By Jennifer Armstrong, Daily Pilot NEWPORT BEACH -The Upper Newport Bay could be studied, inventoried, tested and monitored, thanks to a slew of environmental bills signed by the governor this week -but its dredging won't get any more funding. Gov. Pete Wilson approved 11 coastline-related bills ~d ordered studies of water quality monitor- ing programs and state policies on marine management. But he didn't approve the one proposal local leaders have been hoping for: a bill that would have created a clearinghouse to fund wetlands restoration throughout the state. That is, a bill that could have provided the remaining $2 mUJion needed for the impending dredg- ing of the Upper Bay. Local officials have collected $2 million from this year's state bud- get and $1 million from the feder- al budget to cover the $.5.4 million cost to suck the muck out of the bay. Leaders of the effort have been counting on the cleannghouse proposal to make up the differ- ence. But Wilson vetoed the idea, saying it would create more unneeded ! "We have been talking with the governor's office about expediting the process in next year's budget.• The dredging will still start next month as planned, comple- ments of a loan from the county, but government sources to repay that money are running dry. Officials will try for private foundation funding and plan to start lobbying the state early for next year's budget cycle, Newport Beach City Manager Kevin, Mur- phy said. "In terms of public dollars, we're done until next year," be said. Some of the govemol's otbs actions this week that could help local waters aim for: • An inventory of water moni- toring programs and reoonunen- dations on reducing water poinu:.: tion. • More coordinated. state ~ des for managing marine habitats. • State testing of mussels, shelled animals that ingest water contaminants and can indicate how toxic the surrounding sea is. r--~------------------·---------~---~-------------·--•,«1-;ft~~,"--~~--~-··~-.~-----~-------~---------·--------------------------------~---------1 El Toro airport opponents sc~re partial victory I I . San Diego Judge Judith McConnell will begin hearing arguments from both sides Tues- day, then issue a final ruling on the lawsuit. In the meantime, county officials must take a hard- er look at the potential environmental effects of the proposal, McConnell said. The lawsuit, filed by South County Cities, challenges the county report that recommended making a commercial airport of the El Toro Marine base when it closes in 1999. The tenta- 1 tive ruling favored airport opponents on nine of their 17 points -but didn't approve their request for an injunction to stop the airport plan- ning process. T h e possible annexation of Bonita Village and New- port Coast is pushtng a lttetime supply of hot buttons. But at least one contentious Jaue has been resolved with t>nly a few 'Yarning shots fired. It was easy. The Newport- Mesa school district simply said it wouldn't dream of enlarging Andersen School so it could handle an influx of hundreds of new students from high-density /Bonita. munity Association Alliance - a citywide coalition of home- owner groups -1s saying, •Whoa, Nellie.• "Why rush into unrecover- able possible mistakes?" asks Alliance chairman Phil Arst. A reasonable question. And here are a few more things these inquiring minds want to know: r--. --- - -• .... • \ ..._ --' obligations ... and those who do not. Those with free garbage service and those without. Those with low-cost Irvine Water District water and those paying (triple that for city water)." The alliance also asks about bonding to ensure that present and future infrastructure costs in the new areas are not "placed on the backs of present ... residents.• The alllance da.lms annexa- tion could result in what amounts to a $25,000 to $50,000 per residence subsidy for The Irvin~ Co. "What provisions have been made for Newport Beach to retain that sum to support the risks (and costs) of annexa- tion?" i COSta Mesa mor ~ Center raises $20,000 V Never mind that the district "There must be sizable and tangible benefits for Newport Beach for any such action and its accompanying risks to be justified. What are they?" "Will annexation zap dty funds needed to refurbish older parts of the city?" In addition to all its ques- tions, the Alliance wants to see the big picture, complete in every detail. What will the city look and be like if all the development, traffic-phasing and annexation proposals currently in various stages of discussion should become reality? 1 The Costa Mma Seni« Center i raised $20,225 during the first l week of fund-raising fc. i1I cam-! paign with a goal of raising i $100,000 by the end of the month, 1 officials said. Almost half ot the 1 total raised came from a $10,000 ! gift from the Segerstrom family, ! while senior center member Hazel ! Klussman donated another $5,000. 1 The Costa Mesa Seniors Center l is a nonprofit corporation th.at 1 offers a wide range of services to ~ seniors from the county. I I already had an architect draw up plans for the expansion. That was before it ran into the buzz saw that was the people whose kids go to Andersen. These folks take no prison- ers. But filling Andersen to the brim ia only one of myriad dis· putes lurking around the annexation maneuvering now going on. One popular scenario holds that if Newport Beach doesn't annex Bonita Village and New- port Coast now, the dty may blow the opportunity of a Ule- time. On the other hand, the Com- "The annexation ... is being rushed for reasons that appar- ently will not benefit Newport Beach. Why?" (And why, I'd like to know, if these territories are so terrific, is the city of Irvine and its school district so eager to let them go?) "Why have no financial justi- fications been published for residents' review?" "Will the two areas be self- supporting in terms of revenues gained versus services required .... If not, who will make up the difference?" •current history shows that (revenue) estimates, such as those for the toll road ... can be inaccurate. Is there an allowance for inaccuracies and contingencies ... plus a 'profit' for the dty?" "The infrastructure of the two areas is incompletely developed and subject to addi- tional Mello-Roos fees. Are these to be paid in advance of any annexation?" "The annexation will create dual classes of citizens .... Those who have Mello-Roos And so it goes. These aren't just $64,000 questions. They involve quality of life and, at the very least, tens of millions of dollars. Some of it is tangible, bard, on-the-ba.uel-head cash. Some is not visible at all. For example, developers in Bonita Village and Newport Coast can build to more lenient county codes. Does that mean lower costs, thus lower housing prices? If so, what will that do to the value of comparable houses built to Newport codes? What will traffic be like, intersection by intersection? How will the city fund growth? What will happen with open areas? Schools? The airport? Taxes? Public safety? Munici- pal overhead? If that big picture ever is painted, I doubt it will be very pretty. . • FRED MARTIN'S column runs every Thursday and Saturday. REG. '3.25 Nature O's Cereal 1:;~·--REG. '2.79 & lo:. H ow come they pursued Sid Soffer so much that he had to leave the area ~d yet they let these people rqpeatedly do these kind of Uiings1 I don't understand. t DAVID SLOANE • Newport Beach ' I I really think the Piecemakers need to be Held to the same codes that all the other business- es in Costa Mesa have to a<ihere t<l It kind of makes me angry tqey're allowed to do things that no other business is allowed to do without some sort of conse- quence. And they may recognize they're not a particularly positive force at times in the community, bUt still they need to follow the same rules everybody else bas to. CAROL HALBACH Costa Mesa Even though they consider tl}emselves a religious group, uiey have stolen property. The pfoperty is the music and the Wo rds of the composers. That is perty just as much as jewelry somebody's home, and there- fdre they violated an ordinance, bµt they also are thieves. I llHEA OOllN NeWJll>rl- I think they ought to leave the Piecemakers alone. The city's got enough cod.es to enforce. They'll take care of themselves with the copyright and patent infringements. So, leave them alone. Let the city work on things. CHAllJ.ES GARDNER Newport Beach I'm for everything that they're doing because they're basically setting the people free from the hierarchy of the gov, ernment, and the people need to be free and able to speak what they want and do whatev- er it takes to be in business. I also wanted to say that Council- woman Heather Somen needs to get off of City Cound.1 and get a.n~ther job with the work, ing people. ' JOHN REDDY Costa Mesa I'm for the Piecernakers, and I think what the City Council has been doing in the past and is still doing to people -taking away their rights and taking away their freedoms -needs to stop. This Heather Somers needs to get off the coundl. CHET NELSON Cotta Meu I hope that Piecemakers ls setting a precedent that other businesses do not have to get a permit to do anything on their own private property. LINDA RYAN Newport- I'm lOO o/o behind the Piece, makers. SHIVAUNCJUSM Costa Mesa I think the staff handled it cor, redly. I th.ink the city and ow- government bas too much red tape, and this is an example. I'm' not saying we need to let this go entirely, but the city has too many rules. ZOEMENKICK Costa Mesa I don't think they handled the Piecemakers right. I think they should handle them like every, body else in town. Just because they're a religious group doesn't mean they should get special handling. KEVIN BURKEMPER Costa Mesa U there's a law and they refuse to abide by it, then they need to pay the penalty. When you cons sider that high schools have to pay to perform plays -and they're certainly in no position to be making any blg profit; they rarely break even in these pro- ductions -and you have some, one like the Piecemalc.ers, they cause a lot of trouble, make a lot of noise, and somehow they keep avoiding any kind of repercus, sion. It's just ll.ke a chlld. You have to teach them that they have to do the right thing 10 that evervthing works the way it should. They get aw~wlth a lot of stuff that regular I just don't get away with. MAGGI llASSJACllSON ComM- I certainly think (Council· woman Heather Somers! was right on target. I back her tOOo/o. I don't understand why some of the coundl memben didn't understand what she was trying to get across. If there are city ordinances regarding permits, I certainly think they should be enforced. I have no personal knowledge of Piecemakers, but everything I've read in the paper and their replies to anything in the paper, they are nothing but troublemakers who think they can do anything they want, and no one will give them any prob- lem. J th.ink the code should be enforced, and they should be penalized for disobeying the law. JOYCE HU1lJ!Jt Costa Mesa Just leave the Piecemak.ers alone. You've been hassling these people for years ever since they had a tearoom too close to residences or something idiotic like that So they didn't have a pennit for little -and I 5tress that -musical According to the Daily Pilot, a permit ts r..quired for most public pelformances - not allf Less than a hundred people showed up for that performance. It wasn't a big deal Leave them alone. I've been to their store, and I've been to their aaft fairs -they're a class ad as far as I'm concerned. Th1.s dty is the most rule-and pennlt-happy community l have ever seen. Just try to add a room onto . your house sometiµle, but that'5 another story. If you want to do something constructive for Ute city, dean it up. There's trash everywhere. Use some of your rule and permit money for a. trash cleanup day. • PATDl!TllO c...a.Meoa ' . I totally agree with JQSeph !If Bell's column on the Piecemakers this morning. I think it's just ridiculous wh.at they're trying to do. I just th.ink they're a cult. They don't want to follow the rules the rest of us need to go by. CAROL MASON Costa Mesa I do not think the city is han, dling it properly. To me, it's like having a bunch of spoiled brats and threatening th.at •When yow dad gets home, you're going to get it• But they never get it. These people are just acting in a vsy rebellious manner. If theta's any connotations of Christians applied to them. I think it's wrong. The city should start slap- ping them down. It's not right what tbey're doing, and u long as they're getting away with it, lfs not galng to lllop. We've got enough, with gangbo.ngers· and all this other stuff, getting away with mwdet, and it's causing our city to go down, down, down. It needs to start somewhere. They're gonna have to start get· ting tough somewhere, and this ts a good place to otarl with l*>- ple like thla. I . Let them enjoy a relaxing •• afternoon or evening at your home, some time in the spa and a fine dinner. It's time they heard, first-hand, how noise (or the lack of it in comparison to 20 years ago) affects our homes and to let them know if the cw:rent El Toro airport footprint were over the Orange County Airport, there would not be one home in it between John Wayne Airport and the Pocific Ocean.
