the bay at the rate of 165,000
cubic yards per year, said Jim
Hutchison, sttidy manager with
the Corps of Engineers.
It's a flow that, if unchecked,
would eventually fill up the bay,
eUminate the inte rtidal areas
where animals thrive, and tum it
into a meadow.

dredging project to restore the
silt-threatened habitat of the Back
The project, a collaboration
between the U.S. Army Corps of
Engineers, the County of Orange
and the city of Newport Beach,
was nearly derailed in June when
a crucial $13-million chunk ·of
funding was lost during state bud-
get negotiations in Sacramento.
The funding was restored by Gov.
Gray Davis, however, and the pro-
ject is now back on track.
"You're slowly degrading the
estuarine habitat," Hutchison said.

Children spend the day playing games like Prison· Ball at a summer sports. camp offered by, Newport Beach
play this week.
It is the fourth session of an
eight-week camp that TWl from 7
a.m. to 6 p.m. Monday through Fri-
day .. The camp is designed to enter-
tain energetic children ages 6 to 12.

between two children who swung
their little arms in a vain attempt to
keep it from hitting the blacktop.
The jailbreak was a success.
It was a rousing game of Prison
Ball for campers enrolled in the
Kids Summer Sports Camp at the
Community Youth Center in Grant
Howald Park.
For those such as myself who
have never beard of such a thing,
Prison Ball is a game where two
teams stand on either side of a
ball wall.
The team with the ball calls out
the name of an opposing team
member just before hurling the ball
over the wall If the ball is caught, it
is the other team's turn. If the ball is
not caught, however, the person
whose name was called is out.
Once people are out, their team-
mates can call ·out the word •pris-
oner" instead of a name to bring the
• imprisoned players back into the ~ame. If three or more teammates
are out, •jailbreak• niay be called
out to bring them all back.
U you think that's confusing,
then you should have heard 7-year-
old Kalen Sprigs breathlessly trying
to explain the game as he dashed
around the ball wall to spy on the
other team.
I have no idea how he did it, but

stray dogs in Tahiti. I guess
stray dogs are a problem in
many South Sea islands.
They certainly were in
Samoa. I don't ~ow what
kind of stray dogs the're are
in Tahiti, but the ones is
Samoa are slmply awful.
Stray dogs in China and
Mexico are generally consid-
e,red the very bottom of the
heap. Nonsense. Compared
to the str dogs in Samoa,
the stra dogs of Mexico and
C ook like best of breed
at any dog show.
Samoa's stray dogs run in
packs. I never went out for a
stroll in the evening without
carrying a 5-iron to ward

completely ignored. All of

Tweeter was the name of
a stray Samoan dog,
although just how a stray
dog get~a name escapes
me. Tweefet was set apart
from the other dogs becaU&e
be bit small children. I don't
know how long he had been
biting sman children, but it
was common knowledge
that he did.
Tweeter once bit the child
of a non-Sa.moan who was
an engineer employed by the
Seashore Drive and 57th
Street. They will whip partic-
ipants into shape using mili-
tary-style exercises.

camp for kids
Orange Coast College is
offering a life science camp
that offers children some
hands-on experiences with
the mysteries of nature.
Children will explore how
food moves through the
ecosystem by dissecting owl
pellets. In addition, students

T hey've starred in dozens of
movies despite weighing
much more than the typical
Hollywood star.
Bill Murray, Whoopie Goldberg,
Goldie Hawn and Brendan Fraser
begged to work with them.
Their schedules are packed with
bips to faraway places, including
Thailand and Hawaii.
But unlike many of their coun-
terparts on the silver screen, these
actors are always prepared when
the cameras start rolling. ·rm not going to mention
names, but they often are much
better at remembering their lines
The elephants featured at the fair have made it
big on the silver screen, with the children
than the professional actors,• said
Kart Johnson, 43, an agent and act-
ing coach for Becky, Dixie, Tai and
five other elephants.
They've starred in •Operation
Dumbo Drop,• •George of the Jun-
gle" and dozens of television com-
mercials.
Dixie, 35, a 7 ,550-pound pachy-
derm, and her more svelte 6,000-
J)ound partner, Becky, 13, are
greeting fans at the Orange Coun-
ty Fair during its two-week run.
Those who pay $3.50 can even ride
on their backs.
Johnson, who lives on a ranch in
Riverside County, said she encour-
ages her talent to meet theii public.
Asian elephants like Johnson's -
slightly smaller than their African
counterparts, with pink freckles on
their trunks -are endangered in
the wild. ,
•The kids come back e.very year
and ask 'Where's R~y. the ele-
phant from last year?'• she said.
•And then they want to learn more
about elephants. When they
become adults, hopefully they'll do
something.•
On Monday afternoon, nearly a
dozen children and their parents
stood in line, waiting to trot around
the sawdust pen atop one of the
fuzzy beasts.

and dumped offshore. The
project will see the level of
th~ay floor lowered by six
feet and the dimensions of
the bay's two major basins
expanded dramatically.
What are today slender
ellipses of water will become
broad, nearly circular pools
that will not need mainte-
nance dredging for more
than 20 years, according to a
study.
The project will also see
the removal of an entire land
mass, the small ·-rem
Island,• which is' at the top of
the bay near the intersection
of Jamboree Road and East-
bluff Drive .. The island will
be relocated to a"location in
the lower buin, near the
mouth of the Santa Ana Del·
hi Channel.
A smaller mass, •Hot Dog
Island,• which is adjacent to
Tern Island, will remain in
place.
The relocation will mean
the upper basin can be
dredged deeper and more
completely, Hutchison said.
Also, the move may {lctually
improve the habitat for the
birds. that nest 'on the island.
ln addition to these large-
scale changes, the dredging
will deepen the channels
a.round land masses near the
shore in the Back Bay, a
process that is expected to
help protect animals from
predators.
The start date for the pro-
ject, even under the best cir-
cumstances, is still distant.

Buffa illustrate the lack of knowl-
edge of ma.RY citizens regarding
the recent U.S. Supreme Court
decision banning student-led
prayers at school events, such as
football games and assemblies.
Many people who ~stion the
ruling in Santa Fe Independent
School District (Texas) vs. Doe do
not understand the content of the
U.S. Constitution's 1st Amend-
ment and the legal status of publJc
,schools as instruments of the gov-
ernment.-
The protection of individual
rights found in the 1st Amend-
ment -and indeed throughout
the remainder of the Bill of Rights
and the main body or the Consti·
tution -are protections against
government intrusion into areas
such as religion, speech and the
press.
In the Santa Fe case, the local
schQOl board had adopted a policy
that allowed students by majority
vote lo choose whether a prayer
should .begin certain school events
and to select a student to deliver
that prayer.
The Supreme Court by a 6-3
vote held the Santa Fe policy was
an example of the government -
in that case a school board -
inappropriately involving itself in
religious matters. In supporting
the court's majority, Justice John
Paul Stevens wrote: •Tue religious
liberty protected by the Constitu-
tion is abridged when the state
. alfirmatively sponsors the particu-
lar religious practice of prayer."
The prohibition of government
involvement in religious matters is
manifested by the court's demand
for governmental neutrality; the
proper constitutional role of gov-
ernment being to neither encour-
age religious practices nor dis-
courage them.
ln the Santa Fe case, the court
ruled that while students -con-
sistent with free-speech protec-
tions -may pray privately on
their own or with friends before,
during or after school, campus
officials cannot sponsor a group
prayer or encourage a student to
deliver a religious message at a
school event.
Thus the core issue in this case
1s not free speech but governmen-
tal intrusion into religion.
Perhaps Smith and Buffa do not
understand that public school
boards are extensions of state
government and, as such, are gov-
ernmental entities. Ortginally. the
prohibitions against government
interference contained in the Bill
of Rights applied only to the
national government. But with the
adoption of the 14th Amendment
in 1868, those prohibitions were
extended to the individual states
as well.
That public schools and public
school officials, including school
board members, are considered
agents of the state is a well-estab-
lished legal principle .• The 1985
U.S. Supreme Court 4th Amend-
ment case, New Jersey vs. TLO,
used the following language to
reiterate that message: ·1n carry-
ing out searches and disciplinary
functions ... school officials act as
representatives of the state, not
just as surrogates for the parents,
and they cannot claim the parent's
immunity from the strictures of the
(Constitution).•
So when local public school
board members or other public
school officials use their positions
to propose the posting of the Ten
Commandments in our schools or
the teaching of creationism (or its
new alias •intelligent design"), or
school prayer, they are not speak-
ing as private citizens. Rather,
they speak as agents of the gov-
ernment, and as such they have
no business promoting tpeir own
particular religious orthodoxy.
The beauty of our educational
system is that those who want
religion and prayer as part of the
school setting have the constitu-
tionally protected opportunity for
a private/parochial school educa-
tion. .
Our basic constitutional rights
are founded on the principle of
protecting the individual from a
government with unrestricted
power.
Consistent with that erinciple is
the protection of the minority from
the tyranny of the majority. Thus,
neither we nor our elected repre-
sentatives can "vote" lo violate or
abridge those basic constitutional
rights, even for a popular cause.
The Supreme Court decisiQn in
Santa Fe lndependent School Dis-
trict vs. Doe rightfully reaffirms ·
that principle.

Stanford 9 test scores:

W ell, the Stanford 9 test
results are out, and it's
ti.me to place the blame
on somebody. Some say-we should
blame the teachers. That's the eas-
iP.st way to explain why some
schools, with yearly predictability,
fall below the 50% level.
In fact, what we need to do is
punish those teachers who can't
get their pupils to at least an 85%
testing level. Surely grave socioe-
conomic or language problems
can't cause low test scores.
While I'm the first to agree bl
some teachers could do a better
job, 1 don't believe their worth
should be determined by lest
results. The incentive to cheat has
grown to epic proportions in states
that use the Stanford 9 as a district
and teacher benchmarlt.
As the results gain more impor-
tance. the frenzy to teach test-tak-
ing methods become more wide-
spread. Thus, while students may,
in fact, be marking more COrTect
answers, their percentage scores
won't necessarily go up. Hali the
schools .will always be below 50%
and half will always be above
50%.
Traditionally, those schools scor-
ing in the top half are the ones
that get the best physical facilities
and equipment, the newest text-
. books, and the most qualified
teachers.
So, if we were really serious
about placing community
resources in the problem areas, we
would switch a student body from
one school to another. But, let's
face it, we aren't that interested in
solving the problem.
Given that scenario, if students
from Andersen Elementary School
in Newport Beach were trans-
ferred to Wilson Elementary
School in Costa Mesa, would they
see a 75% drop in their test
scores? And would the Wtlson kids
suddenly experience \l 75%
increase? No.
Each year I compare my daugh-
ter's test scores to that of the
school and wonder why hers are
so different from the average.
Does the fa~ that some of the stu-
dents made designs with their
answer sheet explain why the
school average might be less? The Newport Beach City Coun-
cil members did the right thing by
postponing the hotel vote and all
the rest of the stuff with the
Dunes. In fact. they should post-
pone it forever. They just really
need to say no. We have so many
traffic problems there. We have
the four Seasons Hotel Newport
Beach. lbe Hyatt Newporter and
the Marriott Hotels Resorti we
don't need another hotel.
I am so relieved the City Coun-
cil members delayed the Dunes
resort vote. At least they're think-
ing hard about it. This is an awful-
ly large plan to put in the wonder-
ful estuary we have, and I just
don't see any reason wh y such a
large resort should be put in
reaction from those of us who live
around the Dunes. The project
could destroy the view of a num-
ber of people who live on the
bluffs above the-ocean. I believe
that U the project doesn't destroy
the Back Bay, it certainly is going
to mess up the area. We don't
need more traffic in Newport
Beach.
I agree with the City Council's ,,.
decision to postpone a vote on the
Dunes until September. We

because her school does not teach
history in ninth grade. The eighth-
grade history teacher bad been told
to teach an extra 70 years of bistcly
to get Ulein prepared for the nintb-

made me a little jealous.
But, with all these vast
improvements in the outer skin
of the game, I have to ask this
question.: Is the game still just as
fun for the youngsters playing? wen. from what I've been

Swarm as it tries to win its third consecutive

Evan is one of the team's top scorer, but
he likes passing even more. He Likes the
power play because of all the assists he
collects.
With Evan, Brett and other strong eighl-
year-old players, AKS Swarm has been ?n a
roll recently. With the players we have. 1t
made Acongio's first yeM on the team a
successful one, and he thmks the chances
of his team three-peating is pretty good.
