Green Inc., $475,000 to leave the Costn Mesa Golf and Country Club, but it may take several days for the offer to be made. The council instructed City Manager Allan Roeder to offer a settlement not to exceed S475,000, accordin~ to the minutes from a closed session meeting Monday night. However, o family emergency prevented Roeder from contacting the Greens' Attorney. David Wheeler, on Tuesday. Harry S. Green ran the country club and driving rnngc for 21 years. The city awarded a new concessionaire's-contract to Mesa Verde Partners in June. The contract called for Mesa Verde to take over opcr:ition Sept. l. But the Greens have refused to leave, saying the city never properly informed them of the decision 10 pul the course ouc to bid. The city has filed two lawsuits to force the Greens off the premises. The Greens' lowered their original $1.25 mil- lion demand to $600,000 t"o weeks ago. Wheeler, while stressing that he had not yet had contact with Roeder, soid the $475,000 is closer, but it's still not there. "There seems 10 be some confusion betwee n the parties as to what the sclllemenl exactly contains," he said. "We're getting closer but if you're one dollar· apart the whole thing blows apart." The main disagreement is the valuation of the Greens' golf carts. There arc 120 cam on the property. The Greens assessed value at Sl,600 a piece. The city countered wi th S800. Wheeler went halfway and suggested SJ.200. But, he said he wasn't sure whether the $475,000 figure included the higher a sessment, a difference of $48,000. Generally in a settlement deci ion , reams of paperwork need to be approved before a trans- fer is enacted. But Wheeler said once a se11Je- ment is reached in principle, the Greens could vacate "within 24 hours." Councilwoman Sandra Genis said she was unhappy with the propo~ed settlement offer. but realized ic was a complex mailer. "It's more than I would have liked to ~ee, but unfortunately we have a long-term situation that needs to be sc11led," she said. The city's offer include!> capital im· provements the Greens made over 21 yea rs, a!> well as equipment the Greens own, revenue the Greens claim was lo t because of city mi'>- manugement of driving range com.truct1on, and two court cases th e Greens have filed again~t the city. "There are legitimate issues here that arc being settled," Genis said. "Thi'> i'>n't just $475,000, throw it in your pocket and buy a yacht. It's not a gift." A detailed breakdown of the city's offer and how much Mesa Verde will pay "as unavail- able late Tuesday. The amount the city pays will be taken from the golf course fund, which is unrelated 10 all other city funds. "But it's still the golfer who pay~;· Genis said.
