However, we find that it is not so, and that the actual effect o f the Council's dooial of a use permi t has bel!l to nutlaw babysitting at a friend's home. I am sure we are not alone in thi s cri sis. There must be many o thers who are havtng the same difficul ties. It i s easy fnr the r:ouncil members to say, "Have someone come to your house." There aren't enough baby sitters to 90 around-just as there would not be e.noucjl teachers to 90 around to each home i f school s, such as the Sorona del Mar grarrmar school, o r Newport School, or the Hei ghts school, were not permitted in resi den ti al areas. It IS strange tha t our ':ity Coun cil will thus deny us the ri~t to solve our o wn problems by oursel11es, but at th e same tirn e Ji ve unhesitating approval to "sociali zed baby· si tting" prov•ded by the ci ty i tself. The Members of the Sehate and our collearuea tn the House of Representa- tives are the last bastion tor the defense of eonatltuttonal covernment. Far from yteldJ.ng to the pressures and demands ot the courts and the Executive, lt Is our duty to reatat on every side the encroach- ments on our power and prerogatives. and to begin here and now to restore to the people of the United States the proper balance of power between the three coordinate branches of the Fed- eral Government, and to protect the rights of the States and of the people thereof 1n preserving to them all powers that were not speclflcally delegated to the National Establishment. This is the challenge that is laid down. and I know of no greater service that could be performed for all the people of the United States than that we here and now begin to turn and reverse the tide and to assert that our republican fonn of government shall continue to operate and .e.xJ.sL1n the manner and-form that it was so designed to operate and exist under the Constitution of the United States. It is a mockery for Congresa to ••· .:on- cern itself over any federally estab~~5hed right to vote, when ntne men appointed tor llfe, with no responsibility to the people in either their appointments or tenure, can arrogate unto themselves the power to dictate to the sovereign states how they shall conduct their internal af- fairs. even to the point of stepping in and overturning the established consti- tutions and laws of the States and sit- ting down with a slide rule and dividing people by the head in the same way that a skilled butcher could carve meat. This is not a fancy-it is a tact. Not only has the Supreme Court directed the 1nler1or judges in the Federal judiciary to under- take the task of remaking States, but also it has ad•wised the judiciary systems of the States themselves that It is now their bounden duty under the U.S . Con- stitution to put tbe courts and judges in the political thickets, and for these State courts and judges to get about the busi- ness of either blackjacking State legisla- tures to reapportion or, 1t the threat and intimidation tails, do it themselves. Madam President, the great genius of our constitutional system Ues in the fact that it was designed, both at the level of the National Government and the State governments. to protect the liberty, free- dom. and right of th~ individual as against action s by a raw majority of the people. Are we to define Jiberty and freedom as that which 51 percent of the people want. as opposed to the wish es of 49 percent who voted on the other side? If the individual is to be given a number. and the numhers are going to be added and divided , this will be the inevitable result. No one h as ever claimed that our system of government is perfect. any more than anyone has ever claimed that courts and judges render perfect justice under t h e law. Only the Infinite can be infallible. but by and large we have right- ly cla im ed that we have a better form of government and a system for deciding cases a nd con troversies that has resulted in giving a better and more equitable form of justice than results from any other device. by human ingenuity. I deny that nine platonic guardians who sit on the bench of the U.S. Supreme Court have any more infallibility or per- fection than either the people or the elected representatives of this country. be they at the level of the State or within the National Establishment. As early as 1936 a U.S . Senator, speak- ing on the floor of the Senate, criticizing a decision of the Supreme Court, said : The Supreme Court now, in effect, t or a ll practical purposes. ls a continuous Consti- tutional Convention . Another Senator s aid : Thls means that 120 mllllon are ruled by 5 men. Today he can amend his statement of a quarter of a century ago and say: One hundred and eighty mUUon are ruled by five men, nnd I am one of them. If Ripley himself were alive today arid wanted to pose one ot the most Incredible and incredulous ''belleve It or nota," this would be the one tor him, because this statement was made by none other than Associate Justice Hugo L. Black of Ala· bama when he was a member o1 the tJ .8. Senate. on March 2e, 1912. Justice Black joined with stx of hls colleagues on the Supreme Court Bench to render a deci- sion that is the culmination of the long Hne of cases which this Court has previ- ously decided destroying and usurping first one power and then another uncon- stitutionally invading and weakening the reserved powers of the States in flrst one area and then another, and lending aid and comfort to the conspiracy that is dedicated to the overthrow and destruc- tion of our syste m of government itself. The case of Baker, et al. a gainst Carr is commonly known as the T ennessee ap- portionment case. and in this case for the first time the Supreme Court de- clared that the Federal judiciary had an alleged constitutional authority to in- validate State constitutions and statutes and divide the repr esentation in State legislatures in such a manner and form as the courts might deem jus t and equitable in the premises. The impact of this decision is even now reverberating throughout State after State. and inevitably the Judiciary in both the State and Federal depart- ments is being drawn into the heart of the political thicket and will become so enmeshed in partisan power politics that it is doubtful if the courts can ever be restored to the point of dignity and con- fidence that is required in the character of a judicial system that was envisioned by the founders of this Republic and tha t continued down to the change in the complexion of the U.S . Supreme Court in the late 1930's. Th·: words that Mr. Justice Harlan wrot.e 1n his separate dissenting opinion in the Tennessee case will be prophetic. He said : In con clusion . It ls appropriate t o say that one need n ot agree as a c l tlzen wt th what Tennessee baa done or tailed to do ln order to deprecate, u a judge, what the majortty 1a dolng today.
