guides its progenitor's offspring.
and countless more who came
to live its promise and build that
f)edgling nation· into what they
now proudly call the strongest
of nations.
Such pride, they say, is not
reserved for the oldest of those
voices. However, if it were, few
could boast louder than John
Hannscn of Costa Mesa.
But so could anyone else
whose great, great, great, great,
great grandfather signed the
Constitution .
.. I don't consider myself any
more important than any other
American ... growing up, the
importance of my heritage was
downplayed and kept in penpcc-
tive," commented the 42-year-
old descendant of Constitution
signer and framer, Daniel Car-
roll II.

Today the nation celebrates the 200tb annivenary of
the signing of our Constitution, one of the most
influential and revered documents in history.
It established the framework for the government which
we still have today, codified the individual liberties which
we still enjoy, and reintroduced democracy to the •orld
more than 1,800 yea.rs after Julius Ceasar ended the
Roman Republic.
In celebrating the Constitution, however, we are doing
more than honoring a couple of pieces of ..eaper. Words,
after all, arc just words, as are these you are reading
now. These words will be gone tomorrow. How did the
Constitution reach its place in our history?
The fact that our Constitution is still a valid, indeed
indispensible, part of our society is due to the remarkable
generation of leaders which drafted it and nurtured it
through its infancy.
It is very unlikely that the world will ever see a group
like that again. Madison, Washington, Jefferson,
Adams, Franklin, Hamilton, Jay and the other Founding
Fathers didn't just write down some pretty words to
play to public opinion, and then proceed to act as they
pleased. They truly believed in those words and the hope
for humanity that they represented. Those who
eventually became president, most notably Washington, ·
were well aware that words are ephemeral and must
be backed by action. They were very conscious of their
responsiblility to uphold the Constitution, not undercut
it.
Washington deliberately eschewed the trappings of
royalty that some wanted to attach to the presidency.
Adams and Jefferson managed a peaceful transfer of
power after the first truly contested election in our
history, that of 1800. They set the precedents which guide
us to this day, and without which the Constitution would
have been forgotten before the ink was dry on the
parchment.
Today's leaders would do well to harken back to the
courage and integrity of those great men -living on
a frontier, an ocean away from "civilization" -whose
devotion to an ideal provided the world with a new
beacon of freed om and justice.

Many of us will not live to see
its completion, but the latest
Irvine Company plan for the
moat valuable ra1 cat1te in the
world may become the sreatat
monument to Don BRO and
company.
Nearly 80 percent of the land
between Corona del M1r and
Laguna Beach will be owned by
the public if the latest plan
finally receives all the various
governmental approvals. And
sometime 1round 2:010, when all
clements of the project are in
place, only about one-fifth of
this vut coutal paradise will be
used for homes, hotels, golf
courses and related business
centers.
At this month•s meetina of
Speak Up Newport (SUN), two
young Irvine Company execu-
tives praented a graphic report
on the latest plan for tbe down-
cout region, a plan that bu been
approved by Laguna Beach.

for the Irvine Company, and one

tracts like Seal Beach. The
company could have opened up
more Cameo Shores or subdi-
vided Pelican Hills or built just
north of Laguna Beach where
some of the most majestic views

been built on piecemeal. But no,
the company wanted to stick
with the grand plan, in keepiq
with their dUay developments in
Newport Beach and Corona del
M1r.

I would lite to say one thin&
about the back bay. We are still
. getting all kinds of garbage.
Between the sea wall '8d my
dock is over fifteen feet. It is
solid garbage all oftbe time. We
have·just finished dredging the
bay and the three channels. By
taking a measurement from the
same place at the sea wall, the
silt oa the bottom in the last six
months bas increased a foot and
a half.
I do not know bow we can
have a clean bay, when most of

inated mushrooms and sword-
fish and duct..
The salads consisted of a
lettuce salad with a great tangy
Italian-type~ and a mar-
inated salad of carrots.. green
and red peppen and mush-
rooms.
The feature entrecs. the
swordfish and the d~ were
both tender IDd tasty, a real treat
for the t.astebuds.
Also available was a sushi dish
for more sophisticated tastes

To complete oar meal, we bad
coffee and a dream datrrt.. I had
cbocolat.e mousse in a coolie
·~ sened with fresh raspber-
ries and raspberry sauce. The
sauce was delicious and some-
what diff ennt. lo.stead of a
thick, sugary. sticky glaze, the
raspberry sauce was light and
fresh and only slightly sweet-
ened.
My companion had vanilla ice
cream covered with fresh
raspbcnics that was also heav-
enly.
One of the nicest features of
our lunch is the way we f cit
afterward. Pleasa ntly filled
instead of stuffed.
The view alone is" worth the
trip to Cano's. Just to sit and
look out as the boats sweep by
is a very pleasant way to spend
the lunch hour, and the delicious
food makes l unch truly a

buyer/seller, Part II

Last week we discussed the
dual agency. i.e, when one agent
represents both the seller AND
the buyer in the sale or purchase
of a property. We concluded that
the foremost concern of the
seller is: .. Will my agent have to
tell the buyer what I really will
take for my house (even though
I am asking forSJ00.000 more)?'"
And the buyer is likely to ask
himself ... Will my agent have to
tell the seller that I am really
prepared to go up $25.000 from
what I am initially offering? The
new .. Agency Disclosure .. form
published by the California
Association of Realtors is very
~J><:Cific :ihout that.
The agent docs NOT have to
disclose either fact to the other
party. The form states it this
way: "The agent.. ... may not.
without the express permission
of the prospective party. disclose
to the other party that the Seller
will accept a price less than the
listing price o r that the Buyer
will pay a price greater than the
price offered ...
Thus the dual agent is in the
position to guard both the
eller's and the buyer's ri ght: to
obtain the best sale price (in the
case of the seller). and to obtain
the property at the most attrac-
tive purchase price (in the case
of the buyer) .
Many sellers and buyers may
pref er to have their own agent
who docs NOT represent the
other party as well. Other sellers
and buyers arc pleased with a
transaction handled by the same
agent and sometimes feel that
they (the sellers and buyers) have
benefited from a reduced com-
mission amount.
In either situation. the "'dual
agent .. o r the "singJc agent'~
transaction. it is important for
the agent to be thorough in his
her understanding and execu-
tion of the transaction to main-
tain the highest degree of accu-
racy. honesty and ethics
throughout his/ her relationship
with the client or clients. It is
equally important for sellers and
buyers to thoroughly under-
stand the contract they enter
into. If you don 'l understand
something. ask to have it
explained. If you disagree with
something, bring it out into the
open and negotiate an agree-
ment. In that way. everyone
accomplishes their objectives.
