One of the boys, a senior at Estancia High, also is charged with possession of morphine and Vicadin, a prescription painkiller, said Joe Dagostino, who handles juvenile cases for the district attorney's office. NEWPORT BEACH -A lawyer for the family of a Newport Harbor High School student killed in a traffic accident last year said Tuesday t.tiey are will· ing to drop their lawsuit against the city if it ~pain a curvy section of Irvine Avenue where the wreck occuned, injuring nine other students. Eventually, some original programs such as •Praise the Lord• will be taped there an~ sent via satellite to the network's· 600 broadcast affiliates around the world. Last month, the city Planning Commission allowed TBN to begin serving food prepared in an existing kitch~ to the thousands of visitors who come from around the world to the site each month. The kitchen and cafeteria already are open seven days a week, but only to network staff. No a~ expansion of the kitchen or cafeteria is planned. To augment its food service, file Planning Commission also approved allowing TBN to bring a catering truck onto the property to sell light snacks, drinks and hot meals to visitors and employees. Cowan said she supports council approval of opening the cafeteria to the public, but that it should reject the request for a lunch wagon. •There's no picnic fadllties there,• she said. Planning Director Patti Temple presented the results of a sign inventory that lpgged the status of nearly 1,000 signs on the peninsu- la. The study was mandated by the council last year as a way to possibly improve the look of the peninsula by cleaning out illegal and abandoned signs. The council agreed Monday night that rather than enforce the existing 1970s' law on the ·signs without tjty permits, it should cre- ate an uP<iated set of guidelines that could beautify the peninsula. In the meantime, the council directed its staff to crack down on the peninsula's abandoned signs. It also would give the Planning Commission a tool to control existing busmesses found to be public nuisances by requir- ing them to obtain permits under the new law. The City Council voted 6-1 Monday to support bills that would protect its revenue base. If the fee iS repealed and the revenue is not replaced, the dty could lose about $2.8 million each year. Councilman John Hedges said no one should be opposed to the return of taxpayers' money and argued that the city should stay out of it. But other council mem- bers said while they, too, would rather not pay the vehicle license tax, they have to do what is best for the city. FAIRGROUNDS -A civil tri- al of a lawsuit by the Orange County Fairgrounds to rescind its 1993 purchase of the Pacific Amphitheatre is in its fifth week and testimony is expected to last through the month. The 1995 lawsuit by the 32nd District AgricultW'al Association -the state agency that runs the fairgrounds -alleges that the former owner, the New York City-based Nederlander Organi- zation, knowingly sold a concert venue that cannot be used because of noise restrictions. To settle lawsuits brought against the fairgrounds and Ned- erlander by some residents and the city of Costa Mesa, noise restrictions were imposed in 1987 to limit the amount of sound that legally can be produced at the outdoor venue. In 1993, ~ fair agreed to buy the 13,500..seat amphitheater for $12.5 rnilllon, but claims Neder- lander should be forced to return the money because the fadltty is useless under the court order to lowering decibel levels. Nederlander bas denied any wrongdoing in the sale of the venue, which has been closed since 1995. · In addition to the $12.5 mil- lion, the fair also is seeking unspecified additional damages. In addition to a spate of new books on our last holy war, a dozen. movies also are now in the works. So it seems especiAlly appro- priate to commemorate an event that happened 56 years ago this month. That's when the only American ground forces to hold up the original Japanese offen- sive surrendered on Bataan peninsula and Corregiclor Island m the Philippines and set in motion one of the great tragedies of that war: the Bataan Death March. When the Japanese attacked Pearl Harbor, they struck simul- taneously on a dozen other fronts. One of the most vital to the Japanese plan of conquest was the Philippine island of Luzon and its critical Manila har- bor. A substantial American-Ffi- ipino army under the command of Gen. Douglas MacArthur stood in their way. While Japan- ese invaders achieved rapid early success elsewhere, the going was tough on Luzon. Finally, four months after Pearl Harbor, the Americans had been forced in'to a tiny peninsula called Bataan. 111ere, hungry, badly outnumbered and out- .gunned, and dispirited by the knowledge there would be no joseph n. l. bell reinforcements, they surren- dered. MacArthur was evacuated to Australia to fight another day, and although some 2,000 Ameri- cans escaped to Corregidor Island, it also fell a few weeks later. The Japanese took 12,000 American prisoners on Bataan and 15,000 more on Corregidor. The Bataan.prisoners - including almost 60,000 Filipino soldiers -were weak and ema- ciated from their long struggle. But iplmediately after their cap- ture, they were forced to march 55 miles to a distant railhead under the most inhuman condi- tions. More than 2,300 Ameri- cans and almost 10,000 Filipinos died on that march, and the gen- eral who ordered it was tried, found guilty and executed after the war. 'The Bataan Death March became a rallying ay for Ameri- cans as we twned the war around. And when MacArthur returned to the Philippines almost three years later, one of bis first acts was to ftee the sur- vivors o! the death march. That's when I g<*involved. · I was a pilot in the Naval Air naasport Service, mostly flying wounded out of combat areas in the Pacific. In the summer of 1945, my crew and I we.re sum- moned to the C.0.'s office before heading out on what V(,e thought was a routine flight from Oahu to San Francisco. We were told that our cargo was very special. We were flying the first contingent of released Bataan Death March prisoners on the final leg of their journey home. I watched them boarding from the cockpit: drawn, gray-faced, skeletal men who neither changed expression nor spoke. They just filed solemnly aboard with none of the elation I expect- ed to see. When we were airborne and the other pilot was flying, l went back into the cabin to get a clos- er sense of tl)ese men.
