By Susan Deemer, Daily Pilot COSTA MESA -Critics of a new ordi- nance banning llcensed and unlicensed sidewalk vendors and pushcart operators from residential areas believe the outright ban unfairly targets the mostly Latino entre- preneurs. ..,,,, The ban, which would go into effect 30 days after it's officially adopted April 21, is based on negative reports Crom both city code enforcement officers and police offi- cers. A similar ban was not approved in 1991. but stiff regulations were approved that year. Although initially it was noise problems that prompted the oty to take action, city officials say a threat to the public's health and safety from unsanitary food prepara- tion, trespassing and traffic hazards prompted the ban. Maria Alvarez 1s among those residents who live in the Shalimar Drive area who say they don't mind the noise as long as it is not at night. Many residents depend on ven- dors to bring them food, she said. Some worry the ban will hurt individuals like ice cream vendor Jose Estrada. As the 58-year-old made his rounds Tuesday aJong Shalimar Drive, his bell ring- ing drew customets to frozen Bomb pops and drumsticks. Estrada took the job not only to make money, he said, but because he likes the exercise he gets walking. "The law is the law," Estrada said in bro- ken English. "I will look for another job." Nesto Bollnela, 40, came out to buy a chocolate ice cream bar when he heard Estrada ringing his bell inside· the courtyard of his apartment complex. •Basically the people that complain are Caucasian," he said. "Those people (ven- dors) ma.Ke something in order to live. To work. We cannot complain about it and even we buy the stuff sometimeS" to help them.• City Councilwomal! Llbby Cowan, the lone council member who voted against the ban Monday, said city officials failed to prove the push cart operators pose a signif- icant risk to residents. "We have taken away another ability for someone to make a living," Cowan said. "We should be doing code enforcement." But City Councilman Joe Erickson said he supported the ban based in part on resi- de}lts' complaints about noise. Erickson, however, admits there is no "bulletproof evidence" people will become ill from the food. "Push carts are like a telephone solici- tor," he said. "They come into your neigh- borhood, they make noise and leave trash." City Code Enforcement Officer Sandra Benson has reported numerous citations, including incidents involving vendors who sell cream cheese or other food prepared in their kitchen sink or bathtub. Additionally, vendors have been cited for selling com on the cob, tamales and tortillas prepared under unsafe conditions. Benson's report showed that from July 1996 through February 1997, 38 citations were issued to illegal pushcarts selling items such as com, tamales and ice cream. Matt Gugilelmo, president of Fairview Family and Friends, explains that developmentally j disabled clients are at risk. He said the state's 21 regional centers are responsible for transferring clients from state hospitals into community homes. Lowe, married on Feb. 14 in New· port Beach Michael Ober, a former New- port Harbor High School and Orange Coast College football player, died Monday of skin cancer in a central California hospital. He was 49. Mr. Ober came to Newport Beach with his family in 1952. He attended Newport Harbor High, where he became a foot· ball team standout, before grad- uating in 1964. He continued laying football as he went on to attend Orange Coast College, Whittier College and USC. His local friends remember him best for making the win- ning touchdown in a critical Newport Harbor game against· Anaheim, his mother, Polly Ober, said. After graduating from col- lege, he moved to Hawaii, where he worked for 10 years. An ordained minister, he worked in real estate near San· ta Barbara until he fell ill. He and bis wife, Lynda, recently celebrated their 24th wedding anniversary at a Hawaiian· themed party, his mothe~ said. He died in an emergency room near his home in Solvang. "He'll be remembered as a legend, a gutsy guy," his moth· er said. •He sbould've died months ago, but he made it this far because of his strong con- nection with God." Mr. Ober is survived by his wife; three children, Adena, Michael Jr. and Caleb; his sister, Patsee; and his mother. Memorial services are sched- uled for 11 a.m. Saturday at Santa Ynez Valley Presbyterian Church, 1825 Alamo Pintado, Solvang.
