TITLE: Balboa Village Business Improvement District Advisory Board
Confirmation
ABSTRACT:
A new appointment to the Balboa Village Improvement District (BID) advisory board
requires the City Council's review and confirmation.
RECOMMENDATION:
Confirm the appointment of Rita Stenlund to the Balboa Village BID Advisory Board.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
The City of Newport Beach has two types of BIDS that are regulated by the California
Streets and Highways Code. Four of the City's five BIDs were formed under the 1989
Parking and Business Improvement Area Law: Balboa Village BID, Corona del Mar BID,
Marine Avenue BID and the Newport Beach Restaurant Association BID. Each is
managed by business owners selected by their fellow BID members and confirmed by the
City Council. (Cal. Streets and Hwys. § 36530.) The fifth BID was formed under the 1994
Property and Business Improvement District Law and is managed under contract by Visit
Newport Beach, Inc., which serves as the BID's owners association. (Cal. Streets and
Hwys. § 36614.5.)
The City may limit membership on these advisory boards to persons that are subject to the
BID assessment. They are different and distinct from other advisory bodies within the City

and are not appointed in the same manner. The City relies upon the Streets and Highways
Code for BID Board appointments rather than Council Policy A -2.
In the spring of each year, each of the 1989 BIDs nominates and slates members to serve
on its advisory board of directors. The nominations are then presented to the City Council
for confirmation. The BID advisory boards were last confirmed by Council in June 2011.
A recent change to the membership of the Balboa Village BID Advisory Board
necessitates the Council's review and action. Staff is recommending that Council
confirm the following advisory board appointment:
Rita Stenlund, ExplorOcean, to replace Tony George, Surfside Silver, on the
Balboa Village BID Advisory Board.
Confirmation of this appointment will help provide the resources needed to support this
volunteer advisory board.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined. in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

My background includes positions to advance not only worthy health and human service organizations for the benefit of communities,
but major retail, entertainment and development projects that Include South Coast Plaza and related commercial development projects.
Through these experiences I have participated and witnessed community transformations atthe grass roots and county -wide level and
beyond. Today, at the helm of ExplorOcean /NHNM, I am working with the organization's board members and many supporters who are
committed to transform our organization Into a world -class cultural destination - which is also viewed as a catalytic project in the
renaissance of Balboa Village. Our organization continues to partnerwith the BVBID and its members to offer Village -wide events such as
'The Lexus Newport to Ensenada Kick -Off', "Paint The Town" and "Christmas Tree Lighting" - community events that work to promote
business and vibrance in the Village. As a board member of the BVBID I will continue to workto promote the businesses in our
neighborhood and make a strong connection when possible opportunities /events that arise through ExplorOcean /NHNM. Our
organization will continue to do its part in the overall (business) improvement of Balboa Village, to participate in creating a desired
