-14 and the City Manager’s
Administrative Procedures Manual, a request for proposals for the preparation of an EIR
was sent to six environmental consultant firms and three proposals were received. Staff
selected Kimley-Horn and Associates, Inc. based on their qualifications, experience,
and competitive cost.
ENVIRONMENTAL REVIEW:
Retention of consultants is not a project as defined by California Environmental Quality
Act (CEQA).
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
