"The Federal Snoopers Are After Me," . . . : written by Roblruion Mcll'faine, pubUahet of the Downtown, Pennsylvania, Archive. Mr. Mcilvaine and hla wife had • bought this litUe weekly paper 6n the proverbial ahoestrmg, ii:nd were getting along nicely. unW a representative of the \Vage and Hour Division of the Federal govemment appeared with a long bill of particulars .of unfair practicee which the publisher had unwittingly committed. Mr. .McUv&ine has since followed,' up the Post piece with a further recital of events which he printed in hla paper. It all amounts to an interesting, firat-hand account of bow Federal laws whose. interest ia perfectly good can be carried to extremes of Interpretation which make them almoet incredibly onerous to business-and especially small busineee. ' Newspapers of less than 4.000 circulation are exempt from the Wages and Hours Act. and .Mr . .Mcllvaine BBSUm- ed that his Arehive, with a circulation of about 1,600, •. naturally fell into this category. However. it seemed that the printing end of the paper had been set up as a separate corporation, and this legal quirk brought it with- in the scope. of the law. Mr. Mcilvaine didn't think be was engaged in interstate commerce either . But he was wrong agaln....,..slmply beca use he printed letterheads for firms which mail letters out of the state! · That was only the beginning of the troubles. It had been a common practice for years for groups of people, ' young and old, to d~o p in at the little plant each Wednes· day evening and fold the papers for malling next day. They earned a Little money and they had a lot of fun. But. according to the Wages and Hours agent, each one would henceforth have· to have a time card, a BOCial security card, and all kinds of reconill would bave to be kept. Raiulta : Mr. Mcllvaine, who wu already heavily in debt, .borrowed cnore money on hjs_~ig&: !!&¥ta and bou1rht a preas which mechanically felds the papen. Some time later the Wage and Hour people moved again. .Mr. Mcllvaine was onlered ·to pay ' $744.25 in back wages, which he didn't have: Of thia, $156 was to go to the foreman. The foreman, incidentally, bad been paid a straight $80 a week, with paid vacation. and had been away two more weeklf because of sickness. So he bad already re<:eived $320 for time he had been absent. But he got the additional $156. .Most amazing of all, $582 of the back wages, accord- ing t o the Wage and Hour diviaion, bad to be paid to him· self ! Apparently he'd been taking out less than the proper aalary and that just wasn't legal · Mr. Mcilvaine cites more in.stances of this sort. and observes that the Arehives' dosier to the Wage and Hour ofnce "is now about 15 inches thick and it would be hard to estimate how many of our tax dollars were spent oo thia investigation." In all probability, thouaands of little \maineases have found themselves illvolved in similar pre- dicaments. The big businesa, with its legal and accounting departments, can take the huge masa of lawa and rullnp and bureaucratic practices pretty qiuch in stride.
