TITLE: APPOINTMENTS TO FILL THE VACANCIES ON THE HARBOR
COMMISSION AND PLANNING COMMISSION
ABSTRACT:
At the January 24, 2012 City Council meeting, the City Clerk was directed to treat the
Harbor Commission and Planning Commission vacancies as unscheduled vacancies
and advertise and accept applications from interested citizens, pursuant to City Council
Policy A -2, Board and Commission Appointments.
RECOMMENDATION:
a) Appoint Chandler Bell or Dave Girling to fill the vacancy on the Harbor
Commission.
b) Appoint Tim Brown, Willard Dunlap, or Steven Coyne to fill the vacancy on the
Planning Commission.
c) Determine if the term for the new Planning Commissioner should expire on
June 30, 2012 or be extended to June 30, 2016 as permitted by City Council
Policy A -2.

DISCUSSION:
At the Regular Meeting of January 24, 2012, the City Council directed the City Clerk to
advertise the vacancies on the Harbor Commission and Planning Commission pursuant
to City Council Policy A -2. Mayor Gardner, Council Member Selich, and Council
Member Hill were appointed as the Ad Hoc Appointments Committee ( "Committee ").
The Committee was assigned the task of reviewing applications and interviewing
applicants.
The Notice of Vacancies was posted in the City Clerk's Office on Wednesday,
January 25, 2012, and advertised in the Daily Pilot on Saturday, January 28, 2012. The
deadline to submit an application was Wednesday, February 8, 2012. At the conclusion
of the application period, the applications were forwarded to the Committee for their
review and scheduling of interviews. Interviews were conducted on Tuesday,
February 21, 2012.
On February 28, 2012, the City Council confirmed the nominations of Chandler Bell and
Dave Girling to the Harbor Commission and Tim Brown, Willard Dunlap, and Steven
Coyne to the Planning Commission.
The Harbor Commission term will expire on June 30, 2013. The Planning Commission
term is scheduled to expire on June 30, 2012; however, pursuant to City Council Policy
A -2, the City Council has the discretion to appoint a replacement to serve the balance of
the Planning Commission unexpired term plus one full term of four -years since the
unscheduled vacancy is occurring within one -year of the expiration of the term (June 30,
2012). If desired, the new Planning Commissioner's term could expire on June 30,
2016.
Pursuant to Council Policy A -2, the following is the procedure for voting on
appointments to City Boards, Commissions, and Committees:
A. The Council will vote on all appointments and seats simultaneously. The voting
will be by paper ballot and the City Clerk will tabulate and announce the results,
including the vote tally.
B. Each member of the Council will cast one vote for the Harbor Commission and
one vote for the Planning Commission as indicated on the paper ballot from the
list of the nominees. In order to be appointed, the nominees must receive at
least four votes.

The City Council will also be casting a vote on whether they want the term for the new
Planning Commissioner to expire on June 30, 2012 or June 30, 2016.
The City Clerk will prepare letters for the Mayor's signature for both the successful and
unsuccessful candidates.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.

DISCUSSION:
On January 10, 2012, Harbor Commissioner Vincent Valdes and Planning
Commissioner Robert Hawkins resigned, effective immediately. Mr. Valdes' term
expires on June 30, 2013 and Mr. Hawkins' term expires on June 30, 2012.
The Notice of Vacancies was posted in the City Clerk's Office on Wednesday, February
15, 2012; advertised on Saturday, January 28, 2012, in the Daily Pilot, and applications
were accepted until 5:00 p.m. on Wednesday, February 8, 2012.
At the Regular Meeting of January 24, 2011, Mayor Nancy Gardner and Council
Members Selich and Hill were appointed as the Ad Hoc Appointments Committee. At
the conclusion of the application period, the applications were forwarded to the Ad Hoc
Appointments Committee for their review and scheduling of interviews. Interviews were
conducted on Tuesday, February 21, 2012. Based upon the interviews, the Ad Hoc
Appointments Committee recommends the nomination of Chandler Bell and Dave
Girling to the Harbor Commission and Tim Brown, Willard Dunlap, and Steven Coyne to
the Planning Commission.
Appointments for the Harbor Commission and Planning Commission will take place at
the Tuesday, March 13, 2012, City Council meeting.
Pursuant to Council Policy A -2, the City Council has the discretion to appoint a
replacement to serve the balance of the Planning Commission unexpired term plus one
full term of four -years since the unscheduled vacancy is occurring within one -year of the
expiration of the term (June 30, 2012). If desired, the new Planning Commissioner's

Once the final appointment to the Harbor Commission and Planning Commission are

I have had the pleasure of living and working in one of the most beautiful places in the world. My goals are to pro - actively work with our
Civic Leaders and Residents to keep our Harbor and surrounding community's Safe, Clean, and Friendly. I have good relationships with
State and local Government Agencies, boat owners, yacht clubs, businesses, and waterfront home owners. I work and play on the harbor
and feel I have a good understanding of the needs and values needed to be open minded and responsible to make the right decisions for
our community. Our harbor is one of, if not the finest and most premier destination harbors in the United States/World and I would like to
be a. part of the solutions going forward to make it even better. With the City going through some difficult transitions both on the water
and off making it vital that we have committed and experienced leaders in the community to guide and help during these times and for

David Girline Statement of Interest— Newport Beach Planning Commission
I absolutely love living in Newport Beach and for the better part of 30 years I have had close ties to the
area. My parents have lived on Balboa Island since 1977, and since enrolling at USC that year, I have
either lived in the area or visited frequently to see family and friends.
As a local businessman and Realtor, I want to see the high quality of life we enjoy in Newport Beach
preserved and maintained and, more specifically, ensure that development in our city is appropriate and
consistent with the local planning codes and ordinances. In that spirit, a few years ago I decided that
the best way for me to see that happen was to become more involved in the local community. I
committed myself to doing just that by identifying ways in which I could be involved. I approached the
Newport Beach Association of Realtors ( "NBAOR ") and I am currently serving my second term as
Chairman of the Government and Political Affairs Committee for NBAOR. In that role, I have been able
to increase awareness within the Newport Beach Realtor Community of issues that may affect our
industry, and I believe my efforts have had a positive impact on the process. In addition, I followed in
the footsteps of my father by regularly attending the Aviation Committee meetings so that I will be
informed of developments with the airport and be in a position to disseminate that information to the
local community in general and to the Realtor community in particular. And now, I am applying for
appointment to the Newport Beach Planning Commission.
Throughout my business career, 1 have held senior management and C -level positions, and in these
roles, I have applied a fair and thoughtful management style and a pragmatic approach to decision -
making. Many of my character traits were learned from my father who was an officer in the US Air
Force. For instance, he once told me that when you compromise your integrity you can never get it
back. And he has always treated people with the utmost respect. I always try to apply these principles
in my professional and personal life, and I believe that people deserve respect and that integrity is
"doing the right thing when no one is watching ". If selected, I will apply the same approach as a
member of the Planning Commission that I have applied in my professional and personal life.
I have owned homes on Balboa Island, Belcourt and now in One Ford Road ( "OFR ") and through
homeownership, I have developed a deeper, personal interest in the community. I regularly participate
in OFR Board meetings and I served on the Belcourt HOA for two years. I have also invested in
residential real estate in San Francisco. In both the Marina District in San Francisco and in Newport
Beach, I always tried to preserve the integrity and character of the unique neighborhoods and the
original structures where appropriate. I believe that history is an important aspect of any neighborhood
and that we can "enhance the present by remembering the past ". My properties required renovations
and re- development, and I acted on my behalf as General Contractor, working closely with the local
Planning Departments to submit plans for approval. Furthermore, as a Realtor, I must be very familiar
with the local planning codes and ordinances so that I can effectively advise my clients. The result is
that I have a very good understanding for Planning Department operations and the associated
processes.

I am confident that I have the knowledge and skills necessary to be a valuable and contributing member
of the Planning Commission. My real estate background combined with my finance and marketing
studies at both USC and UCLA (MBA) uniquely position me to be a member of the Planning Commission.
Most of all, I would be honored to serve and to have the opportunity to give back to the community. I
am passionate about Newport Beach and real estate, and I would be enthusiastic about serving on the
Planning Commission to ensure that improvements to the community are consistent with the local
zoning codes and ordinances, and that future development is beneficial and appropriate for the
community.
While I believe my skills are best utilized on the Planning Commission, I am eager to serve the
community. In that spirit, should the selection committee not select me for the Planning Commission, I
am open to an appointment to one of the other Commissions such as the Harbor Commission or the

Dear Ad hoc Selection Committee Members,
I have been active in Newport Beach civic affairs since my first appointment to a city committee
in 1998. 1 have outlined the range and scope of those activities below. I have reached my term
limit as a Parks, Beaches and Recreation Commissioner this June, 2011. 1 am applying for a seat
on the Planning Commission. Although, I am not an engineer, or developer, I believe my civic
leadership and experience in Newport Beach during the last 13 years has provided me the
opportunity to cross a very broad spectrum of community interests that will serve the other
members of the Planning Commission well. In addition, I am in the process of completing a
Certificate of Land Use and Environmental Planning from the University of California, Davis to
further qualify me for this appointment. I look forward to the opportunity to continue to serve
the great city of Newport Beach as a Planning Commissioner.

Planning Commission- I have been in the real estate development business for 38 years, 12 of which were with The Irvine Company. As
the Vice President of the Investment Property Group at The Irvine Company, I filed and presented numerous projects to the Newport
Beach Planning Commission. As the representative of St. James Church I negotiated the current requital parking agreement with the city.
As a current resident and past President of the Cliff Haven Homeowners Association, I assisted In the negotiation agreement that resulted

As a third generation Californian I was blessed to have a family immersed In the heritage of this great state. My
great grandfather, Frank Dunlap moved to California from Missouri in 1881 seeking opportunity to practice law.
He started his practice in the small farm town of Stockton representing young oil drillers seeking fortune in the
growing oil fields of the central valley. In 1888 he was admitted to the California Bar, becoming district attorney
in 1890 and was elected to the state assembly in 1891. He served as Speaker Pro Tem in the California
Assembly in 1905. He drafted and was issued the first oil drilling permit in the state.
My grandfather W.E. Dunlap was a geologist and petroleum engineer and was one of the founding directors of
Richfield Oil Company which later became ARCO. My father W.E. Dunlap Jr. was in the oil business as well. From
1958 to 1965 he was Director of Flight Services for Richfield Oil's five corporate planes airplanes.
I was born in Pasadena Ca. in 1948 where I graduated from Pasadena High School in 1967. 1 attended Menlo
Junior College on a football scholarship and earned my A.A. degree in 1969. In 19711 graduated from U.S.C.
receiving by B,A. degree in History.
