West's decision to rebid the heart ~uit rather than show the secondary five-card club suit resulted in a lay:. down five-club· contract, .berng missed. North judged well to jump to four &(Jades with five-card support nnd a singleton. Looking ot two prob- able diamond tricks and shortness in opener's suit, it is ha.rd to fault East for doubling. · Wei.t lc<l the singleton-diamond, take by East's ten. &lst's decision lo continue the sun when South was Oeclurer ruffed the J1am11nd hi~h. crossed to dun1my with a trump, in the process extracting both the out- standing fangs. There followed in quick order the ace of clubs, two club ruffs in dummy and two more dia- mond ruffs 1n hand, which stripped the side !;uitS from both hands, and declarer had laid the groundwork for another enem¥ faux p~ Declarer exited with a low.heart It should have been obvious to West that declarer could not hold the king of hearts -with lhal card declarer could h.ave arranged t<> lead a heart toward the closed hand. So West should have shot up with the a.cc of hearts, swallowin~ partner's king in what is known m the trade as a Crocodile Coup. That would allow West to cash two more heart tricks for a one-trick set. Instead, West inserted the jack and East won the king per- ' force. On the forced minor-suit return. declarer was able to discard a heart from hand while ruffing in dummy, aod the losses were limited to two heart tricks and a diamond. Defend The Bay is delighted to share news of its recent. victory over the lr\rine Ranch Water District (IRWD) with our cornjllunity, and to thank the literally thousands of people who made it possible. . . . On October 7, 1998, Def end Tlie Bay obtained a State Superior Court ruling invalidating IRWD's permit to du1np treated sewage into ewport Bay, i~sued by the Regional Water Quality Control Board (RWQCB). IRWD is now fighting to resurrect the permit before the RWQCB, and Defend The Bay's next <late in court is December l ltli. We will need the continued support of the community if we are to s uccessfully oppose IRWD's plans. The Court ruling is just the beginning, and IR~'D is just one of many dischargers in the watershed, though perhaps the most egregious. There are numerous additional ups tream polluters whose cumulative impact has impaired th e health of Newport Bay for decades. ' Examples include the commercial landscape nurseries whose fertilizer and pesticide-laden runoff is allowed to flow into the bay untreated. Other communities enforce mandatory wastewater recapture programs, and allow absolutely no poliuted runoff to enter public waters from commercial nur ·eries like the ones in the Newport Bay water ·hed. Defend The Bay is s triving to bring this same level of protection to our bay. Defend The Bay also continues to work with the RWQCB to help set pollutant limits for pesticides, heavy metals and bacterial pathogens entering .the hay. We have been f uncling nationally respected scientist to provide th RW.QCB staff with accurate scientifi · advice during this process. Their advice i~ necessary to counterbalance the often biased input provided by scientific consultants hired by would-he polluters. Remember, the RWQCB re li ed almost exclusively on the rec~>·mmendations of IRWD's paid consultants \\hen they originally approved IHr D's now invalidated pern1it. We believe high quality independent· science is critical lo high quality regulatory decision · . making, and Defend The Bay is the only ~nvironmental group now providing balanced science in this arena. . We incerely, hope our achievements und work thus far will b the catal ':st for an evoh.a tion of public and government attitudes toward the prot ·tiq,n and restoration of Newport Bay. and that our future effort!S are worthy of your ~ support. ~ incerely 'BJ.~tbl Bob C:::a ustin · ~Qunding Director Def end Th Bay • • /: I .. .. .. ··-. WHAT DEFEND THE B AY HAS ACCOMPLISHED1 . . + In State Superior Court, invalidated The Irvine Ranch Water District's (IRWD) permit to dump treated sewage into Newport Bay. · + Obtained a federal court consent decree that requires the U.S. Environmental Protection Agency (EPA) to establish Total Maximum Daily Loads (TMDL) for pollutants allowed to enter Newport Bay, in the event the RWQCB fails to do so. + Challenged the RWQCB's ~ssuance of a pollution discharge permit to Silverado Constructors. . . + · Provided independent scientists to assist the EPA and the RWQCB in setting the TMDLs for the.phosphorus, nitrogen and sediment entering Newport Bay. ) + Provided independent scientists to tes~ify before the RWQCB, countering the scientific assertions of polluters' paid consultants. + Raised awareness of water quality issues and the need to protect Newport Bay. WHAT IS IN DEFEND THE BAY'S FUTIJRE1 . . - + Continue to monitor and oppose IRWD's permit if they go forward with their expected . appeal. + Continue to educate and iilf orm the public of the water quality issues affecting public health -and Newport ~ay. + Provide independent scientists to assist the EPA and the RWQCB in setting the TMDLs for heavy metals, pesticides and bacterial pathogens. . . + Identify sources of pollution entering the bay, and eliminate these sources by enforcing existing laws which have been ignored for years by the polluters. . + Work to require the commercial landscape nurseries to recycle all of their fertilizer laden runoff, instead of allowing it to flo,v into Newport Bay. + Establish an informational and action network of like minded people who are concerned about Newport Bay's future. Our goal is to effect an evolution of attitude among decision makers regarding issues that impact Newport Bay. + Work ·with university professors and graduate students to analyze the pollution .. problems and potential solutions within Newport Bay's watershed. f'AJO t>UBUC EOCC\flO~ ANNOll~CF.MFNT • • , .
