We received a copy of the letter dated January 24, 2008 from Tom Rossmiller, Manager, Harbor Resources Division of the City of Newport Beach responding to your e-mail of August 30, 2007, in which you complained that the floating dock serving 109 Bayside Place encroaches onto your property at 111 Bayside Place, As Mr. Rossmiller states in his letter, the existing pier and floating dock serving.109 Bayside Place comply with all judgments, pennits, applicable laws, regulations, and policies pertaining to the same, and there is no violation of any Newport Beach Harbor Pen -nit Policies. Mr. Rossmiller notes that the new survey recently commissioned by Mr, and Mrs, Moss reflects that a triangular portion of the northwest corner of their floating dock encroaches onto your property by three (3) inches at its widest point, tapering down to one (1) inch at the smallest point. Apparently, this very minor encroachment never interfered with anyone's use of 111 Bayside Place, since it appears that there were no complaints about this matter from the time the pier and dock serving 109 Bayside Place were completed in 1967 until your August 30, 2007 e- mail. The new survey and photos enclosed with Mr. Rossmiller's letter also show that the southwest comer of the floating docks serving your property and 113 Bayside Place encroach four (4) inches onto 109 Bayside Place, and that your new cantilevered deck and a large portion of your new stone and stucco wall encroach onto 1.09 Bayside Place. This is clearly a cause for great concern, since as the wall and deck now stand, they may significantly and negatively affect Mr. & Mrs. Moss's use and development of 109 Bayside Place. We and our clients agree with Mr. Rossmiller's recormnendation that you and Mr. and Mrs. Moss.should try to resolve and document resolution of your property line issues in an amicable and neighborly manner. This is in violation of the Newport Beach Harbor Permit Policies: Moorings, A, which states: "Boats moored at private or public docks shall not extend beyond the projection of the property lines of the property to which the dock facility is connected in accordance with section 20-C." This letter is to advise you that unless you relocate your vessel within 15 days of the date of this notice, an Administrative Citation may be issued and penalties will begin to accrue ($100, $200, $500 increments). Your cooperation will be greatly appreciated in this matter. Please see the attached picture of the infraction along with a drawing that depicts the property lines. RATIONALE: The proposed development consists of the removal of an existing dock float and guide pilings and replacement with a new dock float and guide pilings within the U.S. Pierhead Line. The proposed dock is similar in function to other residential docks in the immediate vicinity. In addition, an inspection performed by the City determined that no eelgrass exists in the vicinity of proposed project. Therefore, no eelgrass will be affected by the proposed r, project. Also, the Regional Water Quality Control Board has determined that the proposed project will not adversely impact water quality if standard construction methods and materials are used. The proposed development will not adversely impact coastal resources, public access, or public recreation opportunities, and is consistent with past Commission actions in the area and Chapter Three policies of the Coastal Act. This waiver will not become effective until reported to the Commission at their June 8-1'1., 1999 meeting and the site of the proposed development has been appropriately noticed, pursuant to 13054(b) of the California Code of Regulations. The enclosed Notice Card shall remain posted at the site until the waiver has been validated and;'no less than seven days prior to the Commission hearing. This comes as a bit of a surprise to us as none of us recalls reviewing the Harbor Permit Application 105-2307 referred to in the letter from the Marine Department to the Mayor and City Council dated June 13, 1983. Of particular concern to us is the so-called dedicated side tie space on the south finger of the north dock protruding into the City Easement. We do not see any granting of specific side tie boat beam allowance in the June 13t' letter and do not believe they have any more rights to this area than we do on the north finger of our dock. We could not find a copy of the -,permit in your file except the Trautwein drawing dated 5117/83. The Franks and Blattermans have been here since 1970, the Bellardis since 1977 and the Suttons since 1998. There have been reasonable size boats on the side ties of both docks off and on for the last 33 years and we are not aware of ever having any conflicts until now. The problem seems to be from the addition of a second boat on the side tie of the north dock along with an extra wide hydro hoist all within the city easement. In all fairness to the owners of both docks, an equitable solution would be to equally split the area for any side tie privileges. This is still significantly less space for our dock than if the 40ft easement had been split down the center. We assume, from our meeting, this matter will be taken to the Harbor Commission for resolution. Due to conflicting schedules, we would prefer either the Sept. 10`^ or Nov. 12"' Harbor Commission meeting dates. Replace these existing structures with 5 guide pilings and a 53 foot long by 50 foot wide U-shaped dock float with two boat slips. The five existing guide pilings will be removed and replaced by five new guide pilings, placed in a different configuration to accommodate the new dock float size. No eelgrass was found in the project vicinity. RATIONALE: The proposed development consists of the removal of an existing dock float and guide pilings and replacement with a new dock float and guide pilings within the U.S. Pierhead Line. The proposed dock is similar in function to other residential docks in the immediate vicinity. In addition, an inspection performed by the City determined that no eelgrass exists in the vicinity of proposed project. Therefore, no eelgrass will be affected by the proposed project. Also, the Regional Water Quality Control Board has determined that the proposed project will not adversely impact water quality if standard construction methods and materials are used. The proposed development will not adversely impact coastal resources, public access, or public recreation opportunities, and is consistent with past Commission actions in the area and Chapter Three policies of the Coastal Act. This waiver will not become effective until reported to the Commission at their June 8-11, 1999 meeting and the site of the proposed development has been appropriately noticed, pursuant to 13054(b) of the California Code of Regulations. The enclosed Notice Card shall remain posted at the site until the waiver has been validated and no less than seven days prior to the Commission hearing.
