SUBJECT: Regular Meeting, March 8, 2016 – Correction to Agenda Item 4:
Accept the 2015 UASI Transfer Agreement
Since the posting of the agenda, the Police Department has revised the staff report
due to typographical errors:
The proposed transfer agreement is with the City of Santa Ana, not Anaheim.
The award amount is $4.4 million, not $5.5 million.
Staff recommends that you approve this item as amended. Redline drafts of the
revised staff report and resolution are attached, as well as a final draft of the staff
report and resolution.

ABSTRACT:
The Federal Urban Area Security Initiative (UASI) Grant Program provides support to
select high-threat, high-density urban areas in order to address their unique needs in
building and sustaining capabilities to prevent, protect against, respond to, and recover
from threats or acts of terrorism. The City of Newport Beach is considered an urban
area sub-recipient under this grant program. Execution of the Transfer Agreement will
make the City eligible to receive equipment and training funding under the FY 2015
UASI grant including reimbursement funds currently available through the Training
Allocation.
RECOMMENDATION:
1. Adopt Resolution No. 2016-___ approving the Agreement for Transfer or
Purchase of Equipment/Services or for Reimbursement of Training Costs for
FY 2015 Urban Areas Security Initiative ("Transfer Agreement") and authorizing
the City Manager and the Police Chief to act as the "Authorized Agents" to
execute for, and on behalf of, the City any actions necessary to implement the
Transfer Agreement and obtain federal financial assistance provided by the
Federal Department of Homeland Security (DHS) and sub-granted through the
California Office of Emergency Services (Cal OES).
2. Accept the FY 2015 UASI Grant Fund Training Allocation in the amount of
$3,409 to be utilized for reimbursement of training costs associated with
approved DHS courses for emergency response personnel. The City of Anaheim
Santa Ana UASI has designated $3,409 to reimburse the City's approved UASI
training instructors to conduct regional training.

3. Approve Budget Amendment No. BA-___ to accept UASI grant funds, increase
revenue estimates by $3,409 in account 01035352-431471-G1503, and increase
expenditure appropriations by $3,409 in account 01035354-713002-G1503.
FUNDING REQUIREMENTS:
This budget amendment records and appropriates $3,409 in additional revenue from
UASI and $3,409 in increased expenditure appropriations. There are no matching fund
requirements to accept this grant.
DISCUSSION:
The Urban Area Security Initiative (UASI) Grant Program was authorized by Congress
in 2003, and implemented by DHS to help strengthen the nation against risks
associated with potential terrorist attacks. In 2015, high-threat, high density urban areas
were eligible for funding under the UASI program, including the Orange County
Metropolitan Area. The urban areas are chosen by DHS based on a formula that takes
into account factors such as a critical infrastructure, population density, and credible
threat information. The cities of Anaheim and Santa Ana, selected as the core cities for
Orange County, were jointly awarded approximately $5.5 4.4 million in FY 2015.
Together, these agencies are responsible for the management and administration of the
UASI Grant Program. Overall, the UASI Grant provides the City's first responders
equipment and training to better prepare for a terrorist attack and/or natural disaster.
The FY 2015 UASI Grant Program Priorities for Orange County include:
• Strengthen Interoperable Communications: Dispatch radio consoles for P25
Compliance upgrade
• Strengthen Chemical, Biological, Radiological, Nuclear and Explosives (CBRNE)
detection, response and decontamination capability, which includes replenishing
dosimeters for Fire, replenishing Personal Protective Equipment (PPE),
maintaining FLIR equipment and OCSD Bomb Squad robot upgrades
• Enhance information collection, analysis and dissemination to sustain the
Automated License Plate Recognition (ALPR) Program
• Improve and expand critical infrastructure protection; sustain Orange County
Civic Center Video Surveillance System
• Enhance catastrophic incident planning, response and recovery, including
portable fuel trailers and camlocks/cabling
• Citizen Preparedness and Participation: enhance the Ready OC Preparedness
Campaign and the “If You See Something, Say Something” Citizen
Preparedness Campaign through 2016

• Homeland Security Training Program: continue conducting the training program,
including, but not limited to: Tactical Emergency Casualty Care for Law
Enforcement, Immediate Action Team (IAT) Refresher, ICS 300, ICS 400, Unified
Response to Active Shooter Incidents and approve Fire training courses
• Homeland Security Exercise Program: continue conducting the Regional
Homeland Security Exercise Program
• Enhance regional intelligence and counter-terrorism efforts: continue funding
Analyst and Program Manager Salaries at OCIAC and the following equipment
needs: analytical research systems and data sources
The City of Newport Beach is considered an urban area sub-recipient under this grant
program. Once the Transfer Agreement is approved, the City is eligible to receive
equipment and training funding for approved City UASI Training Instructors.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH APPROVING THE TRANSFER AGREEMENT FOR FISCAL YEAR
2015 URBAN AREA SECURITY INITIATIVE GRANT PROGRAM
PURPOSES BETWEEN THE CITY OF NEWPORT BEACH AND THE CITY
OF ANAHEIM SANTA ANA
WHEREAS, the Federal Urban Areas Security Initiative (UASI) Grant Program
dedicates funding support to select high-threat, high-density urban areas in order to
address their unique multi-discipline planning, organization, equipment, training, and
exercise needs to prevent, protect against, respond to, and recover from threats or acts
of terrorism.
WHEREAS, the City of Santa Ana, acting through the Santa Ana Police
Department in its capacity as a Core City for the Santa Ana/Anaheim Urban Area under
the Fiscal Year 2015 UASI, has applied for, received and accepted a grant entitled
“Fiscal Year 2015 Urban Areas Security Initiative” from the Federal Department of
Homeland Security (DHS) Federal Emergency Management Agency (FEMA), through
the State of California Governor's Office of Emergency Services (Cal OES), to enhance
countywide emergency preparedness.
WHEREAS, the City of Newport Beach (“City”) has partnered with the City of
Santa Ana to participate in the Fiscal Year 2015 UASI Grant Program. The City will
request training under this grant that will be used for the public safety of its citizens.
WHEREAS, the City of Santa Ana is the administrator of the Fiscal Year 2015
UASI Grant Program. The City is required to sign a Transfer Agreement and the
California Emergency Management Agency Grant Assurances. The City of Santa Ana
requires the naming of two authorized agents from within the City to sign these
documents on behalf of the City.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: Approve the Transfer Agreement for Fiscal Year 2015 UASI Grant
Program purposes (“Transfer Agreement”) between the City and the City of Santa Ana
attached hereto as Exhibit 1.
Section 2: Authorize the City Manager and the Police Chief to act as the
“Authorized Agents” to execute for, and on behalf of, the City any actions necessary to
implement the Transfer Agreement and obtain federal financial assistance provided by
the Federal Department of Homeland Security and sub-granted through the Governor’s
Office of Emergency Services (Cal OES).
Section 3: This resolution shall take effect immediately upon its adoption by
the City Council, and the City Clerk shall certify the vote adopting the resolution.
