WX FORM 6B.I010 REV, i d Dear Mr. Crean: Elaine and Martin Weinberg your neighbors to the North at 100 Via Lido Nord have contacted this office concerning the recently revised dock bayward from your property at 101 Via Lido Soud (letter attached). Their concern is that if a vessel is berthed on the North side of the dock, access to the dock would require crossing into their pier permit area by constantly transversing across the prolongation of their side property line (drawing attached). Generally most docks have a five-foot set -back from adjoining properties and this limits the size of any boat berthed at the dock. In your case on the North side there is a five-foot set -back at the most bayward tip of your dock that angles to create close to 20 feet between the dock and the side property line near the bulkhead. The Weinbergs request that this office place a condition of your permit that restricts the size of any boat berthed on this side of the dock. The Harbor Resources Director has the authority to add conditions to a permit if in his opinion it would be beneficial and reasonably necessary to insure there be no on going violations of the City's Harbor Permit Policies. Therefore Harbor Permit 174-101 will be conditioned to restrict vessels berthed on the North side of your dock not to exceed five feet is width. Please contact this office if you require additional information in regards to this matter, or if you object to the addition of the above mentioned condition to your harbor permit. RATIONALE: The subject site is located between the first public road and the sea and is a bayfront lot. An inspection by the City of Newport Beach Fire and Marine Department states that no eel grass is present within 15 feet of the project area. In addition, the Regional Water Quality Control Board has determined that the proposed project will not adversely impact water quality if standard construction methods and materials are used. The proposed dock work is consistent with Section 30233 of the Coastal Act in that the project will result in the fill of coastal waters (i.e. placement of pilings) for a boating facility and the development minimizes the quantity and size of pilings which minimizes the quantity of fill of coastal waters. Public access to the Newport Bay is available approximately 450 feet east of the project site. The proposed project design is compatible with the character of surrounding development and does not have any negative affects on visual or coastal resources, public recreation or coastal access. Also, the proposed development will not prejudice the City's ability to prepare a Certified Local Coastal Program and is consistent with the land use designation in the City's certified Land Use Plan, past Commission actions in the area and Chapter Three policies of the Coastal Act. This waiver will not become effective until reported to the Commission at their January 9-12, 2001 meeting and the site of the proposed development has been appropriately noticed, pursuant to 13054(b) of the California Code of Regulations. The enclosed Notice Card shall remain posted at the site until the waiver has been validated and no less than seven days prior to the Commission hearing.
