TITLE: Resolution Supporting Submission of Grant Applications under the
Orange County Transportation Authority (OCTA) Measure M2
Environmental Cleanup Grant Program
ABSTRACT:
Staff plans on submitting several applications to obtain funding to construct trash collecting
devices. The applications require City Council adopt a resolution endorsing the grant
applications.
RECOMMENDATION:
Adopt Resolution No. 2012- 27 authorizing and supporting submission of grant applications
for OCTA Measure M2 Environmental Cleanup Tier 1 and Tier 2, grant programs.
FUNDING REQUIREMENTS:
The Tier 1 grant applications will request approximately $500,000. Should the City be
successful and awarded the full amount, the City's minimum match requirement will be 25%
or approximately $125,000. The match will be met through in -lieu contributions, e.g. staff
inspection and maintenance; no direct funding from the General Fund is anticipated.
The Tier 2 grant application will request approximately $150,000. Should the City be
successful and awarded the full amount, the City's minimum match requirement will be 50%
or approximately $75,000. The match will be met through in -lieu contributions, e.g. staff
inspection and maintenance and the General Fund. The General Fund dollar amount is
estimated at $37,500 and would be appropriated with the adoption of a future Capital
Improvement Program budget or at the time of a contract award to perform the work.
DISCUSSION:
OCTA has established and is administrating an environmental cleanup grant funding
program to address water quality degradation associated with transportation - generated

pollution as a component of Measure M2. Measure M2 is a half -cent sales tax for
transportation improvements approved by Orange County voters in 2006.
For the Tier 1 grant program, a total of $19.5 million is projected to be available over a
seven -year period that began in FY11/12. Approximately $2.8 million is available to be
awarded with this grant "Call for Projects ". Staff plans to submit several applications under
this Call for Projects that will be used to install trash collecting devices. Two types of
systems will be installed. The first type, (CDS) units will capture and remove trash and
debris from the stormdrain system. The second type, trash skimmers will capture and
remove trash and debris from the bay (see attached photo).
For the Tier 2 grant program, a total of $38.5 million is projected to be available over a
seven -year period beginning in FY 12/13. Approximately $13.3 million is available to be
awarded with this grant "Call for Projects ". Staff plans to submit one application under this
Call for Projects that will be used to install a larger -scale CDS unit for the Carnation
stormdrain system (see attached map).
As required by the grant application, an adopted resolution must be submitted with the
applications stating that the 1) City Council has reviewed and supports the applications, 2)
City is capable of providing the required match funding and /or in -kind contributions, and 3)
City agrees to work with OCTA to meet established deadlines.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment) and
15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential
for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the
meeting at which the City Council considers the item).

RESOLUTION NO. 2012-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH AUTHORIZING AND SUPPORTING THE SUBMISSION OF A
GRANT PROPOSAL FOR FUNDING UNDER THE ORANGE COUNTY
TRANSPORTATION AUTHORITY (OCTA) ENVIRONMENTAL
CLEANUP, TIER 1 AND TIER 2 GRANT PROGRAM.
WHEREAS, the Orange County Local Transportation Ordinance No. 3, dated
July 24, 2006, known and cited as the Renewed Measure M Transportation Ordinance
and Investment Plan has announced funding available through the Environmental
Cleanup Program to help protect Orange County beaches and waterways from
transportation generated pollution (urban runoff) and improve overall water quality; and
WHEREAS, the Environmental Cleanup, Tier 1 Grant Program consists of
funding to purchase and install catch basin Best Management Practices (BMPs), such
as screens, filters, inserts, trash collection devices and other "street- scale" low flow
diversion projects;
WHEREAS, the Environmental Cleanup, Tier 2 Grant Program consists of
funding to purchase and install large scale Best Management Practices (BMPs), such
as trash collection devices, constructive wetlands, infiltration basins and low flow
diversion projects; and
WHEREAS, the Orange County Transportation Authority has established the
procedures and criteria for reviewing proposals; and
WHEREAS, the City of Newport Beach has developed a targeted program to
reduce transportation generated pollution and improve water quality;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH DOES RESOLVE AS FOLLOWS:
Section 1. The City Council has reviewed and supports the proposal, and
hereby authorizes the City Manager or his designee to submit the proposal.
Section 2. The City of Newport Beach is capable of providing the amount of
funding and /or in -kind contributions, specified in the funding plan and agrees to provide
necessary funding and /or in -kind contributions if awarded a grant.
Section 3. If awarded a grant, the City of Newport Beach agrees to work with
OCTA to meet established deadlines.
Section 4. This resolution shall become effective immediately upon its passage
and adoption.
I HEREBY CERTIFY that the foregoing resolution was duly and regularly
adopted at a Regular Meeting of the City Council of the City of Newport Beach on this
