SUIT CONTINUED FROM 1 •The investigation bu revealed that the police officers who detained and arrested Mis. Slater apparently had no other information about the suspect in the crime other than that she was black and female,• Christopher Mears, Slater's attorney said. "This says she was stopped because of her race." The lawsuit contends that if Slater had be~n white she would not have been stopped, ques- tioned or arrested. Ttierefore, she was acres~ without probable cause by o icers whose con<4Jct she claimed as "done with mal- ice, oppression and fraud,• according to tlMr lawsuit. l Slater filed a claim against the city in December but the city rejected that, thereby inviting lit- igation, Mears said. Costa Mesa City Manager Allan Roeder said there were "significant discrepancies• in Slater's comments as to what did or did not take place dwing the incident. For example, the 45 minutes Slater claims she was kept by police is far greater than the time police computer i;ecords indicate, he sci.id. State officials say they are seeking a court order. By Julie Ross Cannon, Daily Pilot CRYSTAL COVE -Eviction Day has come and gone, but residents in th.is tiny 45-cottage enclave have not made a step toward abandoning their homes. State officials, who have extended the res1-.. dents' lease agreements in the past, told the beach dwellers last month to vacate their homes by Jan. 1. The resid~nts, many of them living in cottages passed from generation to gener~tion, have refused to leave. HWe're trying to do everything any other homeowner would do to save their home,• said Stella Hiatt, 71, who has lived in her shingled cot- tagefor nearly 20 years. But the residents aren't average homeowners. Most of the cottages, located on· the state- owned beach between Corona del Mar and Lagu- na Beach, were built in the early 1930s when the land was owned by The lrviDe Co.
