By Carolyn Miller, Staff Writer SANTA ANA -The trial of a convicted rapist, eligible to be sentenced under the three strikes law, resumed Monday with the defense calling· upon six women who testified the defendant is not violent, regardless of his criminal history. . Dennis Alan Ferrier, 39, is on trial for burglary after he was allegedly caught sneaking into a Costa Mesa couple's ftpartment in May 1994. The couple believe that he might have had the inte{lt to commit rape as he lurked behind their bedroom door while they slept. Under the state4s three strikes law, Ferrier, on trial for his fourth felony, could be sentenced to 25 years to life in state prison, accor~g to Orange County Deputy District Attorney William Feccia. As they took the witness stand in Central Court Monday, a few of the female witnesses winked or smiled at Ferrier sitting calmly at the defense table. The .string of character wit- nesses included Ferrier's mother, sister-in-law, ex-wife, a friend and a teen-age pen pal. Each woman said they were aware of Ferrier's criminal histo- ry, but they have never known Ferrier to be violent. Nor did they believe Ferrier was capable of committing the 1979 rape of a 23- year-old Costa Mesa woman, even though he was convicted of the rape in 1980. Ferrier was also convicted in 1984 and 1987 for burglarizing two homes occupied by women. By Julie Ross cannon, Staff Writer NEWPORT-MESA -School district officials said Monday they won't test student athletes for drugs, despite a controversial U.S. Supreme Court decision giving them the green light. "We don't have any plans to drug-test athletes at this time," Newport-Mesa Unified School District Superintendent Mac Bernd said, stressing the district's "zero-tolerance policy." "We've got strong policies against drugs, and our canine deterrent program is a plus. An increase in our anti-drug effort would not come from a Supreme Court decision, but from our assessment of conditions and problems in our district," he said. The high court ruled 6-3 Mon- day that public school athletes have a reduced expectation of privacy and can therefore be required to undergo drug testing, even if they are not individually suspected of drug use. : Bernd said that while the dis- trict doesn't plan to act on the court's ruling, he is encouraged by the court's direction; "If we see we have a problem· in the future, at least we'll have the legal basis for (testing stu- dents,)" he said. "At this time and in this community, it's something I don't think we need to look at." Reaction' from Newport-Mesa athletic directors and coaches was "We're at an age and a time when kids are supposed to be getting educated ," he said. "We're dealing with 15, 16 and 17 year olds that need our trust.• While he does not object to drug-testing in the professional workplace, '!We it said public schools are a different matter. Mandatory drug testing would be an invasion of a student's privacy, he said. By Carolyn Miller, Staff Wr;ter COSTA MESA -Nine armed police offi- cers swarmed a tidy gray and white house on West 18th Street early Monday to make an arrest in a May drive-by shooting that had investigators working overtime for weeks to solve. One offi<;~r nodded his head, signalling action that was executed with an adrena- line-charged speed: warnings to take cover wer e shouted at the occupants inside, fol- lowed by a swift swing of a sledgehammer and the resounding thump of a broken lock. Within seconds, 18-year-old Jose Angulo was arrested and charged with conspiracy to commit murder and attempted murder. Police said Angulo is a dangerous gang leader suspected of masterminding the May 16 drive-by shooting on Shallmar Drive that left two teen-agers wounded. By Evan Henerson, Staff Writer NEWPORT BEACH -Post- poning a few key elements until they could undergo further study, the Newport Beach City Council Monday night approved its bud- get for the 1995-96 fiscal year. At the request of several local cultural organizations, the coun- cil approved a $40,000 allocation of arts and cultural grants. Mayor John Hed ges had attempted to cut the arts grants funding from the budget for d • second consecutive year. Hedge!> said he believes that during tight fiscal times, government has no business supporting activities which should be tter be supported by private entities. The mayor was the lone dis- senter in the vote to award the grants. The council will not pursue a proposed expansion of the City Hall parking lot until city staff determines the success of shared parking with the adjacent St James Episcopal Church. The council also postponed decisions on whether to extend the hours of two branch libraries and a decision to eliminate all commuter vehicles used by city employees. Both items, the coun- cil decided, need further study. Councilwoman Norma Glover requested that $86,620 be used to open the Mariners and Balboa branches of the library for an extra day per week, but the coun- cil did not want to allocate those funds until staff had completed an extensive study into the use of the library syste m by non -New- port Beach residents., The council also decided tha t the use of commuter vehicles needed a thorough study before the city arbitrarily eliminated the current system . CITY SID Construction on streets, freeway ramps to begin By Tina Borgatta, Staff Writer COSTA MESA -Two sec- tions of Bristol Street will be bustling with construction crews beginning next month, when crews begin work on roadway improvements for the Costa Mesa, Corona del Mar and San Diego freeways. And in the fall, crews will begin repairs on eight stonn- damaged streets. The freeway work will include construction of a single- span bridge over Bristol Street linking the northbound Costa Mesa (55) Freeway to the south- bound Corona del Mar (73) Freeway. It will also include widening the Bristol Street bridge at the San Diego (405) Freeway and adding lanes to freeway on-and off-ramps near South Coast Plaza. "The more difficult project traffic-wise will Se the Bristol- 405 interchange because of the volume of traffic that normally goes through there," said Bill Morris, the city's public services director. ·And we want to make sure that we don't discourage anybody from coming into that area, particularly to shop." Morris said crews will con- duct the bulk of their work on weekdays during non-peak traffic hours. ·They're not going to be doing any work on weekends because that's usually the heav- iest time in that area," he said. ·And we're g_oing to watch things very closely during the afternoons. "That's not to say there won't be some disruption, but we've really put a lot of thought into this to try and keep it at a mini- mum. The work will Ukely taper off dramatically during the holi- days. •Hopefully by that point,. all the work on the on·ramps and off-ramps will be done and the only thing left after Christmas will be the widening of the existing Bristol Street bridge,• said Morris. Those improvements should be completed by April of next year. Work on the Costa Mesa and Corona del Mar freeways will probably finish a month or two before that. "There may be a few occa- sions when we might have to bring traffic into one lane," Morris said. "But it won't be anything major.• The cost for both freeway projects will be covered by agreements with the Orange County 1Tansportation Authori- ty, Caltrans and the 1Tansporta- tion Corridor Agencies. The city street repairs will be covered by federal emergency relief funds and will include paving and structural repairs in the following areas: • Fair Drive between Harbor Boulevard and FaiMew Road. • Placentia Avenue between 19th and Hamilton streets. • Baker Street between Har- bor Boulevard and Royal Palm Drive. • • South Coast Drive between Fairview Road and the San Diego Freeway. • Sunflower Avenue between Hyland Avenue and Harbor. • MacArthur Boulevard between Harbor and the Santa Ana River bridge. • Redhill Avenue between Bristol Street and Baker and between Pullman Street and Airport Loop Drive. WEST SIDE -City officials have hired ·Tustin-based Kabbara Engineering to develop plans for repairing two alleys that parallel James Street between Wallace and Pomona avenues. The lanes provide access to apartments and homes in the area. And for years, resi- dents and property owners have com - plained to City Hall staffers about their dis- repair. .. When it rains, those alleys get so nood- ed that you just about nee d a boat to get through there," said Mayor Joe Erickson. •The situation really is bad, and U'le }lrop- erty owners haven't really cooperated." But city officials think they've developed a course of action to facilit4te the repairs without the use of taxpayer money. Once the Kabbara engineers complete a design plan, city officials will pitch it to the property owners whose homes and apart- ments border both alleys. If the property owners approve the plan, the city will establish an assessment district to cover the cost of construction. "It's a way of getting the property own- ers to work together under the direction of the city. JUNE 27, 1995 • Sc~ool money matters again on board agenda By Julie Ross Cannon, Staff Writer NEWPORT-MESA -School board members will hear details tonight on the Newport-Mesa Unified School District's 1995-96 tentative budget. The budget includes an expected $85.3 million in revenue and transfers, including $4.5 mil- lion from the sale of the Bear Street School site, and an expect- ed $81.8 in expenditures, accord- ing to Mike Fine, director of fiscal services. The district anticipates a $5.2 million ending balance for reserves. The budget will be finalize4 in August, Fine said. Trustees are expected to adopt the tentative budget following a public hear- ing. Other items on the school board's agenda include: • Prioritization of a list of bud- • get items for possible future rein- statement. The district shaved about $3.1 million from its budget earlier this year after the county bankruptcy. • A vote on whether the district should eliminate transportation services for students in grades 9- 12. CUrrently, high school stu- dents living two miles or more from their school can purchase a bus pass for $150 per year. • A discussion on the adjust- ment of trustee areas. According to the 1990 census, Trustee Area 1 contains 9% of the district's vot- ing age population while Area 2 contains 21 %. The district's legal counsel, however, says the distrlct is not required to rearrange the bound- aries. • The appointment of four community members to the dis- bict's investment advisory com- mittee. Thirteen residents have expressed an interest. · The school board meets at 7 p.m. today at Harper Community Center, 425 E. 18th St., Costa Mesa. Andy Gonis. The assault occurred around 11 :30 p.m., after a verbal dis- agreement erupted between Foss and the 300-pound security guard, according to police reports. I thought it might be of some interest to serious historians to describe the first bars in Balboa after the repeal of Prohibiti~n. The first bar to open and change Balboa's drinking habits from straight alcohol to whiskey and gin (vodka came much lat- er) was Bill Ireland's. Bill had a modest hamburger joint on Ma.in Street where the parking lot for Dilhnan's now is located. His place consisted of an open- air grill in front, from which most of bis hamburgers were sold to the walk-by trade, plus six stools inside for the gastro- nomical elite, the sit-down trade. In back of the place was a sand lot. With the repeal of Pro- hibition, Bill simply put some chairs and tables on that sand 1ot and, viola, an instant outdoor bar. Bill's real conbibution to the art of drinking was his justly famous Bal Rum Boa, four two- ounce jiggers of rum in some kind of a fruity mix to give it a Polynesian touch. It sold for 7 5 cents, which was a bargain since regular drinks went for 25. There was no limit on how many Bal Rum Boas one could robe rt gardner buy, but history does not record a single instance of anyone fin- ishing more than two. Bill finally sold out to one of our local gamblers, Bob Mur- phy, who re-named the place the Bamboo Room, put some bamboo and some fish nets in it and it became a true Polynesian bar, although Bob discontinued the Bal Rum Boas. He was too careful a businessman to keep such an obvious loser on the menu. Then there was the Blue Room on Palm Street near the ferry landing. When Mickey and Hank Walker built the Balboa Inn in 1929, Gus Tamplis, who had a small hamburger joint next to the alley on Ma.in Street, bad to move. He moved to the comer of Main and PaJ.m and named his new place Gus's Sea Sl,lell Cafe. When Prohibition was repealed, Gus opened a bar in the back of his place since it was rtgbt across the alley from the Rendezvous. It was an instant success as musicians and dancers would dash over for a quick one between dances. Gus had the first juke box in town. It had a peculiar history. Some electrical genius discov- ered that instead of putting nickels in the box, if one stuck two pins through the electric cord that ran into the box, one could simply pull those two pins together and every time they touched, it had the same result as though a nickel had 'been put in the machine. That was great for awhile. Then the owner of the machine, the same guy that ran the slot machines and punch b oards in town, began to wonder why there was no money in the machine's coin box yet the Benny Goodman records were getting gray from usage. So he fixed the electric sys- tem so the next time someone put the two pins through the cord, the guy that did it got two badly burned fingers and blew out all the lights in Gus' place. The first place to give the town some real class was Art LaShelle's Christian's Hut on the Bay Front at Alvarado. Art not only sold the best drinks and best food in town, he had the best bouncer in town, Don Vaughn. Don was not only 6 feet, 8 inches of brawn and muscle, be had a distinctive way ol throwing out an obnoxious drunk. He would carry the guy out of the place, across the sidewalk, out on the pier and throw the guy into the bay. As I say, Art LaShelle brought real class to the town. Walsh, among the leaders in bringing the Senior PGA Tour (Toshiba Classic) to Mesa Verde last March, was reportedly asked to step down by the flnance and management wings of the club's board of directors. "There bave been dbout a dozen gen- eral managers (at Mesa Verde) in the last 20 years. Walsh outlasted them all," said one source, closely connected to the club. Walsh established himself early 1n his golf management career at Laurel Valley Golf Club in Ligonier, Pa.. a course designed by Arnold Palmer, a personal friend of Walsh's. ·(Palmer) has his baby shoes bronzed on a coffee table in his home. Byrne, who has signed with North Idaho College, among the nation's premier junior colleges in Coeur d'Alene, Idaho, scored 19 points, grabbed six rebounds and blocked a pair of shots on Sunday for Orange Councy, as the visitors defeated the Tri-County All- Stars, 116-93, at Dos Pueblos High in Goleta.
