Coastal Commission staff indicates many more properties are in violation, but have stayed issuance of NOV to allow City/residents to develop a solution. SS2-2 3 SS2-3 4 SS2-4 City to take lead role Create Encroachment Program w/in 15-feet Remove unpermitted development beyond 15-feet 5 SS2-5 February 2013 – City Council directs staff to seek a solution and initiated an amendment to the Coastal Land Use Plan. Ongoing – Staff discussions with Coastal Commission staff and residents Completed - Removal and Replacement Plan for area beyond 15-foot right-of-way 6 SS2-6 Plan includes: Parcel level analysis for removal of unpermitted development Parcel level cost estimates Monitoring Program SS2-7 Recommendation: City should coordinate the Removal Plan. $210,000 for removal and 3 year maintenance Analysis, Planning, Permitting, Construction Residents would reimburse City. 8 SS2-8 Existing Policy - No encroachments permitted Exceptions: ▪Trees existing prior to October 22, 1991 ▪Groundcover Proposed Policy – Consistent w/ West Newport Prohibit anything that requires a building permit No pressurized irrigation No objects above 36 inches No impacts to public access No landscaping in dune habitat SS2-9 10 SS2-10 11 Right of Way Tidelands SS2-11 What should be the cost of encroachment permit?
