TITLE: Adoption of 2015 Urban Water Management Plan
ABSTRACT:
The Urban Water Management Plan (UWMP) is prepared every five years by California
urban water suppliers to support long-term resource planning and ensure adequate
water supplies are available to meet existing and future water demands. A public
hearing was held on June 14, 2016 to collect comments from public review, per
California Department of Water Resources requirements. During the public hearing, a
comment by the public was made to include an executive summary. This summary has
been added at the beginning of the plan.
RECOMMENDATION:
a) Determine that the action is exempt from the California Environmental Quality Act
(CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines
because it will not result in a physical change to the environment, directly or
indirectly;
b) Adopt Resolution No. 2016-83, A Resolution of the City Council of the City of
Newport Beach, California, Adopting the 2015 Urban Water Management Plan; and
c) Direct staff to fulfill the notification requirements set forth by the Water Code if the
UWMP is adopted.
FUNDING REQUIREMENTS:
There are no funding requirements associated with this action.

DISCUSSION:
Every five years, California urban water suppliers must support long-term resource
planning and ensure adequate water supplies are available to meet existing and future
water demands. The City's 2015 UWMP contains components required by the State
Department of Water Resources. Staff developed realistic projections that make the
plan unique and a reliable source for forecasting. This year's plan includes topics on:
Water service area, facilities, sources and supplies
Water use by customer type
Distribution system water losses
Demand management measures
Water supply reliability
Planned water supply projections and programs
And recycled water use
The City, along with 23 other local agencies, participated in a cooperative agreement
with the Municipal Water District of Orange County to select a consultant to update and
develop UWMPs for each specific agency. This effort helps minimize costs by sharing
resources with agencies that have similar hydrology's and water sources. Through a
competitive RFP process the consulting firm Arcadis was selected.
Staff introduced the City's draft 2015 UWMP at the May 24, 2016 City Council meeting
and posted the plan on the City's web site for public review. A public hearing was held
on June 14, 2016 to collect comments from City Council and the public. Public
comments included inserting an executive summary in the plan. The summary has been
added at the beginning of the plan.
The Municipal Operations Department requests that Council adopt Resolution
No. 2016-83, adopting the 2015 Urban Water Management and direct staff to complete
the notification requirements. Once adopted, the California Department of Water
Resources requires the plan to be submitted to them no later than 30 days after
adoption. The plan will then be submitted to the California Library, and the County of
Orange.
The final plan will continue to be available on the City's web site at
www.newportbeachca.gov/government/departments/municipal-operations.

Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378)of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

RESOLUTION NO. 2016-83
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, ADOPTING THE
2015 URBAN WATER MANAGEMENT PLAN
WHEREAS, the California Legislature enacted Assembly Bill 797 (Water Code
Section 10610 et seq., known as the Urban Water Management Planning Act) during
the 1983-84 Regular Session and subsequent amendments mandate every supplier
providing water for municipal purposes to more than 3,000 customers or supplying more
than 3,000 acre-feet of water annually, to prepare an Urban Water Management Plan,
the primary objective of which is to plan for the conservation and efficient use of water;
and
WHEREAS, the water code requires agencies to prepare, adopt and file an
Urban Water Management Plan every five years in the years ending 0 and 5; and
WHEREAS, the 2015 Urban Water Management Plan is due to Department of
Water Resources by July 1, 2016; and
WHEREAS, the Urban Water Management Plan must be adopted after a public
review and hearing and filed with the California Department of Water Resources within
thirty days of adoption; and
WHEREAS, the Plan was introduced for public review on May 24, 2016; and
WHEREAS, a public hearing was held on June 14, 2016; and
WHEREAS, the City Council adopted the Urban Water Management Plan on
June 28, 2016 and directed staff to file said Plan with the California Department of
Water Resources and submit the Plan to the California State Library and County of
Orange by July 28, 2016; and
NOW THEREFORE, the City Council of the City of Newport Beach hereby
resolves as follows:
Section 1: The recitals provided above are true and correct and are
incorporated into the operative part of this resolution.

Section 2: The City Council does hereby adopt and order filed the 2015 Urban
Water Management Plan with the City Clerk. The Municipal Operations Department
Director is hereby authorized and directed to file the 2015 Urban Water Management
Plan with the California Department of Water Resource within 30 days of this date and
before July 28, 2016.
Section 3: If any section, subsection, sentence, clause or phrase of this
resolution is, for any reason, held to be invalid or unconstitutional, such decision shall
not affect the validity or constitutionality of the remaining portions of this resolution. The
City Council hereby declares that it would have passed this resolution, and each
section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any
one or more sections, subsections, sentences, clauses or phrases be declared invalid
or unconstitutional.
Section 4: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in
the environment) and 15060(c)(3) (the activity is not a project as defined in Section
15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3,
because it has no potential for resulting in physical change to the environment, directly
or indirectly.
Section 6: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting the resolution.
