The outspoken boatyard owner told the City Council last week: ''This proposed ordinance Is just the first step that would lead to similar controls on other businesses. Once your foot Is in the door with this legislation, based on aesthetics, It will eventually get to other businesses, and will affect me and my boat yard. A man wants to run a service station, not a shrubbery farm," he objected, referring to a provision in the ordinance requiring landscaping on 15% of the station area. Mr. Gadarian stated further : "It Is not the function of city government to legislate how many tires can be displayed at a service station any more than you could attempt to legislate how many dresses are displayed In a dress shop window." The new concept for legislating more controls on business (and eventually on residences also) is based on eliminating what the planning dreamers in our city government call "visual pollution." It does not take much imagination to realize what drastic and injurious restrictions can result from such an absurd standard of law-making . All local businessmen, and residents as well, should heed Blackie Gadarian's warning and voice their objections to the City Council. If this type of legislation is enacted, there will be dangerous pre- cedent for further controls based on the unconstitutional concept of aesthetics, which is determined by whim of personal taste. • • • * LICENSE FEE IS INEQUITABLE A subtle scheme for dividing and con- quering in the business license fee con- troversy is to claim that "it is unfair to charge small businesses the same fee as big businesses." This is an attempt to play small business against big busi- ness, and can result in changing the baSic concept of levying business license fees. The historic practice in Newport Beach has been to charge fees for services rendered in order to cov1t administrative expenses. The c hange that Is being con- templated would place license fees In the category of a new source of Income In the annual budget --and then all local businesses would face periodic Increases in the business license cost. Why should local businessmen always stand on the defensive against the threat of more and more burdens through legisla- tion enacted by their own City Council? The best defense Is a good offense. It Is time for businessmen to launch a concerted drive to eliminate business license fees, rather than fight rear-guard a ctions against license tee Increase.
