BY DAvtD H 1nn., STAPP Wann BALBOA PENINSULA -The Newport Beach Planning Com· mission hadn't voted yet at press time late Thursday on whethe r to allow a McDonald's to open on the Balboa Peninsula. About 50 residents turned out to oppose the restaurant, saying its proposed locatjon is a terrible place for selling Big Macs. "Would you wan~ a McDonald's built in front of your home?" resi· dent Kent Stoddard asked com· missioners. When residents applauded his query, Commissioner Harry Mer· rill replied, "This isn't the Nielsen ratings." The fast-food restaurant, which would include an indoor seating area as well as drive·thru and walk-up windows, would be situ· ated on a triangular parcel of land located between the northbound and southbound lanes of Newport Boulevard at 28th St. Two dilapidated, vacant build· ings and a dirt lot currently are lo- cated on the site. ,. Residents of 28th Street Marina Condominiums, many of whom would have a bitds·cye vi~ of the new McDonald's, have been vigor· ousty protesting the project since April. According to s1arr rcpons, the city received Jhrec letters from residents oppos· ing the expansion. Next, the matter was rc£erred to the cily Redevelopment Agency, which called upon police officials for background on the types of calls for service they receive from the Stas. The agency denied Tun· stall's application "in large part" because of the police department's comments. • Tunstall then appealed the deci· sion to the City Council -which doubles as the Redevelopment Aacncy -which denied the re· que" on Monday. "~ I view it, this was a request for a conditional-use permit to ex- pand a bar I that has problems," snid Councilman Joe Erickson. "There have been DUI arrests and an inordinate number of calls for service there. And, the ap· plicant tried to 'expand without ob- taining the proper permission. In my heart, I just couldn't approve it." The police dep:irtment claims that in 1993, officers we re called to the Stag Bar 60 times. And, po- lice said, 34 individuals who were arrested for driving under the in- fluence last year said they had been drinking at the bar. "I absolutely do not believe that," Tunstall said. "This bar is too small, and I know too many of the people. When somebody gets picked up here, we know about it. "The thing is, the Stag isn't the only business at 145 E. 19th St. There's also a liquor store down the way, and we get a lot of tran- sients hanging out in the parking lot and sleeping in cars." Now, Tunstall's beginning to wonder if the city has something against bars. A' lengthy legal battle between Costa Mesa and Goat Hill Javern on Newport Boulevard ended in 1992, when the state Supreme Court ruled in favor of the bar, al· towing it to remain open despite the city's desire to sec the estab- lishment close its doors for good. The Island Trader bar, once lo- cated on Newport Boulevard, fi. nally shut down after long-running problems with the city. Another popular saloon, Hogue Barmichacl's, moved its business to Newport Beach in recent years, after a history of conflict with the city and neighboring residents who complained about rowdy, noisy bar patrons littering and loitering in their neighborhood. "I'm not sure if they're trying to drive bars out of the city," Tun- stall said. "Out, it sure seems like , they're being very selective or \\ho they're going after -all· the older bars." ·1· 11 I S 1: I~ I I) _;\ 1 · ~1 11 ti s /\ · r t ; 1 { 1 ) I \ 1 · < ) N 1 ~ 1 · ·-··-tolmtllllelllml, lllhlon lllaW The Newport Beach Wolllen's Club will host a "Hometown, U.S.A." fashion show and luncheon at 11:30 a.m. July 5 at the Balbo:i Bay Club.
