FBI waits in the wings . -, By Rv~s Loar St.aft Wnttr NEWPORT-MESA -The Internal Revenue Service's claim or $2.4 million in back taxes against Stephen Wagner will take a back seat to the return or stolen school district money, according to an attorney represerving the school • district. · 1 "We' have ~t:n advised by tbe lRS that Newport-Mesa would hac.-e priclrity over the IRS tax liens because the restitution or funds stolen from a public agency takes priority over federal tu liens," said Spencer Covert, an auorney for the Newport-Mesa Unified SchoOI District. "There are a few cases in life ~here you can stand in ftont or Uncle Sam -and t~is is one 9f them." Sch06JI district officials have been doubtful that any of the allegedly embezzled money would be returned to the district because of federal tax liens against Wagner for $2.4 million. Federal bankruptcy records show that Wagner has a total indebtedness of about $4 million. Covert said he was assured by IRS officials that a legal statute requires money stolen from a public agency to be returned before any tax claims arc satisfied. School district officials estimate the amount allegedly stolen by Wagner may reach nearly $4 million. "AIDS hit the art community first .and hit it hard," said Rebecca Menes, a coordinator of the day's events. • Originally, "A Day Without Art" involved the shrouding of paintiJ9 and sculptures in museums to illustrate the deadly ~ucnccr of AIDS. That changed this year, and Menes said dte 'Pindox was intentional. "ft ii actually a celebration of art. It commemorates the artists w.ho have passc~ away or have been affected by others who have," said Menes, Orange County's Philhannonic Society ma rketing and communications manager. "The festivities wiU hor,efully encourage and ihcrease AIDS awareness in Orange County. ' 1\iolday's program was held in the amphitheater at the Pavilions <* die Lakes and included performances by T~ Many Bongos - a peramion aroup -Kirov Ballet's orchestra, Pacific Chorale Children's Chorus, a Master Chorale of prangc County tenor IOloist, Pacific Symphony Brass Quinter and the Overture Company of Opera Pacific.
