HAAPA, owner and PUblisher of the Ensign • THIS THREAT CAN HIT US ALL Controls proposed for Mariners Mile prQPertles have prompted some pertinent remarks from Newport Beach Council- man Dick Croul. "A developer buys this valuable prop- erty under one set of conditions, and then you come In here with these regula• tions," he said of the proposal to set a 50 foot height limit and 6(1,{, limit on area that could be developed. "If ~were a developer or ow ned this land, I would not stand for It," Councilman Croul has hit upon the fundamental evil of legislative attack on property. It Is unfair and certainly un- constitutional to take away property value without just compensation. We faced a similar threat two years ago when our City Council was about to enact a drastic parking ordinance for the long e stablished business areas in our city. The law, lf enacted, would have taken away as much as $20,000 to $30,000 U;o~ U}e . ~ v~ue of each business :pr operty1 because of severe ' restrictions on remodeling and rebuild- ing. Only ·at the last moment did an arous.x l business community get to the Council chambers to eliminate' the worst features of the proposed ordinance. For some time now we have been facing another attack on property values. This comes fr om the changes recom- mended for off-s tre et parking for resi- dential lots --the proposal for two gar- age spaces for each residential unit on a lot. This would in eftect rezone an undeveloped R-2 lot to R-1, cutting the potential Income, and thus reducing the sale value as much as $5,000 to $10,000. These threats should alert all local citizens to the danger of financial loss that they can suffer through local law- making. If the Importance of private own- ership of property and the constitutional protection of that right were understood by our lawmakers, and also by the voters, we could be s ecure In our right to own property. In the long run, that right Is the basis for the protection of all other rights, Including freedom itself. , f, · ·)1\IC · ' ' ,' I , ' : • ,"'(,)LI,'•r l•l •• ·•\ 'L -,-,...-~--. ---... ., ...... ::ez•?!l ........ - IIOTICE OF PUBLIC HEARING NOTICE E HEREBY GIVEN tb&t the City COI.lDCil ol the City of Newport Beach will bold a pablle belrlDc regarding a pro~ posed emerpacy ordinance, boiac. The ancients we re skilled astronomers, a nd , knowi ng that God directed both the s tan in the ir courses a nd the wa ys of men on the earth. they saw that the two are inter·related. It is important to avo id the error into which many have ,alipped of holding that the position of the stars at the time of birth determine the charac ter and fa te of men. Augustine re futes this error s killfully by o bserving that Jacob a nd F:sau were born at the sa me instant as far as the positions of the s tar!! can be deter mined. yet the y are utterly d iHere nt from each other. While we must guard against the error of ''Astrology,'' it is equally important not to dis regard the nature of the universe as being one cosmic coordinated whole moving under the dire ct ha nd of God, in whi ch stars themselvea lite reaponaive to the same providence that governs in the aHairs of men. The heavens d o not move in unchanging orbits: they do cha nge and have changed, and the change• aeem to be connected with upheavals on earth.
