RECOMMENDATION: 1. Conduct a public hearing; 2. Find that Hoag Memorial Hospital Presbyterian has demonstrated good faith compliance with the Development Agreement; and 3. Receive and file the Annual Status Report of Development Agreement for Hoag Memorial Hospital Presbyterian (Attachment No. CC 1). FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DEVELOPMENT AGREEMENT: Development Agreement No. 5 (DA) was executed in 1994 and it relates to the long term development and expansion of Hoag Hospital (Hoag). In May of 2008, the DA was amended to allow the hospital to increase the intensity of future development on the upper campus commensurate with a reduction in intensity of future development of the lower campus. The term of the agreement is twenty -five (25) years and it expires in 2019. 1 M Development Agreement Annual Review — 2012 April 24, 2012 Page 2 In prior years, the City Council has determined Hoag in good faith compliance with the DA with the only unresolved issue being the requirement to relocate and enclose equipment within the main loading dock. Equipment was partially shielded and not relocated and full compliance was postponed to a point when Hoag builds additional floor area on the upper campus or significantly changes the loading dock. On March 13, 2012, Hoag submitted a compliance report that includes a comprehensive noise compliance report, information regarding cogeneration plant plume reduction, and photographs indicating the installation of additional landscaping, as required. Based upon the RS Acoustics report, Hoag presently operates within applicable noise standards. However, from time to time, contractors have produced noise outside of approved operating hours (i.e. started work too early). When early construction activities occurred, Hoag immediately took steps to address the situation and further complaints have not been received. Hoag continues to operate the cogeneration facility in concert with the weather station to reduce the water vapor plume from the cooling towers between 7:00 a.m. and 7:00 p.m. from November 18t to April 30th of each year. 3 4 Development Agreement Annual Review — 2012 April 24, 2012 Page 3 Staff received one call regarding the West Road sound wall expressing the opinion that it was not completed. The sound wall was completed 2010, consistent with the recommended materials, height and location standards proscribed by the mitigation measure. It is important to note that residential units on the second and third floor of the 260 Cagney building in Villa Balboa were not shielded by the sound wall. Those units received upgraded windows and doors to mitigate noise which have been installed. The RS Acoustics compliance report shows that these mitigation measures have been effective in reducing noise such that Hoag is in compliance with applicable standards. Hoag has not initiated any significant new construction activity during this time frame but has been pursuing improvements throughout the campus. Of note, Hoag is currently undertaking both interior and exterior improvements to Hoag's original hospital building located at South Hoag Drive (Upper Campus Heart and Vascular Institute project). Hoag's future implementation of unconstructed entitlement will be subject to review and compliance with the provisions of the Development Agreement, Planned Community development standards and all mitigation measures. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act ( "CEQA ") pursuant to Section 15321 of the Guidelines for Implementation of the California Environmental Quality Act. This section exempts actions by regulatory agencies to enforce or revoke a lease, permit, license, certificate, or other entitlement for use issued, adopted, or prescribed by the regulatory agency or enforcement of a law, general rule, standard, or objective, administered or adopted by the regulatory agency. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). As you are aware, this Development Agreement was adopted by the City Council on April 22, 2008 by Ordinance No.2008 -10 and is known as the Amendment to Restated Development Agreement No. S. Per Section 5.2 of the Development Agreement, "The Annual Review shall be conducted at a public hearing noticed in accordance with the provisions of Chapter 15.45 of the Newport Beach Municipal Code. Annual reviews should be scheduled in April of each year." It is our Understanding based on discussions with city staff, that we will be scheduled for the April 10th, 2012 City Council hearing per the above rioted requirement. Project Status Report March 28, 20ai'I'hru March t, 2 012 Fourth Annual Review of the .Development Agreement Between the City of Newport Reach And Hoag Memorial Hospital Presbyterian Introduction & Overview On April 22, 2oo8, the City of Newport Beach ( "City ") approved an amended Development Agreement between the city of Newport Beach and Hoag Memorial Hospital Presbyterian ( "Hoag ") which is known as the "Amendment to the Restated Development Agreement No. 5 ". This Amended Development Agreement was adopted by Ordinance No. 2oo8 -10 on May 13, 2008. Per Section 5.2 of the Amended Development Agreement: "The Annual Review shall be conducted at a public hearing noticed in accordance with the provisions of Chapter 15.4.5 of the Newport Beach Municipal Code. Annual Reviews should be scheduled in April of each year." This Amended Development Agreement was part of Hoag's Master Plan Update which included revised Development Agreement provisions, a revised Planned Community Text ( "PC T'exC) and associated standards, and certification of the Supplemental Environmental Impact Report ( "SEIR ") with mitigation measures. The Supplemental Environmental Impact Report (SCH No. 1991071003) was certified by adoption of City Council Resolution No. 2008 -27. As part of the SEIR adoption, a Mitigation Monitoring & Reporting Program was required which shall be utilized as the basis for the Development: Agreement Updates as it relates to mitigation measures. 12 For the purposes of this Development: Agreement update, and those subsequent annual updates, this update shall serve as the Fourth Annual Review for the Amendment to the Restated Development Agreement No 5. Project Stattis for the Fourth Development Agreement Annual Review As will be described in detail below, over the last year, Hoag has made a diligent, good faith effort to complete as many of the mitigation measures and associated requirements for both the Development Agreement & Planned Community Text as required in this timeframe. Development Agreement Specific Terms Liz Obligations In the separate terms of the Development Agreement requirements (not found in either Mitigation Measures or PC Requirements), the following have been completed: i1. Section 5.4 "5.4 Mitigation Review - The annual review shall include a detailed report of compliance with the various conditions and mitigation measures contained with the mitigation monitoring plan. The report shall also include a noise regulation compliance assessment that includes noise measurements prepared by a qualified noise consultant on a yearly basis. The noise assessment shall identity noise regulation compliance issues and recommended measures to abate any noncompliance. The report shall include an analysis of the view impacts of buildings constructed in comparison to the anticipated views depicted in the EIR. Hoag shall be found in compliance with this Agreement unless the City Council determines, based upon evidence presented at the Annual Review, that Hoag has riot complied withall mitigation measures and conditions including those imposed as a result of subsequent: environmental analysis, applicable to the grading of, or building on, the Property as of the elate of the Annual Review. Hoag shall pay the City administrative costs incurred in conducting Annual Reviews. Hoag shall reimburse the City for costs incurred by the City associated with Fluor Enterprises' review of the cogeneration plant during the 2oo8 Annual Review." 2 13 Hoag has complied with this section of the Amended Development Agreement with the submittal of this detailed report which demonstrates good faith compliance with the various conditions and mitigation measures contained within the mitigation monitoring plan, as noted below. Additionally, Hoag has complied with noise regulation compliance assessment, A noise analysis was performed by RS Acoustics on February 17, 2012 which demonstrates complete compliance with the noise standards in all locations. (A.ttachnlent 1) No view analysis was necessary in this annual Development Agreement review, as only interior remodels have occurred and no new additions have occurred on the Iloag campus during this timeframe. Construction activities related to the Emergency Department expansion at the Upper Campus from 30 existing treatment rooms to 59 new treatment rooms is ongoing and targeted for final completion by September 2012. Currently the project has 38 completed new rooms that are licensed and in full utilization. A new separate patient drop canopy and walk -in entrance as well as expanded Radiology imaging services was completed in the spring of 2011. 15. New Section 8.4 — Sunset View Park Irnprovenient,s "8,zl. IIoag shall reimburse the City up to $i5o,000 for installation of groundcover, shrubs; and irrigation systems with the unimproved portion of Sunset View Park and Superior Avenue, approximately 2o,5oo sq ft in area, located northerly of the cogeneration building, Reimbursement to the City shall he within 3o clays of IIoag receiving an invoice from the City." The City has not moved forward with this project during this time period, and therefore has not requested a reimbursement for park improvements from IIoag. 3 M 3A New Section 8.;5 — Cogeineration Plant Ene Curtailment "8.5 Hoag shall install a weather station capable of identifying ambient conditions necessary in documenting cogeneration plant and cooling tower operations. The weather station shall be tied into the cogeneration plant controls in order to maximize automatic responses to prevailing weather conditions, assisting in managing the operation changes and load shifting, as well as to provide periodic reports on plant operations. Hoag shall not construct or erect additional cooling towers within the IIoag Lower Campus. Hoag shall reduce the effective heat rejection by 33% at the existing cooling towers and such reduction shall be measured from a baseline (to be measured at the cooling towers) of operating three existing generators and absorption chiller at i00% of design capacity. This reduced capacity operation shall be implemented daily between November -1st and April 301h, between the hours of 7:0o AM and 7: 00 PM when the relative humidity is equal to or less than 55 degrees Fahrenheit." Hoag has complied with all requirements regarding the Cogeneration Plant Energy Curtailment and has attached a letter from Hoag's chief engineer of record, Michael Trzepacz, P.E. which certifies the plant has been operated in accordance with the curtailment requirements. Monthly Cogeneration Plant Reports for the months of October 1, 201-1 thru February 29, 2012 are attached for your review. (Attaclinient 2) Mitigation Measures mid PC Text Requirements In that no new major construction or additions has occurred over the last ,year, Hoag's focus has been to fulfill the requirements that were oriented to noise and aesthetics and that were required to be completed or are in progress in this Development Agreement annual review time period. For your reference, the relevant mitigation measures and PC Text requirements are attached in the order they are addressed below. 4 15 Mitigation Measure 3.4-9 Cogeneration Plant Noise As noted above, Hoag has complied with all noise standards and an annual noise analysis was performed by RS Acoustics on February 17, 2012, which concludes that (page 1.7) the Cogeneration Plant's operations comply with the noise standards. (Attachment x) Noise — WeSL.Noag Drive Mitigation Measure: 1[ D F 3.4 -1 —'Villa Balboa Window Installation In August, 201o, IIoag fulfilled its obligation tinder this mitigation measure by depositing a check in the amount of $499,142.00, into an escrow account at a financial institution established by the Villa Balboa Community Association. These funds were used to pay for construction of the windows /sliding glass door upgrades for the eligible Villa Balboa condominiums. The installation of the windows /sliding glass doors has been completed and folly paid £or. This mitigation measure has been satisfied. Mitigation Measure: PDB 3.4-2 — Sou11d Wall Construction of the 471 linear foot sound wall which commenced in October, 2009 is now complete. On January 19, 2oio, the sound wall received final Certificate of Occupancy permits from the City of Newport Beach. All data on the sound wall was included in the 2011 DA Update. Mitigation Measure 3.4-5 - Ioadin�a Lion c Pal-lcis "Sound absorption panels on the east wall of the loading dock shall be installed. Approximately 4.50 square feet of absorptive panels shall be used to cover major portions of the back wall of the loading clock area. The Noise -Foil panels by Industrial Acoustics or a panel with equivalent or better sound rating shall be used." 5 10 Noise roil Sound Panels of approximately 65o square feet have been permitted and dilly installecl. This mitigation measure has been fully complied with and required data was included in the 2011 DA Update. Mitigatioat Measure 3.4 -6 — Relocation of the Trzish Corn amp ctor "The trash compactor shalt be relocated within the loading dock. The trash compactor and baler shall be enclosed in a three -side structure, The walls shall be concrete block or similar masonry construction. The roof shall be lightweight concrete roof or a plywood surface with concrete tiles; a built -up roof with 5'5" of insulation on the inside would be an acceptable alternative. The open side shall face away from residents. Doors may be on the side of the enclosure facing the residents, but must be closed when the baler or compactor are operating. The compactor and baler should only be operated between the hours of 7:oo AM and 7:00 PM." The trash compactor /sanitizer has been enclosed on the Borth and south sides with an exterior metal panel system. The interior of the walls have been lined with Noise roil Panels as recommended by the acoustical engineer. The roof was constructed of metal decking with a waterproof membrane and was constructed similar to the north and south walls and has a bellow material that wraps around the trash enclosure to allow for movement. The west wall of the compactor /sanitizer will be open for access. The west wall of the loading dock was lined from north to south with Noise Foil Panels as recommended by the acoustical engineer. The baler was constructed with three walls on the east, west and south sides. The north side will remain open for access. The roof of the baler enclosure was constructed with the same materials as the compactor /sanitizer roof structure as noted above, The compactor and baler are operated between the hours of 7:oo AM and 7:00 PM. While Hoag is unable to folly relocate the trash compactor, per the Development Agreement Update City Council staff report dated September 1i1, 2o1o, staff notes: "Hoag has committed to relocate the trash compactor and provide a full enclosure as part of Hoar; Hospital's construction of a new structure or structures on the Upper Campus requiring the transfer of 17 buildable square footage from the Lower Campus or reconfiguration of the loading clock. In staff's opinion, this is a good faith partial and substantial compliance with the Mitigation Measure 3.4 -6 for an interim period until such time when the trash compactor will be relocated and full compliance will be achieved as part of Hoag Hospital's construction of a new structure or structures on the Upper Campus requiring the transfer of buildable square footage from the Lower Campus or reconfiguration of the loading dock." Therefore, Hoag is good faith partial and substantial compliance with this mitigation measure by constructing a trash compactor enclosure and a baler enclosure which include the use of sound absorption panels on both enclosures. Additionally, in the last year, no new structure or structures on the Upper Campus were constructed requiring the transfer of buildable square footage from the Lower Campus. Planned Community .requirements — Landscaping Lower Campus (Exhibit #6) Ai-ea 7a — West Parldn, . Area Islands Requirement: 6o days after CDP issuance at Coastal Commission. Hoag received Coastal Commission's "Approval in Concept" of this item on April 8"', 2009 and final permits were received on December 15, 2oo9. Hoag obtained the required building permits for this project on January 19, 2010. Parking Lot Islands were complete by May, 2010. With regards to the trees located within the parking Iot islands, Hoag has engaged a landscape architect and a landscape construction and maintenance company to review the status of the growth of the trees in the parking lot islands. The trees in the parking lot islands are of a different species than the other trees growing on the perimeter of the parking lot. The trees planted on the fringes of the parking lot will not grow in the confined space of the parking lot islands. The trees planted in the parking lot islands are canopy trees but needed to be included in a program of deep watering of the trees until such time as the corrected moisture content took 7 WN place. These parking lot island trees have been put on a fertilization and spraying program and have started to show marked improvement. The irrigation, fertilizing, trimming and spraying of the parking lot island trees continues under a program to monitor the health and growth of the trees. The trees should mature with the appropriate canopy branches and foliage in approximately one year. Hoag has proceeded in good faith and continues to improve the on -going maintenance of the Parking Lot Islands. (Attachment 3) Area g — North Slope above Retaining Wall Requirement: 12o days after CDP Issued by Coastal Commission. Hoag received Coastal Commission's "Approval in Concept" of this item on April 8t", 2oo9 and final permits were issued by the City of Newport Beach on January 19, 2010. The Slope construction was completed by July, 2010. Hoag has proceeded in good faith and is in full compliance with the completion of construction as noted above. 2012 Update: To demonstrate the on -going maintenance of this area, we have attached photos taken this year. (Attachment 3) Area 12 PCF1 Green Scx °een Requirement: Immediately upon issuance of an Approval in Concept by the City an application shall be submitted for said improvements to the Coastal Commission, Construction of said improvements sliall be completed no later than 18 months after Coastal Development Permit Issuance by the Coastal Commission. Hoag received Coastal Commission's "Approval in Concept" of this item on April 8th, 2oo9 and final permits were issued by the City of Newport Beach on January 19, 2010. Hoag has proceeded in good faith and is in Pull compliance with the completion of the PCH Green Screen construction as required. 1J° 2012 Update: To demonstrate the on -going maintenance and growth of this area, we have attached photos taken this year of the area. (Attachment 3) Cogeneration Plant Hoag has engaged a landscape architect and a landscape construction and maintenance company to review the status of the growth of the vines on the CoGen trellis. It has become apparent that an existing Melaleuca tree has shaded some of the vines growing on the screen. It has therefore been trimmed to allow more light to pass through. Three 15- gallon vines have been planted to promote quicker coverage of the upper portion of the CoGen screen and two large pots of two vines each have been plated to help cover the lower part of the screen where no vines were growing. The new vine planting includes a program to fertilize, irrigate and monitor growth. A marked improvement in the growth and coverage of the vines should be seen, but it could take up to two years for the vines to reach full maturity and provide optimal coverage. Photos have been attached of the current conditions of the CoGen screen. Table I below summarizes the test locations, relative time of the tests, and the lest results. The final column presents the governing ordinance which must be satisfied. The hospital campus is separated into two distinct planning sections described as the "Upper Campus" to the north, and the "Lower Campus" to the south. The Upper Campus section is bordered by Hospital Road to the north, West Hoag Drive to the west, Newport Boulevard (55) to the east, and a hospital nwlti -level parking structure extends south to the Newport Blvd. olf -ramp connecting Newport Blvd. to Pacific Coast Highway, The Lower Campus section is bordered to the north by Sunset View Park and Villa Balboa townhornes, Superior Avenue to the west, Newport Blvd. to the east, and the southern boundary is bounded by Pacific Coast Highway (Highway 1). T AllaT13ICS In general, community noise measurements or assessments refer to descriptions of the exterior noise environment in life vicinity of inhabited areas. Descriptions of noise usually include the time and spatial variations in the outdoor noise environment throughout a specific area so that descripflons are relevant to the effect on people within the specified area. 'they generally vary with time of day, being relatively quiet at night when activities are minimal and noisier in morning and afternoons during peak traffic periods. Noise or unwanted sound is complex and may be comprised of a broad range of sounds often including low and high frequency components, which may also occur at differing decibel levels. To help simplify and quantify the human judgment of relative loudness and provide a simple single - number rating system, the A- weighting network was developed. A- woighted sawed level "db(A)" is one of the most widely used methods of stating community noise design goals and regulations in [arms of a single number rating system. A- welghled sound levels are obtained with a sound level meter incorporating an electronic weighting network that de- emphasizes the low frequency portions of the noise spectrum, to automatically compensate for the lower sensitivity of the human ear to low frequency sounds. High frequency components of sound, 10001 -Iz and above are relatively unchanged in A- weighting as the human ear is fairly equally sensitive to all sounds occurring in this range. The single A- weighted number is the sun of all A- weighted sound energy within a given range incorporating the 321 -Iz to 8000FIz octave bands. The City of Newport Beach, as is typical of other cities, utilizes A- weighted sound levels in their noiso ordinance to quantify allowable noise levels which are averaged over a specific time period. This time component is specified to allow for varying noise conditions such as the fluctuating noise levels associated with vehicular traffic stopping or accelerating from an intersection. The resultant level Is the average of all sound levels measured within the stated time period. The noise ordinance of The City of Newport Beach requires that noise measurements be conducted and averaged over a 15 minute period, with a sound level meter set for a slow response averaging lime. The result is termed a "15 minute L,q ", (Equivalent Noise Level) and is measured and presented in A- weighted decibels levels. By definition, a 15 minute L,,r is [he A- weighted sound level corresponding to a steady -state sound level containing the same total energy as a lime - varying signal over Ilia 15 minute period. For brief or short duration or impact sounds, the City of Newport Beach utilizes the L,„„ metric or Maximum Sound Level. This metric is also expressed in A- weighted decibels, and per the requirements of the ordinance is measured at the slow response averaging time. If the ambient noise level exceeds the resulting standard, the ambient shall be the standard. B. It is unlawful for any person at any location within the incorporated area of the City to create any noise, or to allow the creation of any noise on property owned, leased, occupied or otherwise controlled by such person, which causes the noise level when measured on any other properly, to exceed either of the following: 1. The noise standard for the applicable zone for any fifteen- minute period; 2. A maximum instantaneous noise level equal to the value of the noise standard plus twenty (20) DBA for any period of time (measured using A- weighted slow response). C. In the event the ambient noise level exceeds the noise standard; the maximum allowable noise level under said category shall be increased to reflect the maximum ambient noise level. D. The Noise Zone III standard shall apply to that portion of residential property falling within one hundred (100) feet of a commercial property, if the intruding noise originates from that commercial property. F. If the measurement location is on boundary between two different noise zones, the lower noise level standard applicable to the noise zone shall apply. (Ord. 95 -53 § 1, 1995; Ord. 95- 36 § 11 (part), 1995) Discussed in the following section, the ordinance defines the locations where acoustical measurements are to be made to determine compliance with the noise standard criteria. 10.26.055 Noise Level Measurement A. The location selected for measuring exterior noise levels in a residential area shall be at any part of a private yard, patio, deck or balcony normally used for human activity and identified by the owner of the affected properly as suspected of exceeding the noise level standard. This location may be the closest point in the private yard or patio, or on the deck or balcony, to the noise source, but should not be located in nonhuman activity areas such as trash container storage areas, planter beds, above or contacting a property line fence, or other areas not normally used as part of the yard, patio, deck or balcony. The location selected for measuring exterior noise levels in a nonresidential area shall be at the closest point to the noise source. The measurement microphone height shall be five feet above finish elevation or, in the case of a deck or balcony, the measurement microphone height shall be five feet above the finisher) floor level. B. The location selected for measuring interior noise levels shall be made within the affected residential unit. The measurements shall be made at a point at least four feet from the wall, ceiling or floor, of within the frame of a window opening, nearest the noise source. (Ord. 95 -36 § 11 (part), 1995) Special provisions for Floating, Venting and Air Conditioning equipment are provided for in the ordinance as follows: 10.26,045 Fleatinn, Venting and Air Conditioning - Special Provisions A. New HVAC Equipment. New permits for heating, venting and air conditioning (FIVAC) equipment in or adjacent to residential areas shall be issued only where installations can be shown by computation, based on the sound rating of the proposed equipment, not to exceed an A- weighted sound pressure level of fifty (50) dB(A) or not to exceed an A- weighted sound pressure level of [illy -live (55) dB(A) and be installed with a timing device that will deactivate the equipment during the hours of ten p.m. to seven a.m. The method of computation used shall be that specified in "Standard Application of Sound Rated Outdoor Unitary Equipment," Standard 275, Air conditioning and Refrigeration Institute, 1964 or latest revision thereof. B. Existing FIVAC Equipment. 1. HVAC equipment legally installed prior to April 22, 1981, shall be permitted to operate with an exterior noise limit of sixty -five (65) dB(A) until January 1, 1996. 2. HVAC equipment legally installed prior to April 22, 1961, shall be exempted from the interior noise level standard as specified in Section 10.26.030 of this chapter until January 1, 1996 3. HVAC equipment legally installed after April 22, 1961, and prior to the date of adoption of this chapter shall not exceed a maximum exterior noise limit of fifty -five (55) dBA during the ninety -day compliance period set forth in Section 10.26.005. C. In the event that FIVAC equipment cannot meet the requirements set forth in this chapter, then the exterior noise limit for such equipment may be raised to sixty -five (65) dBA and exempted from the interior noise level standard as specified in Section 10.26.030 of this chapter, provided that the applicant obtains the written consent of all the owners of the affected properties. (Ord. 95 -36 § 11 (part), 1995) 1.4 HOAG MEMORIAL FlOSPITA6 PLANNED COMMUNITV DEVELOPMENT CRITERIA & DISTRICT REGULATIONS Amendment to Restated Development Anreemen Paragraph 1.17 -Noise Limitation The existing Planned Community (PC Text) provides that noise generated from Hoag Hospital from new mechanical appurtenances shall not exceed 55 dB(A) at the property lines. This noise limitation was established prior to the adoption of the City's Noise Element in the General Plan and Noise Ordinance. It is proposed that noise generated and originating from the Property be governed by the city Noise Ordinance with certain exceptions. Planned Community Development Criteria and District Regulations M. Noise Standards Noise generated at the Floag Hospital property shall be governed by the City of Newport Beach Noise Ordinance, except as noted below for the Loading Dock Area. Within the Loading Dock Area during daytime hours, vehicles shall be exempt from applicable noise standards as listed above. Vehicle idling shall be prohibited on West Hoag Drive and within the loading dock areas, except that refrigerated vehicles may idle while at the loading docks when refrigeration is necessary. In addition, the grease pit cleaning which is exempt from the City Noise Ordinance as a maintenance activity shall occur on a Saturday between the hours of 11:00 am and 3:00 pm. 1.5 TEST EQUIPMENT Noise levels measurements were conducted with the following equipment which was calibrated immediately prior to and following the test procedures: • Larson Davis Type 624 Type 1 integrating one -third octave band sound level meter • Larson Davis Model PRM902 microphone preamplifier • Larson Davis Type CAL200 precision Class 1 sound level calibrator calibrated to a reference traceable to the National Institute of Standards and Technology, • Larson Davis Type 2560 1/2" microphone accepted to meet the specifications of IEC 60651 and ANSI S 1.4-1983 Type 1. The measurement equipment satisfies the American National Standards Institute (ANSI) Standard 1.4 for Type t precision sound level measurements. 2.'1 ANCILLARY GUILIDING AND INES T TOWER MECHANICAL EQUIPMENT Noise level measurements of the Ancillary building rooftop mechanical equipment and West Tower mechanical equipment room were conducted at 3:30 a.m. on 10 February 2012 when the influence of offsite traffic noise sources are reduced. In order to measure the worst case noise levels, we utilized a 35' telescoping microphone stand to elevate the measuring microphone to an elevation intersecling the rooftop equipment and the upper level condominium residences which have a fairly direct line of sight to the rooftop. Measurements were conducted at the west curb of West Hoag Road nearest the properly line. 2.1.1 Ancillary Building Rooftop Mechanical Equipment 'rho acoustic environment was a combination of noise generated by offsite sources from vehicular traffic on Pacific Coast Highway (PCI-1), surrounding streets, and mechanical equipment on the Ancillary building rooftop was perceptible. The test sequence was manually paused during an emergency vehicle with siren passing on PCH and a helicopter overflight. See Figure 2 for test location. It is our understanding that all four (4) kitchen grease exhaust fans in the rooftop penthouse were operating during our test however was not verified. 'File noise levels from the mechanical oquipment were constant over the duration of the test and were the primary contributor to the ambient environment, The noise levels were measured to be L,q 50.6 dB(A) and the maximum noise level recorded was L,,,,, 54.3 dB(A). CONCLUSION The ancillary building rooftop mechanical noise levels are regulates) by the Floag Memorial Hospital Planned Community Development Criteria & District Regulations (PC Text) which require that noise levels in this area do not exceed L,q 55 dB(A) during the nighttirne hours of 10:00 pm to 7:00 am. Our measurements resulted in noise levels of Lm 50.6 dB(A) which satisfies the L,q 55 dB(A) maximum allowable noise level requirement. The Hospital PC Text noise standards do riot include requirements for maximum allowable L,,,,, noise levels however are included in this report for information only. Ancillary Building Rooftop Mechanical Equipment Figure 2 2.1.2 West Tower Mechanical Bquipmont Room As with measurements of the ancillary building rooftop equipment, the acoustic environment at the property line near the west tower was a combination of ofisile traffic and hospital rooftop :mechanical equipment. Acoustical testing location is shown in Piguro 3. There is an uninterrupted and direct line of sight between the measurement position on the ro<Abed and the west facing second floor louvers serving the mechanical room. To reduce any I t('! Acoustic measurements began at approximately 4:15 a.m. The noise levels generated by the mechanical room resulted in a 15 minute Lq 50.7 dB(A) with the maximum noise level being L„4„ 50.4 dB(A). We did not verify the exact pieces of equipment within the mechanical room that was operating during our test. CONCLUSION The noise levels from the second floor mechanical equipment room in the West Tower are regulated by the Hoag Hospital PC Text which require that noise levels in this area do not exceed Loo 55 dB(A) during the nighttime hours of 10:00 pm to 7:00 am. Our measurements resulted in noise levels of L., 50.7 dB(A) which satisfies the L., 55 dB(A) maximum allowable noise level requirement. Immediately prior to the gates opening at Hoag road, we measured the ambient noise levels in the landscaped area shown as Position 1 in the following Figure 4 between the condominiums and the acoustical wall. Thr, measurement continued from 6:45 a.m. to 7:00 a.m. which is technically still considered nighttime, and a 15 minute average noise level of 54.6 dB(A) L, and maximum 67.7 dB(A) 1 -,,. was recorded. Following the opening of the gates at 7:00 a.m., typical dock activity such as operation of the cardboard compactor, talking, wheeled racks and carts rolling across the dock parking lot were slightly audible at the residential side of the acoustical wall. Trucks arriving and departing were also audible. During our measurements, offsite noise from commercial and general aviation over - flights, and occasional traffic noise from PCH was audible during quiet periods of loading dock activity. Measurement position 1 is located rnidway between the acoustical wall and the face of the condominium building. At approximately 7:03 a.m., a truck arrived from the south and removed the "SaniPak" compactor bin from the loading dock. This event requires backing the truck to the dock, hydraulically raise the truck -bed rails up towards the back of the truck, attach a cable to the compactor bin, winch the bin up on to the bed rails while consecutively lowering the bed- rails and finally driving off. The entire process from the truck arriving to departing was complete in approximately 3 minnteS. In the measurement period which included the SaniPak truck arriving, at Position 1 and at a 15' elevation above the ground, we measured a 15 minute average noise level of 56.5 dB(A) Lq and a maximum level of 71.1 dB(A) L recorded. Following the Sanipak compactor bin removal, tho noise levels at Position 1 were recorded at the 15' elevation and were found to be 66.6 O(A) L,,,,,, and the 15 minute average noise love[ of 55.4 dB(A) L,, was recorded. The source of noise levels were primarily from trucks arriving at the dock, loading or unloading trucks, and operation and loading the cardboard compactor was audible. Most of the compactor noise was from a worker throwing flattened cardboard boxes to the ground from the back of a stake -bed (ruck. Position 2 is located approximately 10' from the face of the condominium building, At a 5' elevation the 15 minute average noise level was 54.6 dB(A) L,, and the maximum level of 63.4 dB(A) 1 -,n,, was recorded. Raising the microphone to a 15' elevation, the 15 minute average noise lovol was 56.6 dB(A) L., and a maximum level of 67.0 dB(A) Lm„ was recorded. 'rhis measurement included typical clock noise, snack arrivals and departures, but also included the return of the Sanipak compactor bin. This operation was similar to the compactor bin departure described above whereas the driver backed the truck into the dock, raised the compactor bin and truck bed, slid the compactor bin off the truck and into position against the compacting apparatus and drove away. The entire process concluded in less than three minutes. Our measurements resulted in noise levels measured at the residential side of the acoustical barrier ranging from L, 54.6 dB(A) to L,� 56.5 dB(A) which satisfies the I„, 65 dB(A) maxinium allowable noise level requirement. 2.22 Fast (Hospital) Side of Acoustical Wall Two (2) measurements were conducted at the west curb of Hoag [:load directly across from the loading dock shown in Figure 5. For the first measurement, the measuring microphone was located at an elevation of 5' above the road bed. The second measurement was conducted with the microphone raised to 1.15' above the road to determine if excessive noise levels were present from recently installed rooftop mechanical equipment serving the Heart & Vascular Institute (FIVI) remodel. Figure 6 shows the HVI mechanical equipment located on the roof over the loading dock shipping /receiving area. During these measurements, clock - related noise and activity included deliveries, cardboard compactor operation, carts rolling on the dock, and a FIVAC condenser operating at the north side of the dock parking lot was audible. At the lover 5' elevation, oquipment noise from the rooftop HVI equipment was inaudible. The maximum noise level was observed to be 81.5 dB(A) L,,,r, which occurred when a truck approached within 10' of the microphone whit(, maneuvering to back into the clock. The 15 minute average noise level of 63.2 dB(A) I.,,,, was recorded. At the raised -1 -15' elevation, the maximum noise level recorded was 79.1 dB(A) L,,,,i, and the 15 minute average noise level was found to be 61.1 dB(A) L,.,a. This position is fairly exposed to traffic on PCH. Noise levels at this position were measured at 57.7 dB(A) L,,, and the 15 minuto averago noise level of 54.1 dD(A) I.,, was recorded. The primary source of noise was of(site veAiicular traffic on PCH. Measurement position 2 was located approximately to' from the face of the condominium building which receives acoustical shielding from traffic noise from the acoustic wall and the three slory condominium building. At this location we measured 56.7 dB(A) I_, ,c and the 15 minute average noise level of 50.7 dB(A) L., was recorded. CONCI,USIQN Noise levels in this area are regulated by the Hoag Hospital PC Text which require that noise levers from the loading dock area do not exceed Lp, 55 dB(A) during the nighttime hours of 10:00 pm to 7:00 arn. Moesurements at the residential side of the acoustical barrier (albeit not generated by the hospital) ranged from Le, 50.7 dB(A) to L, 54.1 dB(A) which satisfies the Lag55 dB(A) maximum allowable noise level requirement. 2.3.2 Fast (I lospital) Side of Acoustical Wall The loading clock and Hoag Road is closed during the nigtttimo hours. During our measurement, minor offsito traffic noise 'coin PCH was audible, along with an exhaust or intake fan locatod in 1110 south side of the West Towor. The measuring microphone was located at an elevation of 5' above the road bed for the entirety of the measurement. At the east side of the barrier along the curb of Floag Road, we measured noise levels of 64.2 dB(A) L.., and a 15 minute average of 54.1 dB(A) L,, were recorded. 2.4 DIETARV LOADING DOCK NOISE: LEVELS A AGTIVITV Measurements were conducted on 10 February 2012 starting at approximately 9:30 a.m. Our measurement location was at the western curb of west Floag Drive directly across from the dietary loading dock. The measuring microphone was located at an elevation of 5' above the road bed for the entirety of the measurement program. See Figure 6 for acoustical testing location. 2.4.1 Daytime Noise Measurements & Activity Noise levels were predominantly oCsito traffic from Hospital Road to the north and mechanical equipment noise from the ancillary building rooftop. Activity of the dietary dock during our measurement included a hospital staff member rolling a cart on the dock to the compactor, loading and operation of the compactor, and minor conversation between workers within the enciosed dock were audible. Traffic on Hoag (load was minimal. At the east side of the barrier along the curb of Hoag Road, tine 15 minute average level was 541 dB(A) L,, and the maximum noise level of 62.3 dB(A) L,,,,, was recorded. CONCLUSION Noise ievols in this area are regulated by the Hoag Hospital PC Text which require that noise levels Irom the Dietary loading dock do not exceed L,, 65 dB(A.) during the daytime hours of 7:00 am to 10:00 pm. The measuring microphone was located at an elevation of 5' above the road bed. Predominant background noise levels observed near the dietary dock area were primarily from ofl -site traffic on Hospital Road and Newport Blvd. There was no activity within the dietary clock curing our nighttime measurements. Mechanical equipmont noise from the Ancillary building rooftop could also be heard in the background Our measurements resulted in a 15 minute L, 46.5 dB(A), with a maximum recorded level of L,,,s, 57.3 dB(A). CONCLUSION Noise levels in this area are regulated by the Hoag Hospital PC Text which require that noise levels from the Dietary loading dock do not exceed L., 55 dB(A) during the nighttime hours of 10:00 pm to 7:00 am. Our measurements resulted in noise levels measured at the curb nearest the properly line across from the Dietary dock was L,q 46.5 dB(A) which satisfies the L, 55 dB(A) maximum allowable noise level requirement. 2.5 COGENERATION FACILITY NOISE LEVELS AND ACTIVITY As shown in Figure 9, measurements were conducted on Sunset View Part( at approximately 10' from the south face of the condominium building located at 200 Paris Lane. The measuring microphone was located at an elevation of +5' above the road bed and also at +20' above the road bed during the measurements. Measurements conducted at the +5' elevation determine the noise level exposure at the lower first floor condominium units which benefit from the acoustical shielding provided by the hospital cogeneration building and existing topography. The noise levels measured at +20' determine the noise levels experienced at the third floor of the condominiums which may have a direct line -of -sight to the hospital cooling towers and minimal acoustical shielding effects. These upper floor units would experience the greatest noise impact from the cooling towers. We observed that three (3) of the cooling lowers in the cogeneration facility were operational during our tests. 2.5.1 Daytime Noise Measurements & Activity Measurements at the 5' elevation were conducted on 10 February 2012 starting at approximately 10:00 am. During the measurement period, the preponderance of ambient noise was generated by ocean waves, traffic on the nearby Superior Avenue and to a lesser degree from traffic on Pacific Coast Highway. During the quieter moments when traffic flow on Superior was limited by the signal at Pacific Coast Highway, noise from the cooling towers and cogeneration facility was slightly audible. With the microphone located at a +5' elevation above the roadbed, we measured Lq 53.0 dB(A) for a 15 minute duration and the maximum level recorded was L,,,,, 50.7 dB(A) clue to offsite traffic. We tell the site and returned at approximately 1.45 p.m. to measure the cogeneration facility at the +20' elevation. With the microphone raised to the higher 20' elevation, we measured L,q 50.1 dB(A) with a 1111AI nun recorded level of L ,,, 64.5 dB(A). Ambient noise levels were prirnarily from ocean waves, offsite traffic noise, and the cooling towers were slightly audible. Cooling lower noise was inaudible when traffic on Superior Avenue passed nearby. CONCLUSION Noise levels in this area are regulated by the City of Newport Beach Noise Ordinance which require that noise levels do not exceed Lev 60 dB(A) during the day due to hospital operations. Maximum levels must not exceed L,,,, 00 dB(A) during the daytime from hospital operations. This section of the residential area is located within 100' from the Hoag Hospital properly line and therefore would be considered as Zone III - "Mixed -Use Residential" With three (3) cooling lowers operating, the measured noise levels of L,q 53.0 dB(A) at the 5' elevation and L_, 50.1 dB(A) at the 2.0' elevation satisfy the City of Newport Beach Noise Ordinance. The worst case Lm„ 59.9 dB(A) measured at 5' above the roadbed and L„„ 64.5 dB(A) measured at 20' above the roadbed were generated by offsite sources and therefore would not be considered in the City Noise Ordinance regarding control on mechanical equipment noise from the hospital operations. The maximum levels measured however do meet the criteria of the City of Newport Beach Noise Ordinance. 2.5.2 Nighttime Noise Measurements & Activity Duo to unusually high noise levels generated by waves during the nighttime at the nearby beach, vie were unable to accurately measure noise levels generated by the cogeneration facility and cooling towers during the 9 -10 February site visit. Acoustical tests were therefore conducted on 17 February 2012 starting at 12:30 am at the location shown on Figure 9. During the nighttime measurements of [he cogeneration facility, the ambient noise levels experienced was traffic noise on PCH, waves at the beach, and the cooling lowers within the cogeneration facility. With the microphone located at a !.5' elevation above the Sunset Park roadbed, we measured L,q 46.5 dB(A) for a 15 minute period and the maximum level recorded was L.,,,,r 53.4 dB(A). With the microphone raised to the higher 4.20' elevation, we measured Lev 47.0 dB(A) with a maximum recorded level of L.,,, 51.0 dB(A). The noise levels measured in these locations are primarily from traffic sources and aircraft operations. Specific hospital equipment and on -site operations were not contributory to these measurements. 26.1 Catalina Drive & Old Newport Blvd. Noise levels were measured at the intersection of Catalina Drive and Old Newport Blvd. shown in Figure 10. This environment consisted of small residences and businesses. The general noise sourco was traffic along Newport Blvd., and to a lesser extent Pacific Coast Highway. Traffic on Catalina Drive was not a major contributor to the ambient noise environmonl. An exhaust fan serving underground transformer which runs intermittently is located at the east curb of Superior Avenue approximately 25' from our measurement position and ran continuously during our first nighttime test. We retested the ambient levels with the exhaust fan off and results of both tests are included to the table below. The first nighttime last which inckrdes transformer noise began at 1:15 a.m. The subsequent test without the transformer noise began at approximately 2:30 a.m. Daytime tests were conducted at approximately 10:30 a.m. while the transformer fan was off. A specific location for the acoustical measurements is not indicated within the Settlement Agreement. Noise level measurements within the Villa Balboa complex were conducted during the daytime and nighttime hours on 10 February 2012 at the location shown in Figure 13 below. 2.7.1 Daytime Noise Measurements Daytime measurements were conducted at 2:00 p.m. at the emergency exit gate immediately east of the 200 Paris Lane condominium. With the microphone located at a 5' elevation above the roadbed, we measured L,q 53.6 dB(A) for a 15 minute duration and the maximum level recorded was L, „„ 62.1 dB(A). The ,general ambient noise consisted of ocean waves, traffic noise from Pacific Coast Highway and to a lesser degree, Superior Avenue. Mechanical equipment noise from Floag Hospital was not audible or identifiable. 2.7.2 Nighttime Noise Measurements Nighttime noise measurements were conducted at 2:00 a.m., also at the exit gate east of the 200 Paris Lane condominium. With the microphone located at a 5' elevation above the roadbed, we measured L. 47.2 dB(A) for a 15 minute duration with the maximum recorded level of Lm„ 53.4 dB(A). General ambient noise during the nighttimo was from ocoan waves and offsite traffic on surrounding streets. CONCLUSION The noise levels measured at this location were generated by offsite sources and therefore would not be considered in the City Noise Ordinance regarding control on mechanical equipment noise from the hospital operations. Measurement data collected however is presented relative to tho levels specified in the noise ordinance. Noise levels in this area are regulated by the City of Newport Beach Noise Ordinance which require That noise levels do not exceed L,, 50 dB(A) during the nighttime hours, and L,q 60 dB(A) during the daytime due to hospital operations. PAaximum levels must not exceed L,,,, 80 dB(A) during the daytime and Lm„ 70 dB(A) during the nighttime from hospital operations. With three (3) cooling towers operating, the noise levels of L,q 53.6 dB(A) measured during the day and L�q 47.2 dB(A) measured during the nighttime hours both satisfy the Lq 60 dB(A) daytime and Lq 50 dB(A) nighttime allowable noise level requirement of the City of Newport Beach Noise Ordinance. The new assemblies were not marked or identified with the installed glass thickness or composition however gasketing at the windows and sliding door was chocked and all appears to be in good condition. See Figure 14 for acoustical testing locations for both daytime and nighttime tests. 2.6.1 Daythne Noise Measurements Daytime measurements of the condominium started at 11:30 a.m. on 10 February. For the balcony measurements, the microphone was located at an elevation of 4' above the balcony floor, and centered within the plan area of the balcony. During the daytime, background noise levels on the balcony were primarily from off -site traffic, general and commercial aviation, general activity at the hospital including staff in the outdoor eating area, and hospital mechanical equipment from the ancillary building rooftop. On the balcony, the 15 minuto average noise levels were found to be Leq 55.4 cIB(A) and the maximum recorded level of Lm„ 63.6 dB(A). Interior measurements were conducted in the living room approximately 5' from the east exterior wall. General exterior noise sources were clifficult to accurately identify within the unit when the windows are closed. Interior noise levels were measured with the windows facing east toward the hospital closed and also with all windows fully open. With the windows closed, the daytime interior noise levels were found to be L,q 37.1 dB(A) for a 15 minute period, and a maximum level of L,,,,, 47.6 dB(A) was recorded. With the windows open, the daytime interior noise levels were found to be Leq 42.6 dB(A) for a 15 minute period, and a maximum level of L„,,, 55.6 dB(A) was recorded. CONCLUSION Noise levels in this area are regulated by the Hoag Hospital PC Text which require that noise levels from the hospital do not exceed I_,, 65 dB(A) during the daytime hours of 7:00 am to 10:00 pm. Maximum levels rneasured with the windows open were found to be of L,,,,, 55.6 dB(A) which also satisfy the maximum allowable levels of L,,,, 65.0 dB(A) for daytime hours. 2.6.2 Nighttime Noise Measurements Nighttime measurements of the condominium started at 11:30 o.m. on 9 February 2012 at the exterior balcony and in the interior living room. Measurement positions were at the same locations as the daytime positions discussed above and are shown on Figure 14. Noise levels measured on the balcony were primarily from off -site traffic and mechanical equipment operating on the hospital rooftop. On the balcony, we measured a 15 minute L,q 52.4 clB(A), with a maximum recorded level of L,,,,, 56.0 clB(A). Interior noise levels were measured with the east - facing windows closed and also with all windows fully open. With the windows closed, the interior noise levels were found to be L,y 35.4 dB(A) for a 15 minute period, and a maximwn level of Lm,., 44.2 dB(A) was recorded. With the windows open, the interior noise levels were found to be L„ 36.9 dB(A) for a 15 minute period, and a maximum level of L,,,, 45.1 dB(A) was recorded. CONCLUSION Noise levels in [his area are regulated by the Hoag Hospital PC Text which require that noise levels from the hospital do not exceed L,s 55 dB(A) during the nighttime hours of 10:00 pm to 7:00 am. The noise levels measured on the balcony facing the hospital were L,, 52.4 (IB(A), which satisfies the L,, 55 dB(A) maximum allowable noise level requirements of the PC Text. Noise levels within the condominium interior due to exterior sources were determined to be L,a 38.9 dB(A) which satisfies the maximum allowable nighttime level of LM 40.0 dB(A) of section 10.26.030 Interior Noise Standards of the City of Newport Beach Noise Ordinance, lvlaximum levels measured with the windows open were found to be of Lm„ 45.1 dB(A) which also satisfy the maximum allowable levels of L,,,, 60.0 dB(A) for nighttime hours. 3.1 CONCLUSION AND UIVIIVII-VIV OF ACOU Y11CAL TESTING RESULTS The results of all acoustical measurements included the noise reduction mitigation measures installed to date at the hospital complex. While not an exhaustive list, visible noise control devices installed at the hospital are as follows: G Noise control penthouse constructed on the ancillary building roof to control noise of kitchen exhaust fans. Acoustical barrier wall constructed at perimeter of ancillary building to acoustically shield the nearby residential condominiums. Acoustical louvers and other noise control devices installed within the West Tower second floor mechanical room. V Sound absorbing panels installed a( the wall surfaces of the loading dock. ACOUstical barrier wall approximately 20' -± tall constructed along West Hoag Road to shield residential condominiums from noiso generated by hospital operations. • A noise control enclosure has been installed around the cardboard compactor located in the loading dock parking lot, • An acoustical shielding wall has been installed directly north of the cooling lowers to shield the adjacent residences from cooling tower noise. The mitigation measures currently installed have sufficiently reduced hospital- generated noise to satisfy the applicable City of Newport Beach Noise Ordinance, and the Hoag Memorial Hospital Planned Community Development Criteria & District Regulations. When the EMS records and reports conditions at the Co -Gen weather station where file Temperature (r) is less than 55 OF and the relative Humidity (RH) is greater than 55 %, the EMS determines if the lime is between 7 a.m. (07:00) and 7 p.m. (19:00). 2. If the time Is outside 7 a.m. and 7 p.m., then continue monitoring T and RH. 3. If the time Is inside 7 a.m. and 7 p.m., then the EMS automatically calculates heat rejection load. 4. The EMS determines if the calculated heat rejection is greater than 46.2 M BTU /hr. 5. If heat rejection is less than 46.2 M BTU /hr then the EMS continues monitoring T and RH. 6. If the calculated heat rejection is greater than 46.2 M BTU /hr, then the EMS automatically alerts the operator with audible and visual alarms for heat reduction operations. 7. The EMS automatically logs the event for auditing and reporting. 6. The EMS starts a delay time for 15 minutes to confirm the T and RH conditions. 9. The hard work on everyones' behalf is sincerely appreciated. I am a PRO HOAG -GO HOAG citizen of Newport Beach, as I was born at Hoag when they were still shoveling dirt in the parking lot at the ground breaking ceremony & I will most likely exit from there... none too soon I hope! Therefore, I embrace Hoag Hospitals expansion & growth! However I do have a few concerns that I would like to get some further clarification on. 1) Why isn't Hoag Hospital on the "current project" list on the city of NB website? It would be helpful to be able to know what it is they are currently constructing & what is scheduled to happen next. As we can see & hear the construction each day, right outside our double pane windows it is helpful to kinow what they ARE doing and roughly how long each construction project is going to take. There isn't any communication from Hoag regarding construction schedules & we never know whatthe heck we are going to wake up to each morning & experience first hand, up close and personal. Especially for those of us who most affected by being immediately adjacent to the loading dock. We never know what's coming next ... a tower, no tower, 21 emergency suites, no 43 emergency suites The new HVAC system that was recently placed on the rooftop of bldg 27 will hopefully be covered soon as it is rather bright, shiny & HUGE and is facing the 2nd story condos like a GIANT new piece of living room furniture... that's how big & close it isto us physically. We are just hoping it IS ONLY large and more importantly quiet, as the HVAC is located directly over the bailer, the loading dock, trash compactor area, waiting delivery trucks & such. Plus, the let everyone know when they are coming to do the noise decibel reading /testing, so with that announcement made, Hoag is not going to start up the jack hammers when they arrive to do the testing. I had the realization recently that even when the expansion project is completed, the noise that emits from the loading dock area is never going to be within code & that exception has been made on their behalf. Maybe Hoag should consider offering to buy these few residencial condos, as they did the #304 unit upstairs that belonged to the attorney couple that lived there. The new doctors, interns, nurses that have choosen to relocate to work at Hoag, stay for a few weeks there, while they can walk to work and get acclimated to the area. If the few owners that are affected by the loading dock/HVAC noise decline the offer to sell their unit here, then they would be forever banned from complaining about the ongoing & never ending activity that takes place daily on the very active one west road access street between Hoag & a residential neighborhood. The zoning has recently changed for the 1419 Hospital Rd. medical plaza from residential to commercial office & with Banning Ranch across the street & ready to roll, I feel as though I am in the IMPACT ZONE! 2) The square footage that was transferred to the upper campus was always a question to me as I could never visualize where that amount of square footage could ever be built on the upper campus as it is already built out for the most part from my observations. As I have inquired about Hoag matters with various entities I find that no one could actually tell me what amoiunt of square footage that is already built on the upper and lower campus and how much square footage is left to builld with? No one was able to answer that question, which concerned me. Is it true that the remaining square footage is transferable back down to the lower campus? 3) If that is the case then I have definite concerns about the height maxiimuns on the lower campus buildings. It was and is my understanding that Villa Balboa views would not be affected moving forward, due to a past agreement by Hoag to the homeowners of Villa Balboa that Hoag would not build any structures on the lowere campus that were any higher than the existing Cancer center on the lower campus. Now, I understand that the cancer center going to be demo'd and rebuilt? Is Hoag going to honor their agreement with Villa Balboa about the existing height maximum? Which brings me to the next issue. 4) Recently Hoag requested, what I understood to be a height variance request for a 13' awning structure to cover the handicap access from the south parking lot to what is now the rear entrance to the hospital. I have no problem with an awning structure to keep the handicapped patients or visitors dry during a rainstorm, however I DO have a problem with what was asked to be permitted by HOAG (with the height variance granted!) It was supposed to be an awning cover & then a 13' by 206' wall of some sort was actually asked to be permitted and now I see as of 4/17/2012 permits were actually approved for a 525 square foot solid roof structure over existing elevator and stairwell, new windblock( ?), fence and retaining walls in various locations. Awning for the handicap access...? Didn't see a permit request for that...instead they use the height variance to build more walls to block our view or cover up their next plan that is being piece meal ed together to get to the results they intended in the first place, which is not very neighborly and is not utilizing their best practices. Please see attached permit number with an approved status. This is NOT ACCEPTABLE, as ANY windblock, fence or various retaining walls WILL GREATLY AFFECT THE VIEW OF OUR HOMEOWNERS HERE AT VILLA BALBOAM!! 5) More importantly it sets a precedence for the lower campus building structures if in fact they ARE ALLOWED to transfer the remaining square footage back down to the lower campus. As most of us know once a variance has been granted for height, it opens the door on that subject again. 6) Also, the existing sound wall structure that was built should be rechecked for certification on the sound wall panels. I do not believe they are up to the standards that was required to begin with. Also, I would request that you look at the loading dock area with the HVAC now installed and see if we can't follow the details of what was requested in the mitigation plan to begin with. Enclosing the trash, loading dock area to be not visible to those in direct view & earshot. 7) It is unclear to me when the reviews for Hoag compliance issues are discussed and one very important meeting was postponed last summer and we were never privy to the new rescheduled date. Also, our management company Villageway Management did not have their contract renewed this year and we have a new property manager to bring up to speed on all of these issues that we are working through & I was informed that Hoag & Villa Balboa had an agreement, but I have not been able to confirm this.
