TITLE: Arts Master Plan update/Arts funding
ABSTRACT:
The Arts Commission has drafted a three year funding and staffing plan to create a
long-term self-sufficient arts program in the City. This plan, if approved by City Council,
will likely provide the necessary funds to support existing programs and to transition into
programming with private funding. The City Arts Commission and the Newport Beach
Arts Foundation have approved this plan in concept for consideration by City Council.
The City Council has also requested that the Arts Commission begin to develop public-
private partnerships to reduce the reliance on the General Fund for arts programs.
RECOMMENDATION:
Consider the Arts Commission's recommended strategy as outlined here.
DISCUSSION:
At the Council Study Session on April 14, 2015, staff presented a draft Master Plan for
Arts and Culture to the City Council to consider. At the Study Session, City Council
considered the draft plan and provided direction to the Commission. At that meeting, the
City Council provided direction to the Arts Commission to:
1. Identify goals and objectives based on the Arts Master Plan recommendations and
develop a long- term vision for arts in the City;
2. Remove the Arts Master Plan recommendation for discretionary review of private
development;
3. Focus on ways to expand private support for public arts programs to lessen the
burden on public funds;
4. Set in place additional public review of sculptural arts selections; and

5. Provide options for Council action.
Current Programming and Budget
Over the last several years, the Arts Commission has focused on the following types of
programming. The annual events include summer Concerts on the Green series,
Shakespeare plays and the annual Newport Beach Art Exhibition. In addition, the
Commission has hosted a variety of special events including various exhibitions
including Mark Hilbert's collection of California Scene Paintings, a Rex Brandt
centennial, and more recently, a centennial exhibition of Joan Irving Brandt's works.
In 2014 and 2015, the Commission coordinated both phases of the Sculpture Exhibition
in Civic Center Park and are anticipating Phase III of this project in the upcoming
months. Each year the Commission also distributes $40,000 in Cultural Arts Grants for
a variety of arts programming produced by others in the community. As a result of these
grants, the Arts Commission has been able to sponsor programming by the Festival
Ballet, Southland Opera, Baroque Music Festival, the Newport Beach Film Festival, and
other cultural arts entities in the City.
Three -Year Plan for Commission
The Arts Commission has drafted a three year funding and staffing plan to create a long-
term self-sufficient arts program in the City. This plan, if approved by City Council, will
provide the necessary support to fund existing programs but also to expand
programming with private funding.
In order to accomplish this goal, the Commission believes that there are a number of
fundamental changes that need to be implemented to create a successful privately -
funded arts program.
Master Plan
The Arts Commission has created a sub -committee to review the Arts Master Plan as
directed by the City Council in April of 2015. It is anticipated this work will be completed
in draft form and presented to the Arts Commission in May 2016 and then to the City
Council for consideration in June or July 2016. The Arts Commission believes this
document is critical to both the future direction of arts in the City but also to successful
private fundraising efforts.
Newport Beach Arts Foundation/Development Manager
Since its inception in 1990, the Newport Beach Arts Foundation, a private non-profit
501(c)(3) organization, has been dedicated to supporting cultural arts activities of the
Newport Beach City Arts Commission in the City of Newport Beach. The Foundation
has been supportive of the Arts in Newport Beach for many years, but has not reached
its potential for fundraising. There are currently 20 members of the Foundation who
have varying levels of activity within the group.

It is recommended that the Newport Beach Arts Foundation grow into a full-fledged
fundraising arm for the City Arts Commission. Using the model created by the Library
Foundation, the Foundation would be augmented with new members who are more
familiar with and adept at non-profit fundraising and development.
As a comparison, the Newport Beach Library Foundation has been in place since
1989. It has about 2,500 members, and is able to raise about $225,000 per year for
Library Services. In addition to supporting the Library, it hosts these programs for the
community: the Witte Lecture Series, Library Live, "It's Your Money" financial
workshops, Making Memories for Children, Books & Bunnies, and Medicine in Our
Backyard. The below chart shows the allocation of funds for the Library Foundation
(from the Foundation's website):

Creation of Public/Private Partnerships is a goal of the City Council. The ability to
leverage tax dollars with private partnerships will allow the City to enhance the arts and
arts programming in the City. The City has three private sources designed to fund arts
programming in the City:
1 - Balboa Performing Arts Theater Foundation
In May of 2015, the Balboa Performing Arts Theater Foundation distributed their
remaining assets to the Newport Beach Arts Foundation of $175,000. In turn, the
Newport Beach Arts Foundation turned these funds over to the City to be specifically
used for performing arts with a preference to the Balboa Village area of town. To date
none of these funds have been spent.
The City Arts Commission would like to use a portion ($85,000) of these one-time funds
in 2016 to stage a performance by the Pacific Symphony in the Civic Green (estimated
to be $60,000) and to present a Chalk Art Festival on the Balboa Peninsula (estimated
at $25,000).
2 - Visit Newport Beach Funds
On January 28, 2014, the City and Visit Newport Beach amended their agreement for
tourism promotion, branding and marketing services to include public benefit funding.
Under the new agreement, VNB contributes $150,000/year to the City for programs or
activities (e.g. public art, cultural and promotional activities, beautification projects, etc.)
that benefit the public, as determined by the City Council.
The City Arts Commission proposes that the $150,000 in VNB funds be allocated for up
to three years (for a total of up to $450,000) to fund the Development Manager position
for the Arts Foundation.
3 - Development Agreement Capital Funds
A Development Agreement ("DA") is a contract between a local jurisdiction and a person
who has ownership or control of property within the jurisdiction. The purpose of the
agreement is to specify the standards and conditions that will govern development of the
property, as well as to describe and possibly fund certain public benefits agreed to by
the parties should the development progress. The development agreement provides
assurance to the developer that he/she may proceed to develop the project subject to
the rules and regulations in effect at the time of the DA's approval.
In March 2013, the City Council adopted Council Policy 1-13 establishing a Public Art
and Cultural Facilities Fund, and a funding source for the acquisition, installation,
management and maintenance of Public Art. The goal of the Policy was to fund art
without adopting or imposing new fees or charges. With the adoption of the policy, the
council authorized the deposit of two percent (2%) of the unallocated public benefit fees

received by the City from development agreements into the Public Arts and Cultural
Facilities Fund. These funds are intended to acquire and maintain permanent art
structures and installations as identified in the Newport Beach Master Arts and Culture
Plan.
The first year of implementation of this program was fiscal year 2014-15. During the
fiscal year, the fund received $433,495. The City Arts Commission and City staff would
make a recommendation to the City Council in compliance with City Council Policy 1-13.
There are time commitments on these funds, per California Government Code
§66001(d), for the fifth fiscal year following the first deposit into the account or fund and
every five years thereafter, the City shall make findings with respect to any portion of the
fee remaining unexpended, whether committed or uncommitted. After reviewing Council
Policy 1-13, the Arts Commission asserts that the use of the Public Art and Cultural
Facilities Fund is an appropriate source to finance Phases III and IV of the Sculpture
Exhibition in Civic Center Park. The Sculpture Exhibition in Civic Center Park can be
identified as a specific and permanent art project that can be supported through the
Public Art and Cultural Facilities Fund.
The Commission proposes appropriating $250,000 from the Public Art and Cultural
Facilities Fund for Phases III ($125,000) and IV ($125,000) respectively. If private
fundraising by the Arts Foundation is successful, the Council may direct that these
private funds may supplant all or portions of the Phase IV amount.
City Support of the Arts
The City has clearly created a desire for a robust Culture and Arts Program in the City.
The City's General Plan, Chapter 9, "Arts and Cultural Element" defines the future goals
of cultural arts in the community. There are three major goals identified in the General
Plan:
1. Active and vital arts, cultural and literary activities and programs that enrich the
community;
2. Adequate physical facilities and venues that support cultural art and literacy
programs; and
3. Establish a broad range of public and private funding sources to support cultural arts
goals and activities.
This framework is further refined by four City Council Policies, 1-9, Art in Public Places
(Attachment A), 1-10 "Financial Support for Culture and Arts" (Attachment B), 1-11
"Acquisition of Art by the City of Newport Beach" (Attachment C), and 1-13 "Public Arts
and Cultural Facilities Fund" (Attachment D).

Status of Arts Manager and Tasks
The City Council authorized the funding of an Arts Manager to assist the City Arts
Commission and City staff with managing programming for the arts. The scope for this
contract position would include the following tasks:
1) Master Plan for the Arts,
2) Administrative and Grant Work,
3) Outreach and Liaison Efforts,
4) City Art Resources and Exhibits.
City staff, along with several Arts Commissioners, reviewed a number of proposals from
vendors. Staff has placed the consideration of any contract on hold until such time as
the funding for the Arts Commission and possible changes to the Foundation can be
completed. It would be anticipated that should City Council approve the changes as
outlined, that this position would be task -specific. For each task, the City would provide
a specific scope of work along with a timeframe for completion. A vendor would provide
the number of hours required and not to exceed cost estimate with measurable
deliverables. This will provide oversight and accountability for the projects to be
completed within the contract.
Funding for this contract or vendor is expected to be in the range of $60,000 per year,
with funding coming from the City's General Fund.
Conclusion and Recommendations
Based on City Council direction, the plan as identified above would include the following
steps and possible funding mechanisms:
1. Complete the Arts Master Plan.
2. Revise the by-laws of the Newport Beach Arts Foundation to more closely reflect the
model of the Newport Beach Library Foundation; develop new members for the
Newport Beach Arts Foundation with an emphasis on members who want to be
involved in fundraising efforts for the arts.
3. Using up to $150,000 per year in funds from Visit Newport Beach, hire a
Development Manager/Fundraiser for the Newport Beach Arts Foundation. The
development professional would be funded for a period not to exceed three years to
kick-start fundraising efforts. The goal of this position is be self- funding at the end
of three years or prior the end of the term.
4. Using up to $250,000 in funds from the Public Art and Cultural Facilities Fund,
finance Phase III of the Sculpture Exhibition in Civic Center Park for fiscal year
2016/17 and Phase IV for fiscal year 2017/18. During this time, it is envisioned that
the Arts Foundation fundraising effort may begin to fund a portion of the Sculpture
Exhibition, with an even greater share for Phases V and beyond, should those
phases be desired by the Commission and City Council.

5. Hire contractors to perform task -specific functions as the Arts Manager until such
time as the Foundation is established and can assist with these tasks.

ART IN PUBLIC PLACES
A. The City of Newport Beach recognizes the importance and desirability of
enhancing and beautifying the public places within the City, by acquiring and
displaying publicly accessible works of art for the cultural benefit of the City, its
citizens and its visitors.
B. The City seeks to involve professional artists in City planning and design
projects; to integrate artworks in City capital improvement projects; and to
commission and/or purchase new artworks for public places.
C. Public art can include but is not limited to permanent and temporary sculpture,
murals, as well as artist -designed fountains, mosaics and tile work, banners, park
benches and other street furniture, water features, bus shelters, streetlights and
lanterns, kiosks, retaining walls, and/or hardscape treatments.
D. The responsibility of the Arts Commission is to:
1. Identify and assess potential Art in Public Places projects and sites;
2. Confer with other Boards and Commissions that may be impacted by the
recommended list of art projects;
3. Make appropriate recommendations to City Council;
4. Participate in the selection of artists for Art in Public Places projects;
5. Plan and oversee the artistic design process;
6 Work with appropriate City Departments to ensure correct installation at
the site and long term maintenance and conservation of the art work.
E. The Arts Commission shall consider the following criteria in making
recommendation for an Art in Public Places project:
1. The aesthetic concept, quality, scale, and form of the work of art, and its
appropriateness for the site;
2. A site that is easily visible and/or accessible to the general public;

3. The experience, skill and ability of the artist to produce the work of art;
4. The proper medium for the work of art, considering durability against
vandalism, theft and weather, and the safety of the viewer;
5. The cost for the City to acquire, install and maintain the work of art;
6. No art objects will be considered that are mass-produced from a standard
design, are reproductions of original art work, and/or are decorative or
functional elements that are designed by an architect as opposed to the
project artist.
7. Temporary art may be acquired and placed through the same procedures
as permanent works.
F. From time to time, the Arts Commission may submit to the City Manager's
Office a list of projects with estimated costs. Said list is to be considered in the
preparation of the next fiscal year budget. Funding for this program shall be
determined by the City Council, and may be derived from the City Art in Public
Places Reserve Fund, Arts Commission events, the Newport Beach Arts
Foundation, private individual, corporate and foundation donations;
government grants, other City funds, and/or voluntary participation by private
developers.
G. In addition, to maintain the artistic integrity of designated Art in Public Places
sites/works, the Arts Commission shall review any future modifications,
relocation, repairs, and/or replacement of parts or works at these sites. The Arts
Commission shall consult with the original artist if possible or a recognized
expert in the field, and shall then make the appropriate recommendation for
modification to the City Council.

FINANCIAL SUPPORT FOR CULTURE AND ARTS
The City Council hereby recognizes the importance of promoting culture and the arts
within the City of Newport Beach. A number of individuals and groups, such as the
Arts Commission and Friends of the Newport Theatre Arts Center, have been
organized with the express purpose of developing and promoting culture, theatre and
the arts.
The City would compliment these efforts by establishing a Reserve Fund for Culture
and Arts that can be used for a) developing a master plan for the promotion of culture
and arts; b) acquiring land and/or the construction of facilities to promote culture and
arts and; c) instituting other cultural promotion projects.
The sum of $55,000 shall be provided each year for specific cultural or artistic planning,
promotion and/or construction projects as approved by the City Council. It is the
policy of the City of Newport Beach that expenditures from the reserve fund should be
matched equally by the community in the form of contributions and donations.
In regard to the City's roll in financially sponsoring art and cultural events, the City
Arts Commission shall review all programs and requests for support from arts groups.
The Commission shall forward its recommendations for funding to the City Council for
final approval. Any appropriation shall not exceed 50% of the Arts Commissions'
annual budget. For the purpose of this policy, arts groups shall be defined as those
involved in visual, musical, theatre, dance, crafts, performing and literary activities.
The following priorities shall be considered by the Commission. The order of
preference for granting support shall be as follows:
A. Local arts groups located within the City and offering programs to City
residents;
B. Regional arts groups located in Orange County and offering programs to City
residents; and
C. Arts groups located in California and performing or offering programs to City
residents.

ACQUISITION OF ART BY THE CITY OF NEWPORT BEACH
A. The City of Newport Beach ("City") believes that paintings, sculptures, drawings
and other art (collectively, "Art") placed on City property and in City buildings
increases the aesthetic appeal and beauty of such property and buildings, and of
the City in general.
B. All proposals to donate, exhibit, loan, sell or commission Art to the City
(collectively, "Convey(s)," "Conveyed," "Conveying" or "Conveyance") shall be
reviewed by the Arts Commission for recommendation to the City Council.
C. The Arts Commission shall be responsible to:
1. Confer with persons who have offered to Convey Art to the City,
informing them of this policy, including criteria for approving Art and the
policies, criteria and approval process.
2. Advise the City Council of the artistic merit and value of Art offered to the
City.
3. Advise the City Council regarding appropriate City property or City
buildings for display of Art, in conjunction with the City commission,
committee, board and/or department which has responsibility for
planning or maintaining the proposed location.
D. The Arts Commission shall consider the following criteria in making a
recommendation for accepting an offer to Convey Art to the City:
1. The Art should be an original creation or a limited edition by the original
artist, and be of the highest quality and level of artistic excellence.
2. The Art should add to the balanced inventory of the City's collection,
representing a variety of style, design and media.
3. The person(s) seeking to Convey Art to the City shall complete all
required forms, as provided by the Library Services Department.
4. The Art should be of satisfactory physical condition, be sufficiently
durable as to not be easily damaged or destroyed, should not require
restoration or extensive long term conservation, and should be of a
physical size and weight that the Art can be managed in storage, transport
and public display without difficulty. Art requiring restoration may only

be considered with full disclosure of the restoration costs provided by a
licensed art appraiser.
5. The Art should be consistent with and relevant to the civic interests and
broad variety of tastes within the Newport Beach community.
E. Art may only be recommended by the Arts Commission to the City Council for
acceptance upon the majority vote of the Arts Commission.
F. Art accepted into the City collection by the City Council is accepted with the
understanding that the City Council reserves the right to place the Art on public
display on either a permanent or temporary basis, and to store the Art when not
on display. Acceptance of Art by the City Council does not guarantee that the
Art will be displayed in perpetuity. The City Council may sell, donate or
otherwise remove any Art in the City collection. Any proceeds received by the
City from the transfer of Art shall be expended to acquire, restore or display Art.
G. Art considered for inclusion in the City's collection must conform to City Council
Policy I-9 (Art in Public Places).
H. The City does not provide valuations or appraisals of Art Conveyed to the City.
The value of Art should be presented by the person(s) Conveying Art to the City
at the time of Conveyance. It is the responsibility of the person(s) Conveying Art
to the City to furnish a valuation to the appropriate government tax agency.
I. The person(s) Conveying Art to the City shall obtain all intellectual and
photographic property rights to the Art and transfer such rights to the City. The
City reserves the right to photograph Art for any and all purposes, including, but
not limited to, publicity and informational literature.
J. Any person(s) that Conveys Art to the City shall represent and warrant in writing
that it owns the Art and that the Art shall be Conveyed to the City free and clear of
all liens, restrictions, security interests or agreements by which the City would be
bound, but subject to all laws generally applicable to the transfer of title of any
work of Art.
K. Subject to compliance with California Civil Code Section 987, the City shall assume
no liability in the event of loss or damage to any Art accepted into the City's
collection.

PUBLIC ARTS AND CULTURAL FACILITIES FUND
A. Purpose: The City of Newport Beach recognizes the importance and desirability
of a city-wide public art and cultural facilities program that includes a funding
source for the acquisition and maintenance of permanent art structures and
installations in public places throughout the City including support of capital
construction programs and cultural facilities (collectively referred to herein as
"Public Art").
B. Intent: The City Council desires to establish a funding source for the acquisition,
installation, management and maintenance of Public Art without adopting or
imposing new fees or charges. The City Council therefore hereby establishes the
Public Arts and Cultural Facilities Fund and by approval of this policy expresses
its intent that Public Art in the City be funded by appropriations and deposits
into the Public Art and Cultural Facilities Fund.
C. Public Art and Cultural Facilities Fund: The Public Art and Cultural Facilities
Fund is the identified funding source for Public Art. With the adoption of this
policy, City Council establishes its intent to deposit into the Public Art and
Cultural Facilities Fund an amount equal to 2% of the unallocated public benefit
fees received by the City after the date of adoption of this policy pursuant to
Development Agreements approved by the City. The allocation of Development
Agreement revenues shall be confirmed by the City Council concurrent with its
approval of the City's annual budget for the fiscal year in which public benefit
fees are anticipated to be received.
To provide for a future stream of funding, the City Council also desires that a
contribution to the Public Art and Cultural Facilities Fund be included as a
component of any public benefit fees negotiated pursuant to Chapter 15.45 of the
City's Municipal Code (Developer Agreements) and approved by City Council
subsequent to the date of adoption of this policy, as the same may be amended
from time to time.
In addition, all monies earmarked for deposit into the Public Art and Cultural
Facilities Fund including, but not limited to, monies received by the City from
private individuals, corporate and foundation donations, government grants and

special appropriations shall be deposited into the Public Art and Cultural
Facilities Fund.
D. Administration of the Public Art and Cultural Facilities Fund: The Public Art
and Cultural Facilities Fund shall be maintained separate from all other City
funds. Funds may be withdrawn from the Public Art and Cultural Facilities
Fund following the receipt of Development Agreement revenue and deposit into
the Public Art and Cultural Facilities Fund. The City Council shall review and
approve all expenditures of the Public Art and Cultural Facilities Fund. Prior to
approving an expenditure on a work of Public Art, the City Council shall obtain
a recommendation from the City's Arts Commission and City staff as to the
proposed Public Art's consistency with this policy. In addition, from time to
time, City staff and the Arts Commission may:
1. Identify and assess potential Public Art projects and locations;
2. Recommend to the City Council funding for the capital construction,
expansion or enhancement of permanent arts and cultural facilities,
museums, historical sites, theaters or performance spaces;
3. Confer with other Boards and Commissions that may be impacted by the
recommended list of Public Art projects;
4. Make appropriate recommendations to City Council;
5. Participate in the selection of artists for Public Art;
6. Plan and oversee the artistic design process; and
7. Work with appropriate City Departments to ensure correct installation
and long-term maintenance and conservation of the Public Art.
E. Other Considerations: The following criteria shall be considered prior to
approval of a Public Art project or authorization of an expenditure of the Public
Art and Cultural Facilities Fund:
1. The aesthetic concept, quality, scale, and form of the work of art, and its
appropriateness for the site;
2. A site that is easily visible and/or accessible to the general public;
3. The experience, skill and ability of the artist to produce the work of art;
4. The proper medium for the work of art, considering durability against
vandalism, theft and weather, and the safety of the viewer;

5. The cost for the City to acquire, install, insure and maintain the work of
art;
6. The degree to which the facility will provide cultural enrichment,
historical understanding, educational value, or facilitate performance art;
7. The value of the proposed facility in the economic, cultural or
neighborhood revitalization of the City and the particular neighborhood
of the proposed facility; and
8. The value of the improvement in enhancing Newport Beach as an arts
and/or cultural destination.
