Dar Uening: NO, I disagree with your fetlow board member tn a Condo private con tr act Hotline . setting, a preliminary 20-day notice is required ol any potential mechanic's lien claimant other than the·originaJ prime contractor A contr~or Working 1n a direct contractual relationship with the association Isn't required to serve a pretiminary 2o-day notice. If ., there Is a oonstruction lender in your situation, the roofing contractor would be required to give the notice to the construction render. Because no preli minary 20-day notice was provided in this instance would not preclude the contractor from recording liens against the condominiums pursuant to Civil Code Section 1369. Typically, the homeowners association will have no knowledge of the identities of the subcontractors and materiaJ suppliers pr0\l1ding labor and materials to the prime contractor. Because the subcontractors and the material suppliers have statutory lien righb in the event they are not paid by the prime contractor, the purpose of the preliminary notice is to make the assoc1atJOn, the prime contractor, and the con truction lender aware of the ,>otcntial lien claimants, and to confirm these lien daimants have been paid, or at least at they have released their mechanics ·lien rights during the course ef the ~tion's progress payments to the prime contractor. A typical progress payment provision in a construction contract faYOrable to the aSsociation will provide that the payments to the prime contractor will be held unless the prime contractor can supply evidence all potential mechanic lien daims have been released. The preli minary 20-day notice is re<\uired to be personal delivered or. ~ certified °' registered mail within 20 days after the potential mechanic's lien claimant begins to supply work, tabor or materials. It also can be gjven before work or materials are furnished. Properly serving the notice protects the mechanic rien rights for all work performed after a date 20 days before the notice was mailed . On private works of improvement such as your reroof, the failure to provide the notice does not bar the lien daim entirely. Rather, it merely precludes all daim for work performed more than 20 days before the notice was actually gr..en. ~ The mechanic's lien statutes in California are extremely intricate and must be carefully (of lowed to protect the association's rights. The association's legal counsel should be contacted before any decision is made that may subject the members to lien claims against their condominiums.
