SAN QUENTIN -The smil-
ing, apple-cheeked killer has
one of the kindest faces on
Death Row. He says he has
found God, that the speed
freak who raped two Orange
County women and killed one
of them in late 1994 has
already died.
While he admits possessing a
gift for manipulation, he claims
he copped to the crimes because
it was time "to start being a reaJ
person instead of this made-up
one."
Yet as he sits in
the visiting room
at San Quentin
State Prison -a
place where hard-
faced, denim-clad
killers munch
vending-machine
popcorn with their
families -26-
year-old Eric Wayne Bermett
seems to offer only fragmentary,
carefully edited glimpses of tum-
self.
The former carpet installer
appears anxious to convey the
impression of an essentially
decent man -a man with a wife
and two young sons -driven to
terrible things by a metharnphet-
amine addiction. He does not
explote the underlying appetites
the drugs worked upon, and lis-
tening to him long enough
makes it almost possible to
believe he Ls the benign surf
bum his face shows.
Skeptics will note Bennett is
practiced with disguises.
He fooled 50-year-old Mane
Powell-Evans, who apparently
had no int1mation of menace
when be arrived in Sept. 1994 to
install the linoleum m her new
Laguna Hills condo. When police
found her bludgeoned and most-
ly naked body two weeks later,
Bennett's phone number was sit-
ting on her kitchen counter.
"She probably thought be was
the nicest guy," says the victim's
daughter, Christy Hougan. ·He
looks like the boy next door.·
He also fooled Pamela
Braswell, 43, the Costa Mesa
neighbor he raped at knife point.
When she trted to identify her
attacker in a police lineup, she
saw Bennett and thought of a lit-
tle boy who needed his IJ)other.
"I think, 'What about this man
would have tipped me off?'•
Braswell says. •And there's just
nothing."

In the old days, holding
court was a trial in itself
Rr 20 years. Orange County
bad three judges of the
superior court, and each had
a courtroom. Then. in 1941, a
new judgeship was credted, and I
was appointed as the fourth
Judge. What to do with a fourth
1udge when there were only
three courtrooms? The answer
was easy.
The tnal calendar was called
m Department 1 of the old court-
house. Frank West, the presiding
Judge, would intone, "Smith vs.
Jones.· The lawyers would cho-
rus, "Ready for trial, your honor.•
West would say with a grin.
"Judge Gardner, identify your-
sell. • I would stand and hold up
my arm. West would say, "Ladies
and Gentlemen, that is Judge
Gardner to whom your case is
assigned. Follow him."
I would then lead the attor-
neys, their clients and my staff,
together with all prospective wit-
·nesses, out of the courtroom. If it
was a Jury tnal, 20 to 25 prospec-
llve Jurors would come along, too.
We would then begin a search
for a place to try the case. The
hrst stop was the Board of Super-
visors heanng room in the court-
house U that room was being
w.ed, we would lake off for the
Santa Ana City Hall some five
blocks away and use the City
Counal Chambers for our trial.
U that was not available, we
would go on a couple of blocks
more to the American Legion
Hall With court staff, lawyers,
witnesses and jurors, we present-
ed quite a sight as we marched
through downtown Santa Ana in
search of a courtroom. It was like
a small parade. All we needed
was a marching band and some
. baton twirlers. On nice days, we

sometimes tried the case on the
lawn in front of the courthouse.
After about a year of that pra~
tice, the county built me a fourth
courtroom in the courthouse.
However, in the meantime, a
mass migration of everyone from
Bismark to Biloxi was headed for
Orange County. With the
increased caseload, new judges
were appointed. We couldn't
have 20 or 30 judges wandering
around downtown Santa Ana
searching for places to try cases,
so the county began to buy
church buildings it converted to
courtrooms.
By the time the new court-
house was built in 1966, we had
about 25 judges trying cases in
converted church buildings. Now,
instead of telling the litigants to
follow judge so and so in search
of a suitable place to try their cas-
es, they were told to report to
Department 20, which was locat-
ed in the basement of the Church
of the Redemption. That was
located at the comer of Fifth and
Ross streets in Santa Ana.
Those were the fun days.
Somehow, no one took him self
too seriously. Oh, we took our
jobs seriously, but not ourselves.
We shared a kind of laid-back
attitude born of sb4red incanve--
nience. An example will suffice.
A new judge was appointed
He was one of those gw:ig ho
people wbo took himself and his
new job very seriously. He was
shocked at the casual way we did
things. And so, at our annual
meeting, in the ~nt of one
of our church buildings, be pre-
sented a set of court rules for all
of us tQ follow. In so doing, he
deaied the •slipshod way• in
which we operated.
After his presentation. one of
the older judges said, •1 move
that we continue in our old slip-
shod ways." His motion was car-
ried by a vote of 20-to-1.
I am not back on the superior
court trying cases in the "new"
11...story courthouse that contains
almost 70 courtrooms. There,
each judge has a courtroom. All
he or she has to do is step off an
elevator to get to his or her court-
room. We also have court rules, a
book about three inches thick.
However, the courthouse suf-
fers from what it called the curse
of bigness. For so~e reason.
which I am unable to explain, it
lakes longer for a panel of jurors
to get from the jury assembly
room on the first floor to my old
courtroom on the third floor than
it did for a jury panel to get from
the old courthouse to the Church
of the Redemption five blocks
away. So much for the march of
civilization.

Teens arrested after
crashing stolen car
Three Santa Ana teenagers
crashed a stolen Toyota Cressida
into another car on Balboa Penin-
sula early Sunday evening,
according to police.
A 14-year-old boy was driving
the 1982 Toyota, with two other
teens, ages 14 and 17, riding as
passengers when it crashed at
5:30 p.m., according to Newport
Beach police Sgt. Steven Shul-
man.
The boys were anested on sus-
picion of auto theft and will be
charged in juvenile court, Shul-
man said. No Qne was injured.

While Braswell escaped and
lived to give her account. only a
badly beaten body and a blood-
drenched condo suggested what
happened to Marte Powell-Evans
two weeks later. Police fO\Dld a
shocking scene: blood on the
kitcb.en floor, in the bedroom, in the
bathroom and on the stairs, with a
wet towel, television and pillow
stacked inexplicably on the victim's
bead
Until now, Bennett bas never
spoken publicly of what happened
on the night of Oct. 13, 1994, when
he climbed through her kitchen
window. His accoWlt is fractured,
chronologically muddled and large-
ly uncorroborated, but the details he
includes -and omits -are telling.
A KILLER'S ACCOUNT
It all unrolled as if m a movie,
Bennett says: Remembering the
crtrne is like watching a character in
a show.
·1 can see my~eU doing it, but I
can't feel myseU doing it,• he says.
Sitting in his Toyota pickup after
work, he smoked aystal meth from
the glass pipe he'd jerry-rigged
from a beveled, decorative light
bulb shaped like a name. His wife,
Karen, found him at the Stag Bar on
the Newport Penninsula late that
night, drinking hard. She wanted
him home with the kids. He made
her go away.
His meth supply exhausted, he
drove to his dealer's home in Costa
Mesa. The dealer wasn't there, and
Bermett ·failed trying to talk the
dealer's girlfriend into sex. He
decided to dnve lo his home town,
Fdllbrook, where he knew he could
hnd drugs.
Yet somehow, on the way there
-he says he doesn't know how -
he wound up at lhe Laguna Hills
condo of the lady whose flooring
he'd installed. She was surprised lo
see tum. Again he fdiled to talk his
way mside for •consensual" sex.
He sat in his pickup at the condo
complex and drank from a 12-
ounce bottle of beer He smoked
cigarettes. He wandered around
the complex. Then he climbed
through Powell-Evans' kitchen win-
dow, found her in the downstairs
bedroom and raped her.
"That part wasn't violent,· Ben-
nett says, then adds an after-
thought: "Except it was a rape.•
The rape over, he says, she
offered him a soda. Upstairs, in the
living room and kitchen area, the
meth-fog that had been gripping
him burned off long enough for him
to realize he'd done something hor-
nble. He wept with remorse. He
UlS1sted she call 911. He told her to
go to the phone. She had to walk
past him to reach it.
Before she could dial, h e
slammed the receiver down. He
grabbed her as she tried to run, and
she bit him on the band. He
reached for the first thing at hand -
a teapot -and smashed her on the
head with it.
OUT OF CONTROL
At this point Bennett's narrative
becomes mostly incoherent.
Though he remembers returning to
the bedroom with her, grabbing a
glass decanter and striking her with
it, he says he doesn't recall any
exchanges of conversation. He says
the situation "snowballed" out of
control.
"I think that's why she died,
because I was so frustrated that
things were out of control,· be says.
•Everything was out of control. I
was confused. It wasn't supposed to
end up this way."
Bennett says he does not know

make sense."
By covering up the murder

The time it took Bennett to dri-
ve home seemed to pass in sec-
onds. His wife, angry that be was
home so late, wouldn't let him in
at flrst. He told her be bad been in
a flght at the Stag Bar to account

Bennett does not explain what
happened to the glals decanter that
police could never find. Kirkwood
says.
•1 think it's pretty dear that be'S
doing what a lot ot defendants do in
this situation -he's giving informa-
tion that can't be proved, and he's
avoiding talking about what can be
proved.

Bennett's addiction was meth1
she says she favored cocaine.
The maniage coasted for about
six months in 1993, during her
pTegMDcy with Bennett's biologi·
cal child, Tosh. They made an
abortive stab at finding religion
together.
But by the time Tosh was an
infant, Bennett was disappearing
for days at a time lo slake his

for the blood on his jacket.
He showered, went to sleep
beside his 4-year-old son, Tyler, and
threw the jacket in a dumpster the
next day. He wanted the story of the
bar fight to be true so badly, he
almost believed it. He says he didn't
remember what really happened
until bis lawyers forced him to
dredge it up.
DOUBTS
That is Bennett's account of the
night of the murder. It has the qual-
ity of a drama unfolding underwa-
ter, distorted, soundless, the figures
insubstantial as shadows. Marie
Powell-Evans does not scream She
does not plead. She has no voice.
In moments of violence, Bennett
typically removes tumself from the
account. The pronoun "I" disap-
pears. He substitutes "she got
killed" for "I killed her· and "she
got tut• for "I hit her.·
Asked If the story jibes with the
confession Bennett gave him,
Deputy Public Defender Leonard
Gumlia is terse: "There is nothing in
the story that is inconsistent with
the physical evidence at the scene."
Yet the woman whose arguments
• helped land Bennett on Death Row,
Deputy District Attorney Carolyn
Kirkwood, describes Bennett's
acx:ount as sell-serving and untrust-
worthy.
"I'm suspicious of it, the whole
drug-induced psychosis, when it
only happens conveniently,· Kirk-
.wood says. "He knows what's going
on. He says that he's in this blackout
kind of state, but he doesn't leave
the jacket lying around the house.
He gets rid of it.•

and he had a fit of remorse that

The description of the rape as
nonviolent also strikes Kirkwood as
dubious, but the woman who sur-
vived being raped by Bennett says
she understands why he would
label it that way.
"He would say the same thing
about mine,• Pamela Braswell says.
"He was trying to be romantic with
me during the rape. paying me
compliments, showing me affection.
It was absolutely bizarre. It's like he
has some awareness that you're
supposed to be kind and caring
during sex.
"He even very gently took my
glasses off and laid them very gen-
tly Of) the mattress, bottom-up, so
the lenses wouldn't get damaged.

The killer confessed to his wife
soon after his arrest in October
1994. lt came as a relief to Karen
Bennett. now 25, who feared she
was going mad.
Their marrlage was a com-
bustible mixture of mutual bad
faith, dope and adulteries on both
sides. He claims she lied a lot; she
claims be Ued compulsively. "I
knew it was sick," she says.
She recalls first meeting him in
wood shop class In Potter Juruor
High School in Fallbrook, where he
left her initially unimpressed. "He
never listened to the teacher,
always did things backwards,· she
says. "I used to tell everyone, 'He's
just so stupid.' w

work as a subcontractor for the
Costa Mesa-based Mike's Carpet

the marriage. Her husband's family
disliked her, and leaving Fallbrook
might quell the tension, give the
couple a chance to rebuild.
On the night of Sept. 27, after dO
argwnent with Bennett, she left to
get a bite at Taco Bell She returned
to frighterung news· A neighbor
had been raped m her apartment
by an attacker who escaped.
It left Karen Bennett feeling vul-
nerable: Her husband left her alone
at home so often. The rapist-at-
large tried to reassure her. "We'll
get that dog you wanted.· she
recalls h.un saying.
On the rughl of Oct. 13, when
Bennett came home late with blood
on his jacket and the story of a bar-
room brawl, his wife kicked him
out of bed. His expression was

Days later, when she found out
about the Powell-Evans mwder -
police wanted Bennett's finger-
prints because he'd done work at
the victim's condo -suspic:ion1
clawed at Karen Bennett. She
called the Stag Bar and learned
there bad been no fight there on
Oct. 13.
·1 would just keep questioning
him about things,• she says. •At
one point he was shaking me and
telling me, 'You think 1 did it!' It
was getting more and more like he
thought I knew.•
She told a relative: "U some-
thing happens to me go to the
police.•
On Oct. 22, she told police he
almost struck her with the car at a
Circle K near Pallbrook. She told
police she feared he was trying to
kill her and why.
Yet when police arrested him on
Oct. 31 at his parents' home in Fall-
brook, genetic evidence having
linked him to the murder, be main-
tained the facade.
"l didn't have sex with an old
lady," he told an Interrogator. "I got
a beautiful wife, so there's no rea-
son for me to have sex with some-
one else."
When Bennett fl.nally confessed
to his wife, within weeks of the
arrest, "it was ~ost like a relief
because I wasn t going crazy," she
says. "I thought I made a horrible
mistake and 1ust rw.ned his We by
pointing the polJce toward him.·

During roughly nine hows of
conversation over a two-day penod,
in the building next door to the
chamber where the state of Califor-
nia plans to kill him. Bennett clings
doggedly to the image of the essen-
bally decent guy. He flashes the
toothpaste-ad smile: No psycholog·
icdl muck here.
Syrupy, textbook-hke plabtudes
punctuate his speech. On sexual
relations: "Sex should be a special
thing between a man and a woman
who are mamed • On why murder
IS wrong: "Life IS the most precious

Only once does Bennett's dis-
gwse seem to slip, as If by accident.
And for a moment -as brief as the
one that almost doomed Braswell -
the homicidal visage squirms mto
view.
"There's not a man on tlus earth

rape a woman," he says, "but be in

flowers every Tuesday. thanks to a

drop off up to four packages at their
local post office. But deliveries of
five or more parcels require an
appoinbnent at a regional parcel'
drop facility.

Mesa are served by the postal ser-
vice's parcel drop location at 3101
W. Sunflower Ave. in Santa Ana.

After the market's agreement
with the city expired last week, it
almost had to pick up its year-old
roots and move.
The McFadden Square agree-
ment that allowed the market to
use a city-owned lot for the market
required that market operators
find free parking for customers
witlun its first year.
When they failed to do that,
officials opted not to renew the
agreement.
Since July 1996, the market has
been selling local residents pro-
duce trucked in from fields in
Orange, San Diego and Riverside
counties.
The first market in the city
opened in Corona del Mar in May
1996 and has continued every Sat-
urday since.
McFadden Square operators
this week managed to get 11 free
parking spaces at 2200 W. Balboa
Blvd., winning a two-month exten-
sion from the city.
Still, the uncertainty, as well as
the lack of parking, has taken its
toll.
·we haven't lost any farmers,·
said market manager Larry
Nedeau of the Orange County
Farm Bureau. ·But we've proba-
bly lost some customers in frustra-
tion."
Customers just don't want to
pay a quarter just for 15 minutes of
perusing produce, Nedeau said.
And nearby merchants were
complaining that market cus-
tomers were talcing up precious
parking spaces.
The two-month extension will
give officials th~ chance to draft a
new agreement, which will even-
tually go before the City Council

The Newport Harbor High 17-and-under girls
water polo team absorbed a pair of heartbreaking
one-goal losses Monday m the second round uf the
1997 National Junior Olympics, held at various
Orange County locales mcludmg Newport Harbor
and Corona del Mar.
Newport battled third-seeded Commerce even-
ly through most of foUI quarters, before the team
with two players from the U.S. national team
scored the game-winner with 14 seconds left to
earn an 8-7 triwnph at CdM.
The Sailors, led by first-team All-CIF Southern
Section performer Alden Moore, then dropped a 4-
3 verdict to Marin, also at CdM.
"We gave Commerce a run for it," said Newport
Coach Brian Kreutzkamp, who noted several
missed opportunibes against Marin.
"We missed a penalty throw, four man advan-
tages and a one-on-nobody with 20 seconds left,"
said Kreutzkarnp, sharing summer coaching
respons1bilibes with Bill Barnett
Moore, an mcorrung senior, led Newport scorers
with three goals against Commerce, while
Kreutzkamp cited strong defensive play from Jen-
na Barto, who will be a sophomore.
Newport has four players who qualify for the
15-and-under age group, but are playing against
older competition.
Moore and Autumn Milliken had two goals
apiece against Marin, while junior Erin Kennedy
also played well in goal.
Newport earned a pair of victories in Sunday's
first round at its own pool, blowing out Rowland,
19-1, then lopping a solid Sacramento A squad, 7-4.
Jocelyn Manderino had three goals against
Sacramento A, while Kennedy held the visitors
from the state capital to just two goals until the
final minute, according lo Kreutzkamp .
Newport's 17-and-under girls, who resume
action today at 8:45 a .m in winner's bracket play
at Servile High, are 1ust one of several local squads
taking part, with boys tournament play beginning
today.
Newport's 15-and-under girls lost to North
Shore, 7-5, and Golden Bear, 4-2, Sunday at Katel-
la High, while Newport's 13-and-under B squad
also dropped fust-day verdicts to Sacramento, 11-
1, and COLA, 13-1, at El Modena High.
Newport's 13-and-under A team opened with a
9-2 victory over ORCA at Valencia High, while
results from their afternoon contest Sunday were
not posted.
Corona del Mar High does not have girls teams
entered, while first-team All-Pacific Coast League
standouts Stephanie Lombardo and Cari Howse
are among the Costa Mesa High representatives
competing for the SoCal 17-and-under squad
based at Foothill High.
