In America
In America's history, March is the month in which Great Britain began enforcing the hated Stamp Act (1765). It is also the month
in which the infamous Boston Massacre occurred (1770). It is the month that Patrick Henry gave his historic speech calling for
"Liberty or Death." However, as important as each of these events are, March also marks the birth of James Madison - -March
16th, 1751. Over the course of his remarkable contributions to our nation, Madison served as a member of the Virginia House of
Burgesses, as a member of the US House of Representatives, and as President of the United States. Perhaps most important,
Madison was sent as delegate to the Constitutional Convention in 1787. In preparation for his role at the convention, Madison
spent months studying the history of republics and democracies. As a result, his insights at the convention were so profound
and so pivotal that subsequent historians have called him, "The Father of the Constitution. ". Equally impressive, it was Madison
who teamed with Alexander Hamilton and John Jay to write the Federalist Papers to help persuade the colonies to ratify the new
Constitution. Finally, Madison was the Congressman who introduced his ideas for a "Bill of Rights" that included the 1st
Amendment which gives us the right to ordain and proclaim as our national motto," In God We Trust."

In God We Trust — America's this month has added to our ever- growing list of "Yes Vote" cities and counties across
America Mineola, New London, Overton, and Tatumt, Texas; Cotter, Arkansas; El Cajon, California; and Stone County
Courthouse in Missouri. This means that since March of 2011, we have added 105 new cities and counties. Click on
the attachment to this newsletter to see the updated list

Errors in March 27, 2012 City Council Staff Reports
The following typos and inconsistencies have been noticed both in the staff reports and more
importantly in the resolutions and ordinances being presented to the Council for adoption.

Item 4. BIG CANYON RESERVOIR FLOATING COVER REPLACEMENT
Page 2:

Handwritten page 12: Section 16 refers to the authorized list of subcontractors "identified in
Exhibit A." Jam unable to find any subcontractors listed in Exhibit A.
Final page (should be handwritten page 36 ?):
• The checking of boxes at the top seems inconsistent with the staff report. Most notably,
under "Source" the report says the transactions involve unappropriated fund balances, yet
the boxes checked suggest the project will generate new revenue for the City.
• The request for $130,000 for outside counsel seems inconsistent with the staff report which
says (page 2) that $52,601 has already been spent and that only $77,400 of new funding is
needed for that purpose.
Comment: should (or does ?) the proposed contract include liability on the part of the outside
design team if the design later proves defective?
Item 5. PLANNING COMMISSION AGENDA FOR "MARCH 8,2012"
The Council's Agenda lists this incorrectly as being a report on the Planning
Commission's March 8 meeting. It is actually a report on the March 22, 2012 meeting.
Page 2: 1 believe the remainder of Newport Banning Ranch matter (Item 4) was continued,
although there is some confusion as to whether it was continued to April 5 or April 19,
2012

Item 7. BEACH COIN LAUNDROMAT AMENDMENTS (PA2011 -209)
Handwritten page 14:
• Under Fact 9: "the Planning Commission voted unanineously (o ayes, 0 noes) to adopt'
o The vote is correctly reported as "(5 ayes, 0 noes, I absent)" in the Ordinance on
handwritten page 23, as confirmed by the Planning Commission minutes on
handwritten page 52. It should be corrected in the Resolution.

The following are some typos and other corrections which the Clerk may wish to consider
relative to the Draft March 23, 2012 Minutes being considered as Agenda Item 1 at the
March 27 Council Meeting.

o Note.' Without naming him, Mr. Purcell was criticizing the non - attendance of the
Council liaison (Council Member Rosansky) and not the staff Liaison (Recreation
Manager Janet Cates). His reference may have been so oblique as to be misunderstood by
many, but Council Member Rosansky responded to the comment in the Oral Reports,
immediately following in the minutes.

• The paragraph beginning `7n response to Jim Mosher's questions..." makes no sense since no
questions by Jim Mosher appear in the draft minutes. I did, indeed, speak before City Attorney
Harp and I would suggest inserting the following paragraph before his:
o "Jim Mosher commented on the FPPC petition ioined by the Council as Aeenda
Item 25 at the previous meeting, and questioned the related contract with the law
firm of Rutan and Tucker which, like other contracts recently awarded by the
Office of the City Attornev, he believes have been issued without time limit,
dollar limit or the Charter - required oversight by the City Manager or Council."
• `...Fletcher Jones has an encroachment permit with the City to use Bayvveod Bavview Way."

• On this page the abbreviations "GRF" and "NBCC" would be more logically introduced in the
first paragraph where the corresponding terms are first used. The abbreviations could then be
used on the remainder of the page.
• The name "O'Hill" is used three times in referring to "Robert O'Hill" (paragraph 3) and "Mr.
O'Hill" (paragraph 4 and on the following page). In the many hearings before the Planning
Commission it was clear this gentleman does not use the apostrophe in his name. The correct

spelling seems to be "Robert O Hill" (with no punctuation— see "Who we are" at
http://www.golfrealtvfund.com/). It is unclear if the "0" is his middle name (as in "Harry S
Truman ") or part of his last name. Unless his speaker card says otherwise, for consistency with
the other minutes I would suggest O Hill.

• Under Agenda Item 15 a motion and vote is missing (see 01:07:00 in the archived video).
o Prior to the vote by paper ballots, the Council voted on whether the Planning
Commission appointment should expire on June 30, 2012 or June 30, 2016. Council
Member Rosansky, seconded by Council Member ? ? ?, moved to choose the June 30,
2016 date (for the Planning Commission appointment, only). The vote to approve the
motion was unanimous.

• `...Dave Girling is the newest member to the Harbor Commission for a term that expires on
June 30, 2016 2013"
o Note: Mr. Girling was being appointed to fill the remaining term of resigned Harbor
Commissioner Vince Valdes, who was appointed June 23, 2009 and whose term was
set to expire on June 30, 2013. Since that is more than a year off, the Council does not
have the power to extend the term. If they did, it would have been extended by four
years to 2017, not 2016.
• At the bottom of this page it would be helpful, and consistent, to insert a blank line before the
comments of Kate Spenson.
