On April S. 2002, the Santa Ana Regional Water Quality Control Board (RWQCB) issued a technically
conditioned Clean water Act Section 401 Water Quality Standards Certification for the above-refcmuced
project. The applicant has contacted Glenn Robertson, with our Regulations Section, to fuether discuss
his project. We have determined based on conversations with our Regulations staff and documentation
received from your agent David Altman, Noble Consultants, Inc, that no dewatering will occur at Uw site
due to changes in construction methods. As a resuh, a National Pollulli tt ischazge Elimination Systertt
will ant be, needed for this
project.
This Addendum revises the second full paragraph on page 2 of the 401 Certification issued on April 8, 2002,
directing the applicant to obtain a Natimtal Poll wnt Discharne Elimination System 11S D Permit No.
CAG99g(10(, general Waste.Disciiarw 1tuirements For DisclitlMas TO Surface WAM Which ore An
Insignificant (De Minimus) Threat To Water OtWity.
All other tenets set forth in the April 8, 2002 401 Certification remain valid and must be upheld. Although
we anticipate no further regulatory involvement, if the -eve -stated .conditioos.are changed, any of -the
criteria or conditions as previously described are not met, or new information becomes available that
indicates a water quality problem. we may fomadatc Waste Discharge Requirements.
In the event of any violation or threatened violation of the conditions of this certifiearion, the violation or
threatened violation shall be subject to any remedies, penalties, process or sanctions as provided for under
state law. For purposes of Section 40I(d) of the Clean Water Act, the applicability of any stato law
authorizing remedies, penaltiesi process or sanctions for the violation or threatened violation constitutes a
limitation necessary to assure cougtliance with the water quality standards and other pertinent requirements

On November 5, 2002, the California Coastal Commission granted to Tara Rands
Coastal Development Permit 5.02-042, subject to the attached Standard and
Special Conditions, for development consisting of: demolish and construct a single
family residence, demolish and construct a bulkhead in the same location and
also extend an existing bayfront patio over the water. More specifically described in

1. Notice f Recei t and A kn wl d ment. The permit is not valid and
development shall not commence until a copy of the permit, signed by the
permittee or authorized agent, acknowledging receipt of the permit and
acceptance of the terms and conditions, is returned to the Commission office.
2, x irati n, if development has not commenced, the permit will expire two years
from the date on which the Commission voted on the application. Development
shall be pursued in a diligent manner and completed in a reasonable period of
time. Application for extension of the permit must be made prior to the expiration
date-
3- Interpretation. Any questions of intent or interpretation of any condition will be
resolved by the Executive Director or the Commission.
4. Assinnment. The permit may be assigned to any qualified person, provided
assignee files with the Commission an affidavit accepting all terms and
conditions of the permit.
5. T rm onditions Run with the Land, These terms and conditions shall be
perpetual, and it is the intention of the Commission and the permittee to bind all
future owners and possessors of the subject property to the terms and
conditions.
III, SPECIAL CONDITIONS:

(a) No construction materials, equipment, debris, or waste will be placed or
stored where it may be subject to wave wind, or rain erosion and
dispersion-
(b) Any and all construction material will be removed from the site within 10
days of completion of construction-
(c) Machinery or construction materials not essential for project improvements
will not be allowed at any time in the intertidal zone,
(d) if turbid conditions are generated during construction a sift curtain will be
utilized to control turt)idity.
(e) Floating booms will be used to contain debris discharged into coastal
waters and any debris discharged will be removed as soon as possible but
no later than the end of each day.
(f) Non -buoyant debris discharged into coastal waters will be recovered by
divers as soon as possible after toss.

Dear Ms, Rands.
Reference is made to your request of February 11, 2002. Under the provisions of Section 10
of the Rivers and harbors Act of March 3, 1899 (33 U.S.C. 4R3), you are hereby authorized to
perform construction activities that would result in approximately 0-003-acre additional coverage
of unvegetated, intertidal habitat within jurisdictional waters of the United States, bayward of
1132 East Balboa Boulevard, in Newport Bay within the city of Newport Beach, Orange County,
Califomia. Activities authorized by this Letter of Permission include the replacement and
extension of an existing deck and the installation of four concrete pilings using Corps -approved
methods to prevent the discharge of excavated material into Newport Bay, as shown on the
enclosed drawings.
Furthermore, based on the information furnished in your letter and provided in
subsequent communications between Mr. flick Ware and Ms. Corice Farrar of my staff, we have
determined that your bulkhead replacement project is to occur landward of Corps jurisdictional
areas, i-e_, above the High Tide Line, and as such sloes not result in a discharge dredged or fill
material into a water of the United States or an adjacent wetland. Therefore, the project is not
subject to our jurisdiction tinder Section 404 of the Clean Water Act and a Section 404 permit is
not required from our office. This jurisdictional determination is valid only if the following
conditions are met:
1. No mechanized land clearing or excavation occurs within jurisdictional waters of the
United States, or adjacent wetlands.
2. Any dredged or fill materials are deposited in upland areas landward of the High Tide
Line or directly into a truck and hauled to an appropriate off -site location.
3. No temporary stockpiling of dredged or fill material may occur within jurisdictional
waters and adjacent wetlands.
The owner or authorized responsible official must sign and date all copies of this Letter of
Permission (LOP) indicating that he/she agrees to the work as described and will comply with all
conditions. One of the signed copies of this Letter of Permission must be returned to the Corps of
Engineers (a pre -addressed envelope is enclosed). In addition, please use the two attached
postcards to notify this office as to the dates of commencement (within 10 days prior to the start of
construction) and completion of the activity (within 10 days following the end of construction).

the holder of any permit or license subject to this certification to furnish, under penalty of perjury, any
technical or monitoring reports the Regional Board deems appropriate. The burden. including costs, of

to or modify the conditions of this certification as appropriate to ensure compliance.

Re: Harbor Permit 110-1130-1, for the property at
1132 East Balboa Blvd.
Dear Sirs:
The City of Newport Beach Marine Department has received a request to transfer
the above Harbor Permit. The facility was inspected by a representative of the
Newport Beach Marine Division on October 16,1996.
We cannot transfer the pier permit until the following has/have been corrected
and WE HAVE BEEN NOTIFIED OF THE CORRECTION:
1. A City approved anti -syphon device is required at the water connection for
the water supply line serving that pier and float. A sketch showing the approved
type of device and its installation is enclosed. This requirement is in accordance
with Title 17 of the California Admuustrative Code. It is also required that this
device be tested annually.
2. All electrical receptables on the pier and dock must be GFI or twist locked.
The outlets must have covers.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures shall be inspected for
compliance with the City's minimum plumbing, electrical and structural
requirements, and the conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the permit."
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES

Dear Mr. Chabre:
The City of Newport Beach Harbor Permit Policies allow only
only one pier and float bayward of each residentially zoned
lot, as delineated in Section I.E., which states:
1.E. "In R-1 zones, only a single pier and float or slip
shall be permitted bayward of each parcel or lot."
In that regard, it would the City staff recommendation,
based on the above quoted section of the permit policies,
that an application for a shore mooring bayward of a location
where there was already a Harbor Permit for a pier and float
would be denied.

The City of Newport Beach has received an application to transfer
pier permit # 110-1130 for the property located at 1130 E. Balboa Blvd.
Newport Beach, California.
The structure was inspected on 8/18/81 at which time it was determined
that the following deficiencies exist:
1.
A City -approved anti -syphon device is required at the water connection
to the pier and float.
2.
The conduit needs to be extended to the end of the "new ramp" to a
junction box. Some of the old wiring is not in conduit and needs
3, to be placed in conduit.
Some of the railings need reinforcement.

In accordance with Section 10-D of the City Harbor Permit Policies:
"All structural deficiencies must be corrected......", it will be
necessary for these to be corrected. A permit for any electrical or
plumbing work must be obtained from the Building Department of the City.
All other work requires a Harbor Permit.

corrected.
