Floating Dock $56,880.00 Pilings (dock) $18,000.00 Pier with pile $13,800.00 TTL $72,480.00 The original bid that was put together for Mr. Robinson two years ago it was for a rework of his existing float and no pile work. The scope of work changed to a new float with new pile and I didn't change the cost to reflect the increase in work and valuation, my mistake I guess I was just copying numbers done and wasn't paying attention. The pier permittee is aware of the Harbor Permit Policies and Chapter 17 of the City of Newport Beach Municipal Code. The permit is not valid and development shall not commence until a copy of the permit, signed by the permittee or authorized agent,. acknowledging receipt of the permit and acceptance of the terms and conditions, is returned to the Commission office. 2. Expiration. If development has not commenced, the permit will expire two years from the date this permit is reported to the Commission. Development shall be pursued in a diligent manner and completed in a reasonable period of time. Application for extension of the permit must be made prior to the expiration date. 3. Interpretation. Any questions of intent or interpretation of any term or condition will be resolved by the Executive. Director or the Commission. 4. Assignment. SPECIAL CONDITIONS: See.pages four to five. EXECUTIVE DIRECTOR'S DETERMINATION (continued): The Executive Director hereby determines that the proposed development is a category of development, which, pursuant to PRC Section 30624, qualifies for approval by the Executive Director through the issuance of an Administrative Permit. Subject to Standard and Special Conditions as attached, said development is in conformity with the provisions of Chapter 3 of the Coastal Act of 1976 and will not have any significant impacts on the environment within the meaning of the California Environmental Quality Act. If located between the nearest public road and the sea, this development is in conformity with the public access and public recreation policies of Chapter 3. FINDINGS FOR EXECUTIVE DIRECTOR'S DETERMINATION: A. Project Location. Description and Previous Com*mission Action At Subject Site Protect Location and Description The subject site is located at 103 Bayside Place in the City of Newport Beach (Exhibits #1-2). Single-family residences characterize the subject site and the surrounding area. The proposed project involves the following: removal and replacement of an existing "U" shaped dock like -for - like consisting of: two (2) 8' x 60' fingers and a 6' x 38' backwalk. The dock will be made of trex and Douglas fir. No new piles are proposed and no work on the existing pier or gangway is proposed (Exhibit #3). Coastal public access to the bay is available approximately 300 feet north of the project site at a street end (Exhibit #1). 5-05-432-[Robinson] Administrative Permit Page 3 of 5 The dock project will be used for boating related purposes to serve a single-family residential development. The site has been surveyed by the City of Newport Beach. Harbor Resources . Division for eelgrass and eelgrass was discovered within 15-feet of the project area. However, the:projectdoes not anticipate adverse impacts to eelgrass associated,with the proposed project since the existing piles will be used and because no new piles are proposed there is no potential for direct adverse impacts to eelgrass beds, nor is there potential for disturbance to Caulerpa taxifolia. Thus, the usual pre- and post- project surveys are not required in this case. The proposed project has received an approval in concept from the City of Newport Beach Harbor Resources Division. The Regional Water Quality Control Board (RWQCB) has determined that the proposed project will not adversely impact water quality if standard construction methods and materials are used. The applicants have applied for a permit from the U.S. Army Corps of Engineers. Section 30600(c) of the Coastal Act provides for the issuance of coastal development permits directly by the Commission in regions where the local government having jurisdiction does not have a certified Local Coastal Program. The City of Newport Beach only has a certified Land Use Plan and has not exercised the options provided in 30600(b) or 30600.5 to issue its own permits. Therefore, the Coastal Commission is the permit issuing entity and the standard of review is Chapter 3 of the Coastal Act. The certified Land Use Plan may be used for guidance. 2. Prior Commission Actions at Subject Site On December 5, 1977, the Commission approved Permit A-2301 to alter the pier and add a deck. B. Marine Resources The proposed recreational boat dock development and its associated structures do not result in the fill of coastal waters and are an allowable and encouraged marine related use. The proposed dock work will not.have any significant adverse effect,on sensitive marine resources, such as eelgrass. Therefore, the Commission finds that the proposed development, which is to be used solely for recreational boating purposes, conforms with Section 30224 of the Coastal Act C. Water Quallt The proposed work will be occurring on, within, or adjacent to coastal waters. The storage or placement of construction material, debris, or waste in a location where it could be discharged into coastal waters would result in an adverse effect on the marine environment. To reduce the potential for construction related impacts on water quality, the Commission imposes special conditions requiring, but not limited to, the appropriate storage and handling of construction equipment and materials to minimize the potential of pollutants to enter coastal waters. To reduce the potential for post -construction impacts to water quality the Commission requires the continued use and maintenance of post construction BMPs. As conditioned, the Commission finds that the development conforms to Sections 30230 and 30231 of the Coastal Act. D. Local Coastal Program The LUP for the City of Newport Beach was effectively certified on May 19, 1982. At the October 2005 Coastal Commission Hearing, the certified LUP was updated. As conditioned, the proposed development is consistent with Chapter 3 of the Coastal Act and with the certified Land Use Plan for 5-05-432-[Robinson] Administrative Permit Page 4 of 5 the area. Approval of the project, as conditioned, will not prejudice the ability.of the local government to preparea Local Coastal Program that is in conformity with the provisions of Chapter 3. E. California Environmental Quality Act (CEQA) As conditioned, there are no feasible alternatives or additional feasible mitigation measures available that would substantially lessen any significant adverse effect that the activity may have on the environment. Therefore, the Commission finds that the proposed project, as conditioned to mitigate the identified impacts, is the least environmentally damaging feasible alternative and can be found consistent with the requirements of the Coastal Act to conform to CEQA. SPECIAL CONDITIONS: 1. Water Quality A. Construction Responsibilities and Debris Removal (1) No construction materials, equipment, debris, or waste will be placed or stored where it may be subject to wave, wind, or rain erosion and dispersion. (2) Any and all construction material will be removed from the site within 10 days of completion of construction. (3) Machinery or construction materials not essential for project improvements will not be allowed at any time in the intertidal zone. (4) If turbid conditions are generated during construction a silt curtain will be utilized to control turbidity. (5) Floating booms will be used to contain debris discharged into coastal waters and any debris discharged will be removed as soon as possible but no later than the end of each day. (6) Non -buoyant debris discharged into coastal waters will be recovered by divers as soon as possible after loss. B. Best Management Practices Program., By acceptance of this permit the applicant agrees that the long-term water -borne berthing of boat(s) in the approved dock and/or boat slip will be managed in a manner that protects water quality pursuant to the implementation of the following BMPs. (1) Boat Cleaning and Maintenance Measures: a. In -water top -side and bottom -side boat cleaning shall minimize the discharge of soaps, paints, and debris. b. In -the -water hull scraping or any process that occurs under water that results in the removal of paint from boat hulls shall be prohibited. Only detergents and cleaning components that are designated by the manufacturer as phosphate - free and biodegradable shall be used, and the amounts used minimized. 5-05-432-[Robinson] Administrative Permit Page 5 of 5 c. .The applicant shall: minimize.the.use of detergents and boat cleaning and maintenance products containing ammonia, sodium hypochlorite, chlorinated solvents, petroleum distillates.or lye. (2) Solid and Liquid.Waste Management Measures: a. All trash, recyclables, and hazardous wastes or potential water contaminants, including old gasoline or gasoline with water, absorbent materials, oily rags, lead acid batteries, anti -freeze, waste diesel, kerosene and mineral spirits will be disposed of in a proper manner and will not at any time be disposed of in the water or gutter. (3) Petroleum Control Management Measures: a. Oil absorbent materials shall be examined at least once a year and replaced as necessary. The applicant will recycle the materials, if possible, or dispose of them in accordance with hazardous waste disposal regulations. The boaters will regularly inspect and maintain engines, seals, gaskets, lines and hoses in order to prevent oil and fuel spills. Boaters will use preventive engine maintenance,oil absorbents, bilge pump -out services, or steam cleaning services as much as possible to clean oily bilge areas. Bilges shall be cleaned and maintained. Detergents will not be used for cleaning. The use of soaps that can be discharged by bilge pumps is prohibited. Discussion This application is being brought to the City Council for review and action because the applicant has requested an exception to the Harbor Permit Policies to allow the construction of a cantilevered deck over public tidelands granted to the County of Orange. Section 29 of the Harbor Permit Policies reads as follows: "In areas where the waterways are privately owned and within Promontory Bay, patio type decks may be cantilevered beyond the established bulkhead lines...." The only zones where cantilevered decks have approved Harbor Permits are Dover Shores, certain segments of Linda Isle and within Promontory.Bay. Additionally, approval of the County of Orange will be required in compliance with Section 5 E of the Harbor Permit Policies which states: "Prior approval of Orange County will be required when work extends over tidelands claimed by the County." A portion of the proposed deck will extend over County Tidelands with the majority to be constructed landward of the Mean High Tide Line over waterways in which the underlying property is privately owned. This application was sent to the Joint Harbor Committee for review and recom- mendation to both the City Council and the County of Orange. At their September 28 meeting, the Joing Harbor Committee, by a two to one vote, recommended denial of that portion of the cantilevered deck which extends over County tidelands. PAGE TWO APPLICANT: BEN DEANE It is staff's understanding that the intent of Section 29 of the Harbor Permit Policies was to prohibit the extension of yards or patios over public tidelands via the construction of cantilevered decks. The City Attorney has indicated that construction of a cantilevered deck over public tidelands for private residential use would go beyond permitted uses under the tideland grants. Prior to :this application being submitted to the Joint Harbor Committee, the Orange County Environmental Management. Agency staff was contacted for input in as much as the County .is the tidelands trustee in. this situation. The EMA staff indicated that County Counsel expressed some doubt as to the legality of permits being issued for this purpose. It is their feeling that "private residential use" of public tidelands may not be in keeping with the intent of the tidelands grants. As a result of the above information, the requirement for State Lands Division approval was included in the Recommendation portion of this report should Council .approve the exception to the Policies. Disruscinn Listed below are two alternatives the Committee may wish to consider in the formulation of its recommendation. Approve the pier and float revision and deny the cantilevered deck. 2. Approve the pier and float revision and the cantilevered deck subject to submittal prior to issuance of the Harbor Permit of a Registered Civil or Soils Engineers Certification that the existing retaining wall will support the proposed cantilevered deck. This application has been brought to the Joint Harbor Committee for review and recommendation in compliance with Section 5E of the City's Harbor Permit Policies which states: "Prior approval of Orange County will be required when work extends over tidelands claimed by the County." In addition, Section 29 of the Policies states: "In areas where the waterways are privately owned and within Promontory Bay, patio type decks may be cantilevered beyond the established bulkhead lines....." In this area, the waters bayward of the Mean High Tide Line are publicly owned, therefore should the Committee recommend approval of a variance, City Council approval of the application is required. The Harbor Permit Policies do not provide for cantilevered decks except as stated in Section 29 of the Harbor Permit Policies. The only zones where cantilevered decks have approved Harbor Permits are Dovers Shores, certain segments of Linda Isle and within Promontory Bay. Currently, three other cantilevered decks exist in this general area. However, staff was unable to find any record of City approval for these decks. Gentlemen: We have at your request performed a limited onsite examination of the existing seawall and the underlying geotechnical conditions at,the referenced location. This letter presents our conclusions and opinions as to the performance of the soils/rock foundation materials under the wall, under proposed additional loads to be imposed by a proposed deck system. The details are shown in the referenced drawing (see .Attachment I hereto, for -applicable portions of this drawing). On September 7, 1977, the undersigned, in company with Mr_, Ben Deane, performed a visual examination of the bay side of the sea- wall and a limited water -jet probing of the below -water foundation area. *About. 6 to 7 feet of the wall height was exposed, we could not see the lower 0 feet, since.it was under water. we found no visual evidence of any significant wall distress--i.e., cracks, linear spall.ing, tilting, relative differential settlement along the coping or variations in horizontal alignment. The water -jet probing revealed either bedrock or concrete along the entire length Deane Development Company September 16, 1977 Page 2 W. 0. 1013 of the wall, at the mudline. There appeared to be a thin (1 feet±) surface layer of loose sandy gravel overlying the concrete/rock. .We a.lso.noted that bedrock and associ.ated outcroppings (above water) a few feet away from the wall. The bay -front yard of the adjacent residence to seaward is bordered with very large imported boulders, probably mortared into bedrock. The Deane residence is, in all probability, founded on a superficial stratum of beach sand overlying bedrock which extends under the residence from the steep bedrock cliffs across Bay Front Place (street) from the house. The wall structural details are not known. We have discussed this with Mr. David 'Kramer, Civil Engineer. Based on conservative assumptions, he estimates that the vertical contact pressures 'on -the underlying foundation material are: (a) existing, about 1.3 ksf; and (b) proposed, about 1.5 ksf. Based on the above information., we 'believe that the foundation materials will satisfactorly support the proposed wall loads for the following reasons: (a) the foundation material has apparently performed well -in the past, since no distress was noted in the wall-; (b) the proposed new pressures are only slightly higher than those that exist; and (c) the proposed pressures are well within the allowable bearing capacity for rock materials. We recommend, how- ever, that further visual examinations be made of, the inside surface of the wall and underlying foundation materials during construction. As regards the proposed interior retaining wall, we note that one corner will be located close to the existing residence. Care should be taken during construction to provide adequate support for the foundations. In addition,appropriate construction safety precautions should be taken while excavating behind the wall, since the sandy soils crave easily. This report was prepared for planning purposes only. We assume that adequate structural drawings and construction supervision will be provided for this work. Our findings and recommendations were prepared .in accordance with generally accepted professional engineer- ing principles and practices. We make no other warranty, neither expressed nor implied.
