While there have admittedly been some peCuliar, if not outrageous, ver- dicts, in the vast majority of cases the jurtes come to the right con- clusion. I speak with some authority. I presided over jury trials for 33 years on the Superior Court of Orange County, then reviewed Jury trials for 12 years on the Court of Appeal, then tried jury trials for three years in American Samoa, and am now back on the Orange County Superior Court trying jury trials. In all those years, I can count on the fingers of one hand the number of times I have dis- agreed with the dedsions of the juries. I am quite aware of some out- rageous jury verdicts, but I am equally aware that we judges have pulled a few bloopers our- selv~. No system is perfect, but for my money. the jury system \s the best. It is probably because of this long-lasting love affair with juries that the first magazine arti- cle I bad published ran in the old American Mercury in 1958 and was entitled-•1n def~ ol juries .• A nd so it was that I received quite a thrill when I beard recently that I bad acquired a certain doubtful immortality when my name sur- faced in the O.J. Simpson mur- der trial, this time -again -in defense of juries. I say, ·1 heard" because I have not been following the case. But several lawyers and judges who have told me that an opinion I wrote while on the Court of Appeal was dted by the prosecu- tion in arguing the admissibWty of the gruesome pictures of the Victims which the defense con- tended would inflame the pas- sions of the jurors. The district attorney apparent- fy said something to the effect at •A Justice Gardner said in eople v Long 38 Cal App. (3) at page 689, a case in which twas contended that the admit- ce of gruesome pictures ecessartly inflamed the pas- ions of the jury, "1\vo observations might be made: Murder is seldom pretty and pictures, testimony and 1>hysical evidence in such cases is always unpleasant: and (2) many attorneys tend to underes- timate the stability of the jury. A juror is not some kind of a dither- ing nincompoop, brought in from never-never land and exposed to the harsh realities of life for the first ti.me in the jury box. "There ls nothing magic about being a member of the bench or bar wbk:h makes these individu- als capable of dispassionately evaluating gruesome testimony which, it often ls contended, will throw jurors into a paroxysm of hysteria. The school district initially invested the huge loan in the county's · investment pool to make money on high interest rates, but the plan backfired last year when interest rates dropped and the county declared bankruptcy. The district borrowed another $11.296 million from the water district this week to tide itself over until the county repays $11 million in recovery notes, which was initially expected June 5. MWe have unofficial indication from the county that we'll receive cash from the recovery notes by the end of the week.• Though the water district loan can be extended for one year, Bernd said the district will repay it as soon as the funds from the. county are received. Newport braces for some belt tightening • City manager suggests putting off some capital improvement projects, slicing operating budget and cutting positions. By Evan Henerson, Staff Writer NEWPORT BEACH -City Council members and residents alike got their first collective look at the city's 1995-96 budget dur- ing the council's regular meeting Monday rught. The verdict: difhcult times call for difficult measures and not everybody will be pleased with all of the choices. In order to make up a $4 nul- lion defidt. City Manager KeVlil Murphy has recommended thdt the council defer $1.3 million in capital improvement projects for one year. He has also recom- mended eliminating $2.3 milhon from the city's operating bndget, raising $500,000 through new or increased fees and cutting 25 positions. Both Murphy and council members stressed that the pas· sage of this year's budget and next year's will involve major challenges. The city bad reduced its work force by 14% (108 posi· lions) over the past five years and there isn't much more to cut, according to Murphy. While the city will raise an additional $500,000 this year. increasing fees ,in upcoming years will also be difficult. Mur· phy said. School officials on Monday found that someone over the weekend had damaged the metal door on the recycbng bin -near a new padlock - making it impossible to get into the container. Kravette and bis partner, Amy Webster, came close to the Olympic dream in 1994 when they placed third at the U.S. Fig- ure Skating Championships and served as alternates to the winter games instead\. Monday Kravette, 31. shared his dream with his alma mater at the school's baccalaureate. Never mind that be didn't begin ice dancing until after be graduated. "It's kind of ironic to be back at high school making a speech when I did.n 't begin ice dancing until I was in college." Kravette said. Though Kravette tried on bis first skates in elementary school, he didn't pursue the sport because of its expense, he said. Kravette didn't begin skating seriously until he was 19 and attending UCl. He spent most of bis time practicing at the Costa Mesa Ice Chalet, he said. He planned only to be good enough to teach skating and put himseU through law school. "The county claims it needs nearly $2 billion to meet all of its obligations. Californians are among the highest taxed J)eople in the country, H the survey reads. "Taxpayers can not afford to pay for any new taxes to rescue the county's financial responsibilities." Bill Mitchell, chairman of Orange County Common Cause, believes surveys and question- naires frequently have a recog- nizable slant. "The way the question is framed usually indicates what the correct answer is," Mitchell said. Newport-Mesa Unified School District trustees are expected to pass the resolution in support of the half-cent sales tax increase at their reg- ular school board meeting at 7 p.m . at Harper Community Center, 425 E. 18th St., Costa Mesa. "The welfare of our children and our schools is too impor- tant to risk and we must rise above our anger and frustra- tion and join with leaders and citizens throughout Orange County to support Measure R as a realistic solution," states . the district's resolution. Some school officials are worried that they may not see the last 10% of the $80 million the district invested in the bankrupt county pool if the measure does not pass. The district has received about $60 million so far, with another $11 million expected soon. T he Orange Coast College women's swimming team showed that it sometimes pays to tum it on when it counts. The Pirates, who could manage no better than a fifth-place showing at the Orange Empire Conference meet just a couple of weeks earlie.r. were in the familiar position as champions when all was' said and done at the State Championships at Ohlone College in Fremont. It was the school's seventh consecutive women's state swimming crown and 11th in 12 years under Coach Don Watson. ---accused two1I1-e-dleyrelay- victories and a second-place finish in the 400-yard freestyle relay, as well as balanced scoring from six ipdividual swimmers and two divers, to pull off the victory with 388 points. Coast opened up a 26-point lead after the first day. then pulled away after that. Sophomore Erin Snow was named the school's Female Athlete of the Year led the way with second-place finishes in two individual events and was part of Coast's two winning medley relay teams. Meanwhile, the OCC men relinquished the state crown they had won at Cypress College the previous year, finishing ninth overall with 156 points, well : behind champion Gol~en West. Andreas Lindholm provided the Pirates with their only winner (male or female) by taking the 400 medley in 4:06.25. He was second in the 200 IM in 1 :55.66. In becoming the first player in OCC grid history to tum the trick, Clayton rushed for 1,065 yards and 11 touchdowns. He had 1,442 yards as a freshman, a school record. Clayton. named the Pirates MVP, also tied a school record with 216 carries last season. His 2,507 yards is tops in OCC history. Clayton played the final game, a 17-14 loss to Riverside, with three fractured ribs and still managed. 146 yards and two TDs on 31 carries. As a team, the Pirates, however, struggled to a 2-8 mark, going winless at home. It was Coast's worst football season since.the 1982 squad went 0-10 after forfeiting two victories. a Retirements: Dick Tucker and Bob Wetzel, two of OCC's coaching giants since the 1960s, announced their retirements as · full-time staff members. .Between.-them. are more than 60 years of teaching and coaching ~xperience at OCC. Tucker, 68, of Newport Beach, won more football games than any other coach in Pirate history, going 129-102-5 in 24 seasons (1962-85) and led the school to its only two state and national gridiron titles, in 1963 and '75. He was also the OCC athletic director from 1976-87. Wetzel, 59, of Costa Mesa. made his name in recent years as the most successful men's volleyball coach in the state, winning state titles in '87, '89, '90 and '91. He compiled a 225-71 career mark in 11 seasons before stepping down in 1992.
