TITLE: Approve Amendment No. One to the Utilities On -Call Maintenance/
Repair Services Agreement with T.E. Roberts, Inc.
ABSTRACT:
In May 2015, the City Council approved a utilities on-call maintenance/repair services
agreement with T.E. Roberts, Inc. Since that time, staff has utilized T.E. Roberts to
complete a variety of maintenance and repair items to the City's water, wastewater and
storm drain system. Specifically, the City's large Capital Improvement Program has
necessitated a great deal of utility work in preparation for or in conjunction with capital
projects. The agreement limits have been reached and staff is requesting that the
agreement be amended by $200,000 for the remaining two year period.
RECOMMENDATION:
a) Determine that the action is exempt from the California Environmental Quality Act
(CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines
because it will not result in a physical change to the environment, directly or
indirectly; and
b) Approve Amendment No. One with T.E. Roberts, Inc. for utility on-call maintenance/
repair services increasing the compensation limits by $200,000 for the remaining two
year period of the agreement, and authorize the Mayor and City Clerk to execute the
amendment.
FUNDING REQUIREMENTS:
There are adequate funds in the Municipal Operations and Public Works Department
budgets to fund these services this fiscal year, and funds for these services will continue
to be budgeted in subsequent fiscal years.

DISCUSSION:
In May 2015, the City Council approved a utility on-call maintenance/repair services
agreement with T.E. Roberts, Inc. The work performed under this agreement includes
the installation, maintenance and repair of water, wastewater, and storm system
components. The Water and Storm System Divisions of the Municipal Operations
Department, as well as the Public Works Department, have utilized the services of T.E.
Roberts since the inception date.
Over the last year, the services of T.E. Roberts have been utilized for many repair and
maintenance items throughout the City. A significant portion of the agreement was
utilized for an emergency repair of the City's main water well line. The remaining
portion of the agreement was utilized by Public Works for work associated with its large
Capital Improvement Program. This included relocation work associated with the
Orange County Sanitation District Project, potholing and utility relocation work prior to
roadway projects and cast iron pipe fire hydrant repairs prior to the upcoming Cameo
Shores neighborhood pavement reconstruction project.
The original T.E. Roberts agreement contained a limit of $300,000 over a three year
term. Amendment One requests to increase the limit by $200,000 over the remaining
two years of the agreement. Municipal Operations and Public Works are not requesting
additional budget funding. Rather, this action is solely to amend the agreement to
authorize additional work for future as -needed utility on-call maintenance/repair
services.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
